Board of Education National Historical Park Expansion and Redesignation Act</shortTitle>”.</content></section>
<section id="d82750e123" identifier="/us/pl/117/123/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REDESIGNATION OF THE BROWN V. BOARD OF EDUCATION NATIONAL HISTORICAL PARK.</heading><subsection class="firstIndent0 fontsize10" id="yeba9fe59-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/123/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeba9fe5a-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s410iiii">16 USC 410iiii note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Brown v. Board of Education National Historic Site established by <ref href="/us/pl/102/525/s103/a">section 103(a) of Public Law 102–525</ref> (<ref href="/us/stat/106/3439">106 Stat. 3439</ref>) shall be known and designated as the “Brown v. Board of Education National Historical Park”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yeba9fe5b-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/123/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">References</inline>.—</heading><content>Any reference in any law, regulation, document, record, map, or other paper of the United States to the Brown v. Board of Education National Historic Site shall be considered to be a reference to the “Brown v. Board of Education National Historical Park”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yeba9fe5c-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/123/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendments</inline>.—</heading><chapeau><ref href="/us/pl/102/525/tI">Title I of Public Law 102–525</ref> (<ref href="/us/stat/106/3438">106 Stat. 3438</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yeba9fe5d-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/123/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the title heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><b>HISTORIC SITE</b></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><b>HISTORICAL PARK</b></quotedText>”;</content></paragraph>

Sharpe, filed in the District of Columbia) that were consolidated into the case of Brown v. Board of Education of Topeka.</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="yebab8516-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>A 1999 historic resources study examined the 5 cases included in Brown v. Board of Education of Topeka and found that each case—</chapeau><subparagraph class="fontsize10" id="yebab8517-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is nationally significant; and</content></subparagraph>
<subparagraph class="fontsize10" id="yebab8518-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>contributes unique stories to the case for educational equity.”</content></subparagraph>

<paragraph class="fontsize10" id="yebab8519-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/123/s3/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (6) (as so redesignated), the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yebabd33a-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><chapeau>With respect to the case of Briggs v. Elliott—</chapeau><subparagraph class="fontsize10" id="yebabd33b-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>Summerton High School in Summerton, South Carolina, the all-White school that refused to admit the plaintiffs in the case—</chapeau><clause class="fontsize10" id="yebabd33c-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>has been listed on the National Register of Historic Places in recognition of the national significance of the school; and</content></clause>
<clause class="fontsize10" id="yebabd33d-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>is used as administrative offices for Clarendon School District 1; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yebabd33e-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the former Scott’s Branch High School, an ‘equalization school’ in Summerton, South Carolina constructed for African-American students in 1951 to provide facilities comparable to those of White students, is now the Community Resource Center owned by Clarendon School District 1.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="yebabd33f-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><chapeau>Robert Russa Moton High School, the all-Black school in Farmville, Virginia, which was the location of a student-led strike leading to Davis v. County School Board of Prince Edward County—<page identifier="/us/stat/136/1198">136 STAT. 1198</page></chapeau><subparagraph class="fontsize10" id="yebabd340-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>has been designated as a National Historic Landmark in recognition of the national significance of the school; and</content></subparagraph>
<subparagraph class="fontsize10" id="yebabd341-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is now the Robert Russa Moton Museum, which is administered by the Moton Museum, Inc., and affiliated with Longwood University.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="yebabd342-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><chapeau>With respect to the case of Belton v. Gebhart—</chapeau><subparagraph class="fontsize10" id="yebabd343-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>Howard High School in Wilmington, Delaware, an all-Black school to which the plaintiffs in the case were forced to travel—</chapeau><clause class="fontsize10" id="yebabfa54-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>has been designated as a National Historic Landmark in recognition of the national significance of the school; and</content></clause>
<clause class="fontsize10" id="yebabfa55-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>is now the Howard High School of Technology, an active school administered by the New Castle County Vocational-Technical School District;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yebabfa56-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the all-White Claymont High School, which denied admission to the plaintiffs, is now the Claymont Community Center administered by the Brandywine Community Resource Council, Inc.; and</content></subparagraph>
<subparagraph class="fontsize10" id="yebabfa57-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>the Hockessin School #107C (Hockessin Colored School)—</chapeau><clause class="fontsize10" id="yebabfa58-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is the all-Black school in Hockessin, Delaware, that 1 of the plaintiffs in the case was required to attend with no public transportation provided; and</content></clause>
<clause class="fontsize10" id="yebabfa59-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>is now used as a community facility by Friends of Hockessin Colored School #107, Inc.</content></clause>

<paragraph class="indentUp0 fontsize10" id="yebabfa5a-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><chapeau>John Philip Sousa Junior High School in the District of Columbia, the all-White school that refused to admit plaintiffs in Bolling v. Sharpe—</chapeau><subparagraph class="fontsize10" id="yebabfa5b-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>has been designated as a National Historic Landmark in recognition of the national significance of the school;</content></subparagraph>

<paragraph class="fontsize10" id="yebacbdcf-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>The Delaware Brown v. <subsection class="indentDown1 firstIndent0 fontsize10" id="yebacbdd4-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><chapeau>Each affiliated area shall be managed in a manner consistent with—</chapeau><paragraph class="fontsize10" id="yebacbdd5-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>this title; and</content></paragraph>
<paragraph class="fontsize10" id="yebacbdd6-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the laws generally applicable to units of the National Park System.</content></paragraph>

<subsection class="indentDown1 firstIndent0 fontsize10" id="yebacbdd7-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xebacbdd8-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Management Plans</inline>.—</heading><paragraph class="fontsize10" id="yebacbdd9-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary, in consultation with the management entity for the applicable affiliated area, shall develop a management plan for each affiliated area.</content></paragraph>
<paragraph class="fontsize10" id="yebacbdda-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>A management plan under paragraph (1) shall—</chapeau><subparagraph class="fontsize10" id="yebacbddb-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xebacbddc-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>be prepared in consultation and coordination with interested State, county, and local governments, management entities, organizations, and interested members of the public associated with the affiliated area;</content></subparagraph>
<subparagraph class="fontsize10" id="yebacbddd-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>identify, as appropriate, the roles and responsibilities of the National Park Service and the management entity in administering and interpreting the affiliated area in a manner that does not interfere with existing operations and continued use of existing facilities; and</content></subparagraph>
<subparagraph class="fontsize10" id="yebacbdde-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>require the Secretary to coordinate the preparation and implementation of the management plan and interpretation of the affiliated area with the historical park.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yebacbddf-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Public comment</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph class="fontsize10" id="yebacbde0-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>hold not less than 1 public meeting in the general proximity of each affiliated area on the proposed management plan, which shall include opportunities for public comment; and</content></subparagraph>
<subparagraph class="fontsize10" id="yebacbde1-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline" id="yebacbde2-e81c-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xebacbde3-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><content>publish the draft management plan on the internet; and</content></clause>
<clause class="indentUp0 fontsize10" id="yebacbde4-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>provide an opportunity for public comment on the draft management plan.</content></clause>

<paragraph class="fontsize10" id="yebacbde5-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Submission</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xebacbde6-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>—</heading><content>Not later than 3 years after the date on which funds are made available to carry out this section, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives the management plan for each affiliated area developed under paragraph (1).</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yebacbde7-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Cooperative Agreements</inline>.—</heading><content>The Secretary may provide technical and financial assistance to, and enter into cooperative agreements with, the management entity for each affiliated area to provide financial assistance for the marketing, marking, interpretation, and preservation of the applicable affiliated area.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yebacbde8-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Land Use</inline>.—</heading><chapeau>Nothing in this section affects—</chapeau><paragraph class="fontsize10" id="yebacbde9-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>land use rights of private property owners within or adjacent to an affiliated area, including activities or uses on private land that can be seen or heard within an affiliated area; or</content></paragraph>
<paragraph class="fontsize10" id="yebacbdea-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the authority of management entities to operate and administer the affiliated areas.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yebacbdeb-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Limited Role of the Secretary</inline>.—</heading><paragraph class="fontsize10" id="yebacbdec-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Nothing in this section authorizes the Secretary—</chapeau><subparagraph class="fontsize10" id="yebacbded-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to acquire land in an affiliated area; or</content></subparagraph>
<subparagraph class="fontsize10" id="yebacbdee-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>to assume financial responsibility for the operation, maintenance, or management of an affiliated area.<page identifier="/us/stat/136/1200">136 STAT. 1200</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yebacbdef-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Ownership</inline>.—</heading><content>Each affiliated area shall continue to be owned, operated, and managed by the applicable public or private owner of the land in the affiliated area.”</content></paragraph>
