<section id="d141230e88" identifier="/us/pl/117/10/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xde9b4afc-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s4501">2 USC 4501 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Senate Shared Employee Act</shortTitle>”.</content></section>
<section id="d141230e103" identifier="/us/pl/117/10/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ALLOWING SENATORS, COMMITTEES, LEADERSHIP OFFICES, AND OTHER OFFICES OF THE SENATE TO SHARE EMPLOYEES.</heading><subsection class="firstIndent0 fontsize10" id="yde9b991d-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/10/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 114 of the Legislative Branch Appropriation Act, 1978 (<ref href="/us/usc/t2/s4576">2 U.S.C. 4576</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yde9b991e-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/10/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(a)</quotedText>” before “<quotedText>Notwithstanding</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="yde9b991f-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/10/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>position, each of</quotedText>” and all that follows through the period at the end and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“qualifying position if the aggregate gross pay from those positions does not exceed—<paragraph class="indentUp0 fontsize10" id="yde9bc030-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the maximum rate specified in section 105(d)(2) of the Legislative Branch Appropriation Act, 1968 (<ref href="/us/usc/t2/s4575/d/2">2 U.S.C. 4575(d)(2)</ref>), as amended and modified; or</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="yde9bc031-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>in a case where 1 or more of the individual’s qualifying positions are positions described in subsection (d)(2)(B), the maximum rate specified in section 105(e)(3) of the Legislative Branch Appropriation Act, 1968 (<ref href="/us/usc/t2/s4575/e/3">2 U.S.C. 4575(e)(3)</ref>), as amended and modified.”</content></paragraph>
</quotedContent>; and</content></paragraph>
<paragraph class="fontsize10" id="yde9bc032-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/10/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yde9c3563-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b)</num><paragraph class="inline" id="yde9c3564-e81d-11f0-bc57-ad3ac4b1618c"><num value="1">(1) </num><content>For an individual serving in more than 1 qualifying position under subsection (a), the cost of any travel for official business shall be paid by the office authorizing the travel.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yde9c3565-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Messages for each electronic mail account used in connection with carrying out the official duties of an individual serving in more than 1 qualifying position under subsection (a) may be delivered to and sent from a single handheld communications device provided to the individual for purposes of official business.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yde9c3566-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3)</num><subparagraph class="inline" id="yde9c3567-e81d-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><content>For purposes of the Ethics in Government Act of 1978 (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>), the rate of basic pay for an individual serving in more than 1 qualifying position under subsection (a) shall be the total basic pay received by the individual from all such positions.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="yde9c3568-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>For an individual serving in more than one qualifying position under subsection (a), for purposes of the rights and obligations described in, or described in the provisions applied under, title II of the Congressional Accountability Act of 1995 (<ref href="/us/usc/t2/s1311/etseq">2 U.S.C. 1311 et seq.</ref>) related to practices used at a time when the individual <page identifier="/us/stat/135/260">135 STAT. 260</page>
is serving in such a qualifying position with an employing office, the rate of pay for the individual shall be the individual rate of pay received from the employing office.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yde9c3569-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c)</num><paragraph class="inline" id="yde9c356a-e81d-11f0-bc57-ad3ac4b1618c"><num value="1">(1) </num><content>If the duties of a qualifying position under subsection (a) include information technology services and support, an individual may only serve in the qualifying position and 1 or more additional qualifying positions under such subsection if the individual is in compliance with each information technology standard and policy established for Senate offices by the Office of the Sergeant at Arms and Doorkeeper of the Senate.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yde9c356b-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>Notwithstanding subsection (a), an employee serving in a qualifying position in the Office of the Secretary of the Senate or the Office of the Sergeant at Arms and Doorkeeper of the Senate may serve in an additional qualifying position only if—</chapeau><subparagraph class="fontsize10" id="yde9c356c-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the other qualifying position is with the other Office; or</content></subparagraph>
<subparagraph class="fontsize10" id="yde9c356d-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Committee on Rules and Administration of the Senate has approved the arrangement.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yde9c356e-e81d-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xde9c5c7f-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definition.</p></sidenote><chapeau>In this section, the term ‘<term>qualifying position</term>’ means a position that—</chapeau><paragraph class="fontsize10" id="yde9c5c80-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>is designated as a shared position for purposes of this section by the Senator or other head of the office in which the position is located; and</content></paragraph>
<paragraph class="fontsize10" id="yde9c5c81-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>is one of the following:</chapeau><subparagraph class="fontsize10" id="yde9c5c82-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>A position—</chapeau><clause class="fontsize10" id="yde9c5c83-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>that is in the office of a Senator; and</content></clause>
<clause class="fontsize10" id="yde9c5c84-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the pay of which is disbursed by the Secretary of the Senate.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yde9c5c85-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>A position—</chapeau><clause class="fontsize10" id="yde9c5c86-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>that is in any committee of the Senate (including a select or special committee) or a joint committee of Congress; and</content></clause>
<clause class="fontsize10" id="yde9c5c87-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the pay of which is disbursed by the Secretary of the Senate out of an appropriation under the heading ‘<headingText class="smallCaps">inquiries and investigations</headingText>’ or ‘<headingText class="smallCaps">Joint Economic Committee</headingText>’, or a heading relating to a Joint Congressional Committee on Inaugural Ceremonies.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yde9c5c88-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>A position—</chapeau><clause class="fontsize10" id="yde9c5c89-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>that is in another office (excluding the Office of the Vice President and the Office of the Chaplain of the Senate); and</content></clause>
<clause class="fontsize10" id="yde9c5c8a-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the pay of which is disbursed by the Secretary of the Senate out of an appropriation under the heading ‘<headingText class="smallCaps">Salaries, Officers and Employees</headingText>’.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yde9c5c8b-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><chapeau>A position—</chapeau><clause class="fontsize10" id="yde9c5c8c-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>that is filled pursuant to section 105 of the Second Supplemental Appropriations Act, 1978 (<ref href="/us/usc/t2/s6311">2 U.S.C. 6311</ref>); and</content></clause>
<clause class="fontsize10" id="yde9c5c8d-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the pay of which is disbursed by the Secretary of the Senate out of an appropriation under the heading ‘<headingText class="smallCaps">miscellaneous items</headingText>’.”</content></clause>

<subsection class="firstIndent0 fontsize10" id="yde9c5c8e-e81d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/10/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xde9c5c8f-e81d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s4576">2 USC 4576 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by subsection (a) shall take effect beginning on the day that is 6 months after the date of enactment of this Act.</content></subsection>
