<section id="d127426e102" identifier="/us/pl/117/106/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Amache National Historic Site Act</shortTitle>”.</content></section>
<section id="d127426e112" identifier="/us/pl/117/106/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x882ea886-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">   In this Act:</chapeau><paragraph class="fontsize10" id="y882ea887-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>Map</term>” means the map entitled “Amache National Historical Site Proposed Boundary”, numbered 100/175348 and dated July 2021.</content></paragraph>
<paragraph class="fontsize10" id="y882ea888-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">National historic site</inline>.—</heading><content>The term “<term>National Historic Site</term>” means the Amache National Historic Site established by section 3(a).</content></paragraph>
<paragraph class="fontsize10" id="y882ea889-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>

<section id="d127426e146" identifier="/us/pl/117/106/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>AMACHE NATIONAL HISTORIC SITE.</heading><subsection class="firstIndent0 fontsize10" id="y88302f2a-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>Subject to subsection (c), there is established the Amache National Historic Site in the State of Colorado as a unit of the National Park System.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f2b-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Purpose</inline>.—</heading><chapeau>The purpose of the National Historic Site is to preserve, protect, and interpret for the benefit of present and future generations resources associated with—</chapeau><paragraph class="fontsize10" id="y88302f2c-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the incarceration of civilians of Japanese ancestry during World War II at Amache, also known as the Granada Relocation Center, and the military service of center incarcerees;</content></paragraph>
<paragraph class="fontsize10" id="y88302f2d-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>public reaction in the State of Colorado to the incarceration of Japanese Americans, including the position of Governor Ralph Carr and the local community; and</content></paragraph>
<paragraph class="fontsize10" id="y88302f2e-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the transition of the incarcerees and their descendants following the closure of the center and resettlement in the State of Colorado and other States.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f2f-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Determination by the Secretary</inline>.—</heading><content>The National Historic Site shall not be established until the date on which the Secretary determines that a sufficient quantity of land or interests in land has been acquired to constitute a manageable park unit.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f30-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x88302f31-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x88302f32-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Federal Register,</p><p class="leftAlign firstIndent0 fontsize8" id="x88302f33-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">publication.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Notice</inline>.—</heading><content>Not later than 30 days after the Secretary makes a determination under subsection (c), the Secretary shall publish <page identifier="/us/stat/136/1123">136 STAT. 1123</page>
in the Federal Register notice of the establishment of the National Historic Site.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f34-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Boundary; Map</inline>.—</heading><paragraph class="fontsize10" id="y88302f35-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Boundary</inline>.—</heading><content>The boundary of the National Historic Site shall be as generally depicted on the Map.</content></paragraph>
<paragraph class="fontsize10" id="y88302f36-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Availability of map</inline>.—</heading><content>The Map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f37-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Land Acquisition Authority</inline>.—</heading><content>The Secretary may acquire land or interests in land located within the boundary of the Camp Amache National Historic Landmark, as generally depicted on the Map, only by donation.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f38-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Addition to Boundary</inline>.—</heading><content>Any lands or interests in land acquired under subsection (f) shall be included within the boundary of the National Historic Site.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f39-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><paragraph class="fontsize10" id="y88302f3a-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/h/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall administer the National Historic Site in accordance with—</chapeau><subparagraph class="fontsize10" id="y88302f3b-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/h/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="y88302f3c-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/h/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the laws generally applicable to units of the National Park System.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y88302f3d-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/h/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Management plan</inline>.—</heading><subparagraph class="fontsize10" id="y88302f3e-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/h/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Deadline for completion</inline>.—</heading><content>Not later than 3 years after the date on which funds are first made available to the Secretary for this purpose, the Secretary shall prepare a general management plan for the National Historic Site in accordance with <ref href="/us/usc/t54/s100502">section 100502 of title 54, United States Code</ref>.</content></subparagraph>
<subparagraph class="fontsize10" id="y88302f3f-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/h/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Submission to congress</inline>.—</heading><content>On completion of the general management plan under subparagraph (A), the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives the general management plan prepared under that subparagraph.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f40-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/i" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">Administrative Facilities</inline>.—</heading><content>For the purposes of ensuring the preservation, protection, and proper management of the site and associated resources, the Secretary may establish facilities for administration, visitor services, and curation of personal property, outside the boundary of, and in the vicinity of, the National Historic Site.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f41-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/j" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="j">(j) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x88302f42-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Cooperative Agreements</inline>.—</heading><chapeau>The Secretary may enter into agreements with—</chapeau><paragraph class="fontsize10" id="y88302f43-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/j/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the public or private entities for the purpose of establishing and operating facilities outside of the boundary of the National Historic Site for administration, visitor services and curation of personal property; and</content></paragraph>
<paragraph class="fontsize10" id="y88302f44-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/j/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>other public or private entities for the purposes of carrying out this Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y88302f45-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/k" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="k">(k) </num><heading class="fontsize10"><inline class="smallCaps">Effect on Water Rights</inline>.—</heading><chapeau>Except as provided for in subsection (l), nothing in this Act shall affect—</chapeau><paragraph class="fontsize10" id="y88305656-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/k/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the use, allocation, ownership, or control, in existence on the date of the enactment of any water, water right, or any other valid existing right;</content></paragraph>
<paragraph class="fontsize10" id="y88305657-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/k/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>any vested absolute or decreed conditional water right in existence on the date of the enactment;<page identifier="/us/stat/136/1124">136 STAT. 1124</page></content></paragraph>
<paragraph class="fontsize10" id="y88305658-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/k/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>any interstate water compact in existence on the date of the enactment; or</content></paragraph>
<paragraph class="fontsize10" id="y88305659-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/k/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>State jurisdiction over any water law.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8830565a-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/l" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="l">(l) </num><heading class="fontsize10"><inline class="smallCaps">Operation and Maintenance of Water Infrastructure and Appurtenances</inline>.—</heading><paragraph class="fontsize10" id="y8830565b-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/l/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Effect</inline>.—</heading><content>Nothing in this Act affects the authority of the town of Granada, Colorado, with respect to the operation and maintenance of all water infrastructure, systems and appurtenances located within the boundary of the National Historic Site in existence on the date of enactment of this Act, including but not limited to wells, pumps, tanks, water lines, valves, and water treatment facilities.</content></paragraph>
<paragraph class="fontsize10" id="y8830565c-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/l/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Determination</inline>.—</heading><content>The Secretary shall provide the town of Granada, Colorado, with access to those areas of the National Historic Site determined as necessary for the operation and maintenance of water infrastructure and appurtenances.</content></paragraph>
<paragraph class="fontsize10" id="y8830565d-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/l/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">New water infrastructure</inline>.—</heading><chapeau>The Secretary may permit the town of Granada, Colorado, to construct or install new water infrastructure, systems, or appurtenances—</chapeau><subparagraph class="fontsize10" id="y8830565e-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/l/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>consistent with applicable laws;</content></subparagraph>
<subparagraph class="fontsize10" id="y8830565f-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/l/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>limited to the areas determined to be necessary under paragraph (2); and</content></subparagraph>
<subparagraph class="fontsize10" id="y88305660-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/l/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in a manner that ensures the preservation, protection, and proper management of the National Historic Site.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y88305661-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/106/s3/l/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Acceptance of donated water infrastructure</inline>.—</heading><content>The Secretary may accept, for addition to and administration as part of the National Historic Site, the donation of water infrastructure, systems, or appurtenances within the boundary of the National Historic Site, including associated water rights, if the water infrastructure, systems, or appurtenances are no longer used by the town of Granada, Colorado.</content></paragraph>
