<subparagraph class="fontsize10" id="yd6ca2495-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Armed Services of the Senate;</content></subparagraph>

<subparagraph class="fontsize10" id="yd6ca249c-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/1/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the Committee on Homeland Security of the House of Representatives; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd6ca249d-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/1/J" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">(J) </num><content>the Committee on the Judiciary of the House of Representatives.</content></subparagraph>

<paragraph class="fontsize10" id="yd6ca249e-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Social credit system</inline>.—</heading><chapeau>The term “<term>social credit system</term>” means a system proposed by the Government of the People’s <page identifier="/us/stat/133/1162">133 STAT. 1162</page>
Republic of China and scheduled for implementation by 2020, which would—</chapeau><subparagraph class="fontsize10" id="yd6ca4baf-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>use existing financial credit systems, public records, online activity, and other tools of surveillance to aggregate data on every Chinese citizen and business; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd6ca4bb0-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>use such data to monitor, shape, and rate certain financial, social, religious, or political behaviors.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd6ca4bb1-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">United states person</inline>.—</heading><chapeau>The term “<term>United States person</term>” means—</chapeau><subparagraph class="fontsize10" id="yd6ca4bb2-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a United States citizen;</content></subparagraph>
<subparagraph class="fontsize10" id="yd6ca4bb3-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a lawfully admitted permanent resident of the United States; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd6ca4bb4-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>an entity organized under the laws of—</chapeau><clause class="fontsize10" id="yd6ca4bb5-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the United States; or</content></clause>
<clause class="fontsize10" id="yd6ca4bb6-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s2/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any jurisdiction within the United States, including a foreign branch of such an entity.</content></clause>

</paragraph>
</section>
<section id="d164143e305" identifier="/us/pl/116/76/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6ca4bb7-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s5701">22 USC 5701 note</ref>.</p></sidenote><heading>STATEMENT OF POLICY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd6cae7f8-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the policy of the United States—</chapeau><paragraph class="fontsize10" id="yd6cae7f9-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>to reaffirm the principles and objectives set forth in the United States-Hong Kong Policy Act of 1992 (<ref href="/us/pl/102/383">Public Law 102–383</ref>), namely that—</chapeau><subparagraph class="fontsize10" id="yd6cae7fa-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the United States has “a strong interest in the continued vitality, prosperity, and stability of Hong Kong”;</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cae7fb-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>“[s]upport for democratization is a fundamental principle of United States foreign policy” and therefore “naturally applies to United States policy toward Hong Kong”;</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cae7fc-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>“the human rights of the people of Hong Kong are of great importance to the United States and are directly relevant to United States interests in Hong Kong [and] serve as a basis for Hong Kong’s continued economic prosperity”; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cae7fd-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Hong Kong must remain sufficiently autonomous from the People’s Republic of China to “justify treatment under a particular law of the United States, or any provision thereof, different from that accorded the People’s Republic of China”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd6cae7fe-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>to support the high degree of autonomy and fundamental rights and freedoms of the people of Hong Kong, as enumerated by—</chapeau><subparagraph class="fontsize10" id="yd6cae7ff-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Joint Declaration of the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the People’s Republic of China on the Question of Hong Kong, done at Beijing December 19, 1984 (referred to in this Act as the “Joint Declaration”);</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cae800-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the International Covenant on Civil and Political Rights, done at New York December 19, 1966; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cae801-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the Universal Declaration of Human Rights, done at Paris December 10, 1948;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd6cae802-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to support the democratic aspirations of the people of Hong Kong, including the “ultimate aim” of the selection of the Chief Executive and all members of the Legislative Council by universal suffrage, as articulated in the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China (referred to in this Act as the “Basic Law”);<page identifier="/us/stat/133/1163">133 STAT. 1163</page></content></paragraph>
<paragraph class="fontsize10" id="yd6cae803-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to urge the Government of the People’s Republic of China to uphold its commitments to Hong Kong, including allowing the people of Hong Kong to govern Hong Kong with a high degree of autonomy and without undue interference, and ensuring that Hong Kong voters freely enjoy the right to elect the Chief Executive and all members of the Hong Kong Legislative Council by universal suffrage;</content></paragraph>
<paragraph class="fontsize10" id="yd6cae804-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>to support the establishment of a genuine democratic option to freely and fairly nominate and elect the Chief Executive of Hong Kong, and the establishment by 2020 of open and direct democratic elections for all members of the Hong Kong Legislative Council;</content></paragraph>
<paragraph class="fontsize10" id="yd6cae805-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>to support the robust exercise by residents of Hong Kong of the rights to free speech, the press, and other fundamental freedoms, as provided by the Basic Law, the Joint Declaration, and the International Covenant on Civil and Political Rights;</content></paragraph>
<paragraph class="fontsize10" id="yd6cae806-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>to support freedom from arbitrary or unlawful arrest, detention, or imprisonment for all Hong Kong residents, as provided by the Basic Law, the Joint Declaration, and the International Covenant on Civil and Political Rights;</content></paragraph>
<paragraph class="fontsize10" id="yd6cae807-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>to draw international attention to any violations by the Government of the People’s Republic of China of the fundamental rights of the people of Hong Kong, as provided by the International Covenant on Civil and Political Rights, and any encroachment upon the autonomy guaranteed to Hong Kong by the Basic Law and the Joint Declaration;</content></paragraph>
<paragraph class="fontsize10" id="yd6cae808-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>to protect United States citizens and long-term permanent residents living in Hong Kong, as well as people visiting and transiting through Hong Kong;</content></paragraph>
<paragraph class="fontsize10" id="yd6cae809-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>to maintain the economic and cultural ties that provide significant benefits to both the United States and Hong Kong; and</content></paragraph>
<paragraph class="fontsize10" id="yd6cae80a-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s3/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>to coordinate with allies, including the United Kingdom, Australia, Canada, Japan, and the Republic of Korea, to promote democracy and human rights in Hong Kong.</content></paragraph>

<paragraph class="fontsize10" id="yd6cb844e-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content><amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="yd6cc479f-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="205">“SEC. 205. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47a0-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s5725">22 USC 5725</ref>.</p></sidenote><heading class="fontsize12">SECRETARY OF STATE REPORT REGARDING THE AUTONOMY OF HONG KONG.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="yd6cc47a1-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Certification</inline>.—</heading><paragraph class="fontsize10" id="yd6cc47a2-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in subsection (b), the Secretary of State, on at least an annual basis, and in conjunction with the report required under section 301, shall issue a certification to Congress that—</chapeau><subparagraph class="fontsize10" id="yd6cc47a3-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>indicates whether Hong Kong continues to warrant treatment under United States law in the same manner as United States laws were applied to Hong Kong before July 1, 1997;<page identifier="/us/stat/133/1164">133 STAT. 1164</page></content></subparagraph>
<subparagraph class="fontsize10" id="yd6cc47a4-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>addresses—</chapeau><clause class="fontsize10" id="yd6cc47a5-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>commercial agreements;</content></clause>
<clause class="fontsize10" id="yd6cc47a6-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>law enforcement cooperation, including extradition requests;</content></clause>
<clause class="fontsize10" id="yd6cc47a7-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>sanctions enforcement;</content></clause>
<clause class="fontsize10" id="yd6cc47a8-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>export controls, and any other agreements and forms of exchange involving dual use, critical, or other sensitive technologies;</content></clause>
<clause class="fontsize10" id="yd6cc47a9-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>any formal treaties or agreements between the United States and Hong Kong;</content></clause>
<clause class="fontsize10" id="yd6cc47aa-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>other areas of bilateral cooperation that the Secretary determines to be relevant; and</content></clause>
<clause class="fontsize10" id="yd6cc47ab-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><chapeau>decision-making within the Government of Hong Kong, including executive, legislative, and judicial structures, including—</chapeau><subclause class="fontsize10" id="yd6cc47ac-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>freedom of assembly;</content></subclause>
<subclause class="fontsize10" id="yd6cc47ad-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>freedom of speech;</content></subclause>
<subclause class="fontsize10" id="yd6cc47ae-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>freedom of expression; and</content></subclause>
<subclause class="fontsize10" id="yd6cc47af-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>freedom of the press, including the Internet and social media;</content></subclause>

<clause class="fontsize10" id="yd6cc47b0-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">“(viii) </num><content>universal suffrage, including the ultimate aim of the selection of the Chief Executive and all members of the Legislative Council by universal suffrage;</content></clause>
<clause class="fontsize10" id="yd6cc47b1-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">“(ix) </num><content>judicial independence;</content></clause>
<clause class="fontsize10" id="yd6cc47b2-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="x">“(x) </num><content>police and security functions;</content></clause>
<clause class="fontsize10" id="yd6cc47b3-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xi">“(xi) </num><content>education;</content></clause>
<clause class="fontsize10" id="yd6cc47b4-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xii">“(xii) </num><content>laws or regulations regarding treason, secession, sedition, subversion against the Central People’s Government of the People’s Republic of China, or theft of state secrets;</content></clause>
<clause class="fontsize10" id="yd6cc47b5-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xiii">“(xiii) </num><content>laws or regulations regarding foreign political organizations or bodies;</content></clause>
<clause class="fontsize10" id="yd6cc47b6-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xiv">“(xiv) </num><content>laws or regulations regarding political organizations; and</content></clause>
<clause class="fontsize10" id="yd6cc47b7-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xv">“(xv) </num><content>other rights enumerated in the Universal Declaration of Human Rights, done at Paris December 10, 1948, and the International Covenant on Civil and Political Rights, done at New York December 19, 1966; and</content></clause>

<subparagraph class="fontsize10" id="yd6cc47b8-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>includes—</chapeau><clause class="fontsize10" id="yd6cc47b9-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47ba-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>an assessment of the degree of any erosions to Hong Kong’s autonomy in each category listed in subparagraph (B) resulting from actions by the Government of the People’s Republic of China that are inconsistent with its commitments under the Basic Law or the Joint Declaration;</content></clause>
<clause class="fontsize10" id="yd6cc47bb-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47bc-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>an evaluation of the specific impacts to any areas of cooperation between the United States and Hong Kong resulting from erosions of autonomy in Hong Kong or failures of the Government of Hong Kong to fulfill obligations to the United States under international agreements within the categories listed in subparagraph (B); and</content></clause>
<clause class="fontsize10" id="yd6cc47bd-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47be-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>a list of any specific actions taken by the United States Government in response to any erosion of autonomy or failures to fulfill obligations to the <page identifier="/us/stat/133/1165">133 STAT. 1165</page>
United States under international agreements identified in this certification and the report required under section 301.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd6cc47bf-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Factor for consideration</inline>.—</heading><content>In making each certification under paragraph (1), the Secretary of State should consider the terms, obligations, and expectations expressed in the Joint Declaration with respect to Hong Kong.</content></paragraph>
<paragraph class="fontsize10" id="yd6cc47c0-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47c1-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47c2-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional certifications</inline>.—</heading><content>The certification under section (1) shall be issued annually, but the Secretary may issue additional certifications at any time if the Secretary determines it is warranted by circumstances in Hong Kong.</content></paragraph>

<subsection class="indentDown1 firstIndent0 fontsize10" id="yd6cc47c3-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Waiver Authority</inline>.—</heading><paragraph class="fontsize10" id="yd6cc47c4-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary of State may waive the application of subsection (a) if—</chapeau><subparagraph class="fontsize10" id="yd6cc47c5-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47c6-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the Secretary determines that such a waiver is in the national security interests of the United States; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cc47c7-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47c8-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p></sidenote><content>on or before the date on which the waiver takes effect, the Secretary notifies the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives of the intent to waive such subsection;</content></subparagraph>

<paragraph class="fontsize10" id="yd6cc47c9-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc47ca-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Partial waiver</inline>.—</heading><content>Except for the list of actions described in subsection (a)(1)(C)(iii), the Secretary of State may waive relevant parts of the application of subsection (a) if the President issues an Executive order under section 202 that suspends the application of any particular United States law to Hong Kong.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yd6cc95f0-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><chapeau>The Secretary of State shall take such steps as may be necessary to ensure that consular officers are aware of the policy described in subsection (a) and receive appropriate training and support to ensure that the policy is carried out so that affected individuals do not face discrimination or unnecessary delay in the processing of their visa applications, including—</chapeau><paragraph class="fontsize10" id="yd6cc95f1-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>providing specialized training for all consular officers posted to the United States Embassy in Beijing or to any United States consulate in the People’s Republic of China, the Hong Kong Special Administrative Region, or the Macau Special Administrative Region;</content></paragraph>
<paragraph class="fontsize10" id="yd6cc95f2-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc95f3-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>instructing the United States Consulate in Hong Kong to maintain an active list of individuals who are known to have been formally charged, detained, or convicted by the Government of Hong Kong Special Administrative Region or <page identifier="/us/stat/133/1166">133 STAT. 1166</page>
by the Government of the People’s Republic of China, or intermediaries of such governments, based on politically-motivated considerations related to their exercise of rights enumerated in the Universal Declaration of Human Rights, done at Paris December 10, 1948, or the International Covenant on Civil and Political Rights, done at New York December 19, 1966, to facilitate the cross-checking of visa applications for Hong Kong residents; and</content></paragraph>
<paragraph class="fontsize10" id="yd6cc95f4-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc95f5-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Websites.</p></sidenote><content>updating any relevant United States Government websites with information on the policy described in subsection (a).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cc95f6-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Cooperation With Like-minded Countries</inline>.—</heading><chapeau>The Secretary of State shall contact appropriate representatives of other democratic countries, particularly those who receive a large number of applicants for student and employment visas from Hong Kong—</chapeau><paragraph class="fontsize10" id="yd6cc95f7-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>to inform them of the United States policy regarding arrests for participation in nonviolent protests in Hong Kong; and</content></paragraph>
<paragraph class="fontsize10" id="yd6cc95f8-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>to encourage them to take similar steps to ensure the rights of nonviolent protesters are protected from discrimination due to the actions of the Government of Hong Kong and of the Government of the People’s Republic of China.”</content></paragraph>

<section id="d164143e800" identifier="/us/pl/116/76/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cc95f9-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s5701">22 USC 5701 note</ref>.</p></sidenote><heading>ANNUAL REPORT ON VIOLATIONS OF UNITED STATES EXPORT CONTROL LAWS AND UNITED NATIONS SANCTIONS OCCURRING IN HONG KONG.</heading><subsection class="firstIndent0 fontsize10" id="yd6cd594a-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cd594b-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="xd6cd594c-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="xd6cd594d-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, and annually thereafter until the date that is 7 years after the date of the enactment of this Act, the Secretary of Commerce, in consultation with the Secretary of the Treasury and the Secretary of State, shall submit a report to the committees specified in subsection (b) that includes—</chapeau><paragraph class="fontsize10" id="yd6cd594e-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>an assessment of the nature and extent of violations of United States export control and sanctions laws occurring in Hong Kong;</content></paragraph>
<paragraph class="fontsize10" id="yd6cd594f-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>to the extent possible, the identification of—</chapeau><subparagraph class="fontsize10" id="yd6cd5950-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any items that were reexported from Hong Kong in violation of the laws referred to in paragraph (1);</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cd5951-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the countries and persons to which the items referred to in subparagraph (A) were reexported; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cd5952-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>how such items were used;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd6cd5953-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>an assessment of whether sensitive dual-use items subject to the export control laws of the United States are being—</chapeau><subparagraph class="fontsize10" id="yd6cd5954-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>transshipped through Hong Kong; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cd5955-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>used to develop—</chapeau><clause class="fontsize10" id="yd6cd5956-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Sharp Eyes, Skynet, Integrated Joint Operations Platform, or other systems of mass surveillance and predictive policing; or</content></clause>
<clause class="fontsize10" id="yd6cd5957-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the “social credit system” of the People’s Republic of China;</content></clause>

<paragraph class="fontsize10" id="yd6cd5958-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>an assessment of the efforts by the Government of the People’s Republic of China to use the status of Hong Kong as a separate customs territory to import items into the People’s Republic of China from Hong Kong in violation of the export control laws of the United States, whether as part of the Greater Bay Area plan, through the assignment by Beijing of Hong Kong as a national technology and innovation center, <page identifier="/us/stat/133/1167">133 STAT. 1167</page>
or through other programs that may exploit Hong Kong as a conduit for controlled sensitive technology;</content></paragraph>
<paragraph class="fontsize10" id="yd6cd5959-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>an assessment of whether the Government of Hong Kong has adequately enforced sanctions imposed by the United Nations;</content></paragraph>
<paragraph class="fontsize10" id="yd6cd595a-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><chapeau>a description of the types of goods and services transshipped or reexported through Hong Kong in violation of such sanctions to—</chapeau><subparagraph class="fontsize10" id="yd6cd595b-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>North Korea or Iran; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cd595c-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>other countries, regimes, or persons subject to such sanctions for engaging in activities—</chapeau><clause class="fontsize10" id="yd6cd595d-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/6/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>relating to international terrorism, international narcotics trafficking, or the proliferation of weapons of mass destruction; or</content></clause>
<clause class="fontsize10" id="yd6cd595e-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/6/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>that otherwise present a threat to the national security, foreign policy, or economy of the United States; and</content></clause>

</paragraph>
<paragraph class="fontsize10" id="yd6cd595f-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/a/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>an assessment of whether shortcomings in the enforcement of export controls or sanctions by the Government of Hong Kong necessitates the assignment of additional Department of the Treasury, Department of Commerce, or Department of State personnel to the United States Consulate in Hong Kong.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cd5960-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Committees Specified</inline>.—</heading><chapeau>The committees specified in this subsection are—</chapeau><paragraph class="fontsize10" id="yd6cd5961-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Foreign Relations of the Senate;</content></paragraph>
<paragraph class="fontsize10" id="yd6cd5962-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Banking, Housing, and Urban Affairs of the Senate;</content></paragraph>

<section id="d164143e965" identifier="/us/pl/116/76/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cd7f77-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s5701">22 USC 5701 note</ref>.</p></sidenote><heading>PROTECTING UNITED STATES CITIZENS AND OTHERS FROM RENDITION TO THE PEOPLE’S REPUBLIC OF CHINA.</heading><subsection class="firstIndent0 fontsize10" id="yd6cdcd98-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Policy Statements</inline>.—</heading><chapeau>It is the policy of the United States—</chapeau><paragraph class="fontsize10" id="yd6cdcd99-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to safeguard United States citizens from extradition, rendition, or abduction to the People’s Republic of China from Hong Kong for trial, detention, or any other purpose;</content></paragraph>
<paragraph class="fontsize10" id="yd6cdcd9a-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to safeguard United States businesses in Hong Kong from economic coercion and intellectual property theft;</content></paragraph>
<paragraph class="fontsize10" id="yd6cdcd9b-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s6/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>pursuant to section 103(7) of the United States-Hong Kong Policy Act of 1992 (<ref href="/us/usc/t22/s5713/7">22 U.S.C. 5713(7)</ref>), to encourage United States businesses “to continue to operate in Hong Kong, in accordance with applicable United States and Hong Kong law”; and</content></paragraph>

<paragraph class="fontsize10" id="yd6cdcda3-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cdcda4-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>assesses the potential risks of the legislation to United States citizens residing in, traveling to, or transiting through Hong Kong; and</content></paragraph>

<paragraph class="fontsize10" id="yd6cf5451-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Timing of reports</inline>.—</heading><chapeau>The President shall submit to the appropriate congressional committees—</chapeau><subparagraph class="fontsize10" id="yd6cf5452-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>the report required under paragraph (1)—</chapeau><clause class="fontsize10" id="yd6cf5453-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>not later than 180 days after the date of the enactment of this Act; and</content></clause>

<subparagraph class="fontsize10" id="yd6cf5456-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an update to the report not later than 15 days after any new action is taken under subsection (b) based on the discovery of new information described in paragraph (1).</content></subparagraph>

<paragraph class="fontsize10" id="yd6cf5457-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Consideration of certain information</inline>.—</heading><chapeau>In preparing the report required under paragraph (1), the President shall consider—</chapeau><subparagraph class="fontsize10" id="yd6cf7b68-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>information provided jointly by the chairperson and ranking member of each of the appropriate congressional committees; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cf7b69-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>information obtained by other countries or reputable nongovernmental organizations that monitor violations of human rights abuses.<page identifier="/us/stat/133/1169">133 STAT. 1169</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd6cf7b6a-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The report required under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cf7b6b-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Imposition of Sanctions</inline>.—</heading><content>The President shall impose the sanctions described in subsection (c) with respect to each foreign person identified in the report required under subsection (a)(1).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cf7b6c-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Sanctions Described</inline>.—</heading><chapeau>The sanctions described in this subsection are the following:</chapeau><paragraph class="fontsize10" id="yd6cf7b6d-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Asset blocking</inline>.—</heading><content>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>) to the extent necessary to block and prohibit all transactions in property and interests in property of a foreign person identified in the report required under subsection (a)(1) if such property and interests in property are in the United States, come within the United States, or come within the possession or control of a United States person.</content></paragraph>
<paragraph class="fontsize10" id="yd6cf7b6e-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Ineligibility for visas, admission, or parole</inline>.—</heading><subparagraph class="fontsize10" id="yd6cf7b6f-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Visas, admission, or parole</inline>.—</heading><chapeau>An alien described in subsection (a)(1) is—</chapeau><clause class="fontsize10" id="yd6cf7b70-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>inadmissible to the United States;</content></clause>
<clause class="fontsize10" id="yd6cf7b71-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>ineligible to receive a visa or other documentation to enter the United States; and</content></clause>
<clause class="fontsize10" id="yd6cf7b72-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/etseq">8 U.S.C. 1101 et seq.</ref>).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yd6cf7b73-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Current visas revoked</inline>.—</heading><clause class="fontsize10" id="yd6cf7b74-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>An alien described in subsection (a)(1) is subject to revocation of any visa or other entry documentation regardless of when the visa or other entry documentation is or was issued.</content></clause>
<clause class="fontsize10" id="yd6cf7b75-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Immediate effect</inline>.—</heading><chapeau>A revocation under clause (i) shall—</chapeau><subclause class="fontsize10" id="yd6cf7b76-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>take effect immediately; and</content></subclause>
<subclause class="fontsize10" id="yd6cf7b77-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/2/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>automatically cancel any other valid visa or entry documentation that is in the alien’s possession.</content></subclause>

</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd6cf7b78-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cf7b79-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Penalties</inline>.—</heading><content>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1705">50 U.S.C. 1705</ref>) shall apply to a foreign person that violates, attempts to violate, conspires to violate, or causes a violation of paragraph (1) to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of such section 206.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cf7b7a-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><content>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1702">50 U.S.C. 1702</ref> and 1704) to carry out this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cf7b7b-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cf7b7c-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xd6cf7b7d-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Certification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Waiver</inline>.—</heading><content>The President may waive the application of sanctions under this section with respect to a person identified in the report required under subsection (a)(1) if the President determines and certifies to the appropriate congressional committees that such a waiver is in the national interest of the United States.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cf7b7e-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><paragraph class="fontsize10" id="yd6cf7b7f-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Exception for intelligence activities</inline>.—</heading><content>Sanctions under this section shall not apply to any activity subject to <page identifier="/us/stat/133/1170">133 STAT. 1170</page>
the reporting requirements under title V of the National Security Act of 1947 (<ref href="/us/usc/t50/s3091/etseq">50 U.S.C. 3091 et seq.</ref>) or any authorized intelligence activities of the United States.</content></paragraph>
<paragraph class="fontsize10" id="yd6cf7b80-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Exception to comply with international obligations and for law enforcement activities</inline>.—</heading><chapeau>Sanctions under subsection (c)(2) shall not apply with respect to an alien if admitting or paroling the alien into the United States is necessary—</chapeau><subparagraph class="fontsize10" id="yd6cf7b81-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/f/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cf7b82-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/f/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to carry out or assist law enforcement activity in the United States.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd6cf7b83-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/f/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Exception relating to importation of goods</inline>.—</heading><subparagraph class="fontsize10" id="yd6cf7b84-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/f/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The authorities and requirements to impose sanctions authorized under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cf7b85-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/f/3/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Good defined</inline>.—</heading><content>In this paragraph, the term “<term>good</term>” means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cf7b86-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cf7b87-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xd6cf7b88-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Termination of Sanctions</inline>.—</heading><chapeau>The President may terminate the application of sanctions under this section with respect to a person if the President determines and reports to the appropriate congressional committees not less than 15 days before the termination takes effect that—</chapeau><paragraph class="fontsize10" id="yd6cf7b89-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>information exists that the person did not engage in the activity for which sanctions were imposed;</content></paragraph>
<paragraph class="fontsize10" id="yd6cf7b8a-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the person has been prosecuted appropriately for the activity for which sanctions were imposed;</content></paragraph>
<paragraph class="fontsize10" id="yd6cf7b8b-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the person has credibly demonstrated a significant change in behavior, has paid an appropriate consequence for the activity for which sanctions were imposed, and has credibly committed to not engage in an activity described in subsection (a)(1) in the future; or</content></paragraph>
<paragraph class="fontsize10" id="yd6cf7b8c-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/g/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the termination of the sanctions is in the national security interests of the United States.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cf7b8d-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>This section, and any sanctions imposed under this section, shall terminate on the date that is 5 years after the date of the enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cf7b8e-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/i" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yd6cf7b8f-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/i/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Admission; admitted; alien</inline>.—</heading><content>The terms “admission”, “admitted”, and “alien” have the meanings given those terms in section 101 of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101">8 U.S.C. 1101</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yd6cf7b90-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s7/i/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Foreign person</inline>.—</heading><content>The term “<term>foreign person</term>” means a person that is not a United States person.</content></paragraph>

<section id="d164143e1465" identifier="/us/pl/116/76/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cf7b91-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="xd6cf7b92-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s5701">22 USC 5701 note</ref>.</p></sidenote><heading>SANCTIONS REPORTS.</heading><subsection class="firstIndent0 fontsize10" id="yd6cfc9b3-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s8/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>In accordance with section 7, the President shall submit, to the appropriate congressional committees, a report that includes—<page identifier="/us/stat/133/1171">133 STAT. 1171</page></chapeau><paragraph class="fontsize10" id="yd6cfc9b4-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s8/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cfc9b5-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>a list of each foreign person with respect to which the President imposed sanctions during the year preceding the submission of the report;</content></paragraph>
<paragraph class="fontsize10" id="yd6cfc9b6-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s8/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a description of the type of sanctions imposed with respect to each such person;</content></paragraph>
<paragraph class="fontsize10" id="yd6cfc9b7-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s8/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the number of foreign persons with respect to which the President terminated sanctions under section 7 during that year;</content></paragraph>
<paragraph class="fontsize10" id="yd6cfc9b8-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s8/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the dates on which such sanctions were imposed or terminated, as applicable;</content></paragraph>
<paragraph class="fontsize10" id="yd6cfc9b9-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s8/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the reasons for imposing or terminating such sanctions; and</content></paragraph>
<paragraph class="fontsize10" id="yd6cfc9ba-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s8/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>a description of the efforts of the President to encourage the governments of other countries to impose sanctions that are similar to the sanctions authorized under section 7.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd6cfc9bb-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s8/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Nonapplicability of Confidentiality Requirement With Respect to Visa Records</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cfc9bc-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Publication.</p></sidenote>The President shall publish the report required under subsection (a) without regard to the requirements of section 222(f) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1202/f">8 U.S.C. 1202(f)</ref>) with respect to confidentiality of records pertaining to the issuance or refusal of visas or permits to enter the United States.</content></subsection>
</section>
<section id="d164143e1539" identifier="/us/pl/116/76/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>SENSE OF CONGRESS ON PEOPLE’S REPUBLIC OF CHINA STATE-CONTROLLED MEDIA.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd6cff0cd-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="yd6cff0ce-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s9/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the United States condemns the deliberate targeting and harassment of democracy activists, diplomatic personnel of the United States and other nations, and their families by media organizations controlled by the Government of the People’s Republic of China, including Wen Wei Po and Ta Kung Po;</content></paragraph>
<paragraph class="fontsize10" id="yd6cff0cf-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s9/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Secretary of State should clearly inform the Government of the People’s Republic of China that the use of media outlets to spread disinformation or to intimidate and threaten its perceived enemies in Hong Kong or in other countries is unacceptable; and</content></paragraph>
<paragraph class="fontsize10" id="yd6cff0d0-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/76/s9/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the Secretary of State should take any activities described in paragraph (1) or (2) into consideration when granting visas for travel and work in the United States to journalists from the People’s Republic of China who are affiliated with any such media organizations.</content></paragraph>

<section id="d164143e1562" identifier="/us/pl/116/76/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><heading>SENSE OF CONGRESS ON COMMERCIAL EXPORTS OF CROWD CONTROL EQUIPMENT TO HONG KONG.</heading><content style="-uslm-lc:I658120">  It is sense of Congress that the Department of Commerce, in conjunction with other relevant Federal departments and agencies, should consider appropriate adjustments to the current United States export controls with respect to Hong Kong to prevent the <page identifier="/us/stat/133/1172">133 STAT. 1172</page>
supply of crowd control and surveillance equipment that could be used inappropriately in Hong Kong.</content></section>
