<section id="d126875e90" identifier="/us/pl/117/11/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x693323a9-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s301">21 USC 301 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Food Allergy Safety, Treatment, Education, and Research Act of 2021</shortTitle>” or the “<shortTitle role="act">FASTER Act of 2021</shortTitle>”.</content></section>
<section id="d126875e108" identifier="/us/pl/117/11/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FOOD ALLERGY SAFETY.</heading><subsection class="firstIndent0 fontsize10" id="y69334aba-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 201(qq)(1) of the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s321/qq/1">21 U.S.C. 321(qq)(1)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>and soybeans</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>soybeans, and sesame</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y69334abb-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x69334abc-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s321">21 USC 321 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendment made by subsection (a) shall apply to any food that is introduced or delivered for introduction into interstate commerce on or after January 1, 2023.</content></subsection>

<section id="d126875e149" identifier="/us/pl/117/11/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REPORT TO CONGRESS.</heading><subsection class="firstIndent0 fontsize10" id="y6933bfed-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 18 months after the date of enactment of this Act, the Secretary of Health and Human Services (referred to in this section as the “Secretary”) shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that includes—</chapeau><paragraph class="fontsize10" id="y6933bfee-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>descriptions of ongoing Federal activities related to—</chapeau><subparagraph class="fontsize10" id="y6933bfef-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the surveillance and collection of data on the prevalence of food allergies and severity of allergic reactions for specific food or food ingredients, including the identification of any gaps in such activities;</content></subparagraph>
<subparagraph class="fontsize10" id="y6933bff0-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the development of effective food allergy diagnostics;</content></subparagraph>
<subparagraph class="fontsize10" id="y6933bff1-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the prevention of the onset of food allergies;</content></subparagraph>
<subparagraph class="fontsize10" id="y6933bff2-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the reduction of risks related to living with food allergies; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6933bff3-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>the development of new therapeutics to prevent, treat, cure, and manage food allergies; and</content></subparagraph>

<paragraph class="fontsize10" id="y6933bff4-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6933bff5-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x6933bff6-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p><p class="leftAlign firstIndent0 fontsize8" id="x6933bff7-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Strategies.</p></sidenote><chapeau>specific recommendations and strategies to expand, enhance, or improve activities described in paragraph (1), including—</chapeau><subparagraph class="fontsize10" id="y6933bff8-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>strategies to improve the accuracy of food allergy prevalence data by expanding and intensifying current <page identifier="/us/stat/135/263">135 STAT. 263</page>
collection methods, including support for research that includes the identification of biomarkers and tests to validate survey data and the investigation of the use of identified biomarkers and tests in national surveys;</content></subparagraph>
<subparagraph class="fontsize10" id="y6933bff9-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>strategies to overcome gaps in surveillance and data collection activities related to food allergies and specific food allergens; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6933bffa-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>recommendations for the development and implementation of a regulatory process and framework that would allow for the timely, transparent, and evidence-based modification of the definition of “major food allergen” included in section 201(qq) of the Federal Food, Drug and Cosmetic Act (<ref href="/us/usc/t21/s321/qq">21 U.S.C. 321(qq)</ref>), including with respect to—</chapeau><clause class="fontsize10" id="y6933bffb-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the scientific criteria for defining a food or food ingredient as a “major food allergen” pursuant to such process, including recommendations pertaining to evidence of the prevalence and severity of allergic reactions to a food or food ingredient that would be required in order to establish that such food or food ingredient is an allergen of public health concern appropriate for such process; and</content></clause>
<clause class="fontsize10" id="y6933bffc-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/a/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>opportunities for stakeholder engagement and comment, as appropriate, in considering any such modification to such definition.</content></clause>

<subsection class="firstIndent0 fontsize10" id="y6933bffd-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/11/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6933bffe-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Publication</inline>.—</heading><content>The Secretary shall make the report under subsection (a) available on the internet website of the Department of Health and Human Services.</content></subsection>
