<section id="d84000e100" identifier="/us/pl/117/105/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe7212a-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s201">42 USC 201 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Dr. Lorna Breen Health Care Provider Protection Act</shortTitle>”.</content></section>
<section id="d84000e115" identifier="/us/pl/117/105/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe7212b-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s294s">42 USC 294s note</ref>.</p></sidenote><heading>DISSEMINATION OF BEST PRACTICES.</heading><content style="-uslm-lc:I658120"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe7212c-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>  Not later than 2 years after the date of the enactment of this Act, the Secretary of Health and Human Services (referred to in this Act as the “Secretary”) shall identify and disseminate evidence-based or evidence-informed best practices for preventing suicide and improving mental health and resiliency among health care professionals, and for training health care professionals in appropriate strategies to promote their mental health.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe7212d-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x8fe7212e-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote> Such best practices shall include recommendations related to preventing suicide and improving mental health and resiliency among health care professionals.</content></section>
<section id="d84000e136" identifier="/us/pl/117/105/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe7212f-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s294s">42 USC 294s note</ref>.</p></sidenote><heading>EDUCATION AND AWARENESS INITIATIVE ENCOURAGING USE OF MENTAL HEALTH AND SUBSTANCE USE DISORDER SERVICES BY HEALTH CARE PROFESSIONALS.</heading><subsection class="firstIndent0 fontsize10" id="y8fe76f50-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe76f51-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Secretary, in consultation with relevant stakeholders, including medical professional associations, shall establish a national evidence-based or evidence-informed education and awareness initiative—</chapeau><paragraph class="fontsize10" id="y8fe76f52-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to encourage health care professionals to seek support and care for their mental health or substance use concerns, to help such professionals identify risk factors associated with suicide and mental health conditions, and to help such professionals learn how best to respond to such risks, with the goal of preventing suicide, mental health conditions, and substance use disorders; and</content></paragraph>
<paragraph class="fontsize10" id="y8fe76f53-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to address stigma associated with seeking mental health and substance use disorder services.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe76f54-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Secretary shall provide to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives an update on the activities and outcomes of the initiative under subsection (a), including a description of quantitative and qualitative metrics used to evaluate such activities and outcomes.<page identifier="/us/stat/136/1119">136 STAT. 1119</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe76f55-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe76f56-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>To carry out this section, there are authorized to be appropriated $10,000,000 for each of fiscal years 2022 through 2024.</content></subsection>

<section id="d84000e193" identifier="/us/pl/117/105/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>PROGRAMS TO PROMOTE MENTAL HEALTH AMONG THE HEALTH PROFESSIONAL WORKFORCE.</heading><content class="firstIndent0 fontsize10" id="x8fe7bd77-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Subpart I of part E of title VII of the Public Health Service Act (<ref href="/us/usc/t42/s294n/etseq">42 U.S.C. 294n et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y8fe80b98-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="764">“SEC. 764. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe80b99-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s294s">42 USC 294s</ref>.</p></sidenote><heading class="fontsize12">PROGRAMS TO PROMOTE MENTAL HEALTH AMONG THE HEALTH PROFESSIONAL WORKFORCE.</heading><subsection class="firstIndent0 fontsize10" id="y8fe80b9a-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe80b9b-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Grants.</p><p class="leftAlign firstIndent0 fontsize8" id="x8fe80b9c-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Programs to Promote Mental Health Among Health Care Professionals</inline>.—</heading><paragraph class="fontsize10" id="y8fe80b9d-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall award grants or contracts to health care entities, including entities that provide health care services, such as hospitals, community health centers, and rural health clinics, or to medical professional associations, to establish or enhance evidence-based or evidence-informed programs dedicated to improving mental health and resiliency for health care professionals.</content></paragraph>
<paragraph class="fontsize10" id="y8fe80b9e-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Use of funds</inline>.—</heading><chapeau>An eligible entity receiving a grant or contract under this subsection shall use funds received through the grant or contract to implement a new program or enhance an existing program to promote mental health among health care professionals, which may include—</chapeau><subparagraph class="fontsize10" id="y8fe80b9f-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>improving awareness among health care professionals about risk factors for, and signs of, suicide and mental health or substance use disorders, in accordance with evidence-based or evidence-informed practices;</content></subparagraph>
<subparagraph class="fontsize10" id="y8fe80ba0-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>establishing new, or enhancing existing, evidence-based or evidence-informed programs for preventing suicide and improving mental health and resiliency among health care professionals;</content></subparagraph>
<subparagraph class="fontsize10" id="y8fe80ba1-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>establishing new, or enhancing existing, peer-support programs among health care professionals; or</content></subparagraph>
<subparagraph class="fontsize10" id="y8fe80ba2-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>providing mental health care, follow-up services and care, or referral for such services and care, as appropriate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y8fe80ba3-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Priority</inline>.—</heading><content>In awarding grants and contracts under this subsection, the Secretary shall give priority to eligible entities in health professional shortage areas or rural areas.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe80ba4-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Training Grants</inline>.—</heading><content>The Secretary may establish a program to award grants to health professions schools, academic health centers, State or local governments, Indian Tribes or Tribal organizations, or other appropriate public or private nonprofit entities (or consortia of entities, including entities promoting multidisciplinary approaches) to support the training of health care students, residents, or health care professionals in evidence-based or evidence-informed strategies to address mental and substance use disorders and improve mental health and resiliency among health care professionals.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe80ba5-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Grant Terms</inline>.—</heading><content>A grant or contract awarded under subsection (a) or (b) shall be for a period of 3 years.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe80ba6-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Application Submission</inline>.—</heading><content>An entity seeking a grant or contract under subsection (a) or (b) shall submit an application to the Secretary at such time, in such manner, and accompanied by such information as the Secretary may require.<page identifier="/us/stat/136/1120">136 STAT. 1120</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe80ba7-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe80ba8-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><content>An entity awarded a grant or contract under subsection (a) or (b) shall periodically submit to the Secretary a report evaluating the activities supported by the grant or contract.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe80ba9-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe80baa-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>To carry out this section and section 5 of the Dr. Lorna Breen Health Care Provider Protection Act, there are authorized to be appropriated $35,000,000 for each of fiscal years 2022 through 2024.”</content></subsection>

<section id="d84000e338" identifier="/us/pl/117/105/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>REVIEW WITH RESPECT TO HEALTH CARE PROFESSIONAL MENTAL HEALTH AND RESILIENCY.</heading><subsection class="firstIndent0 fontsize10" id="y8fe880db-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe880dc-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x8fe880dd-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than 3 years after the date of enactment of this Act, the Secretary, in consultation with relevant stakeholders, shall—</chapeau><paragraph class="fontsize10" id="y8fe880de-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe880df-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><content>conduct a review on improving health care professional mental health and the outcomes of programs authorized under this Act; and</content></paragraph>
<paragraph class="fontsize10" id="y8fe880e0-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fe880e1-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><content>submit a report to the Congress on the results of such review.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe880e2-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><chapeau>The review under subsection (a) shall take into account—</chapeau><paragraph class="fontsize10" id="y8fe880e3-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the prevalence and severity of mental health conditions among health professionals, and factors that contribute to those mental health conditions;</content></paragraph>
<paragraph class="fontsize10" id="y8fe880e4-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>barriers to seeking and accessing mental health care for health care professionals, which may include consideration of stigma and licensing concerns, and actions taken by State licensing boards, schools for health professionals, health care professional training associations, hospital associations, or other organizations, as appropriate, to address such barriers;</content></paragraph>
<paragraph class="fontsize10" id="y8fe880e5-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the impact of the COVID–19 public health emergency on the mental health of health care professionals and lessons learned for future public health emergencies;</content></paragraph>
<paragraph class="fontsize10" id="y8fe880e6-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>factors that promote mental health and resiliency among health care professionals, including programs or strategies to strengthen mental health and resiliency among health care professionals; and</content></paragraph>
<paragraph class="fontsize10" id="y8fe880e7-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the efficacy of health professional training programs that promote resiliency and improve mental health.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8fe880e8-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Recommendations</inline>.—</heading><chapeau>The review under subsection (a), as appropriate, shall identify best practices related to, and make recommendations to address—</chapeau><paragraph class="fontsize10" id="y8fe880e9-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>improving mental health and resiliency among health care professionals;</content></paragraph>
<paragraph class="fontsize10" id="y8fe880ea-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>removing barriers to mental health care for health care professionals; and</content></paragraph>
<paragraph class="fontsize10" id="y8fe880eb-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/105/s5/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>strategies to promote resiliency among health care professionals in health care settings.</content></paragraph>

<section id="d84000e432" identifier="/us/pl/117/105/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>GAO REPORT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x8fe8a7fc-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not later than 4 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Congress a report on the extent to which Federal substance use disorder and mental health grant programs address the prevalence and severity of mental health conditions and substance use disorders among health professionals.
