<section id="d83159e92" identifier="/us/pl/117/118/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Ukraine Democracy Defense Lend-Lease Act of 2022</shortTitle>”.</content></section>
<section id="d83159e102" identifier="/us/pl/117/118/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>LOAN AND LEASE OF DEFENSE ARTICLES TO THE GOVERNMENTS OF UKRAINE AND EASTERN FLANK COUNTRIES.</heading><subsection class="firstIndent0 fontsize10" id="y24f532ea-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Authority To Lend or Lease Defense Articles to Certain Governments</inline>.—</heading><paragraph class="fontsize10" id="y24f532eb-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x24f532ec-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to paragraph (2), for fiscal years 2022 and 2023, the President may authorize the United States Government to lend or lease defense articles to the Government of Ukraine or to governments of Eastern European countries impacted by the Russian Federation’s invasion of Ukraine to help bolster those countries’ defense capabilities and protect their civilian populations from potential invasion or ongoing aggression by the armed forces of the Government of the Russian Federation.</content></paragraph>
<paragraph class="fontsize10" id="y24f532ed-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Exclusions</inline>.—</heading><chapeau>For the purposes of the authority described in paragraph (1) as that authority relates to Ukraine, the following provisions of law shall not apply:</chapeau><subparagraph class="fontsize10" id="y24f532ee-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Section 503(b)(3) of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2311/b/3">22 U.S.C. 2311(b)(3)</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y24f532ef-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Section 61 of the Arms Export Control Act (<ref href="/us/usc/t22/s2796">22 U.S.C. 2796</ref>).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y24f532f0-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Condition</inline>.—</heading><content>Any loan or lease of defense articles to the Government of Ukraine under paragraph (1) shall be subject to all applicable laws concerning the return of and reimbursement and repayment for defense articles loan or leased to foreign governments.</content></paragraph>
<paragraph class="fontsize10" id="y24f532f1-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Delegation of authority</inline>.—</heading><content>The President may delegate the enhanced authority under this subsection only to an official appointed by the President by and with the advice and consent of the Senate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y24f532f2-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x24f532f3-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Procedures for Delivery of Defense Articles</inline>.—</heading><content>Not later than 60 days after the date of the enactment of this Act, the President shall establish expedited procedures for the delivery of any defense article loaned or leased to the Government of Ukraine <page identifier="/us/stat/136/1185">136 STAT. 1185</page>
under an agreement entered into under subsection (a) to ensure timely delivery of the article to that Government.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y24f532f4-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/118/s2/c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Definition of Defense Article</inline>.—</heading><content>In this Act, the term “<term>defense article</term>” has the meaning given that term in section 47 of the Arms Export Control Act (<ref href="/us/usc/t22/s2794">22 U.S.C. 2794</ref>).</content></subsection>
