<section id="d164597e88" identifier="/us/pl/116/72/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfb27af2d-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1">18 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Preventing Animal Cruelty and Torture Act</shortTitle>” or the “<shortTitle role="act">PACT Act</shortTitle>”.</content></section>
<section id="d164597e106" identifier="/us/pl/116/72/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REVISION OF SECTION 48.</heading><subsection class="firstIndent0 fontsize10" id="yfb27fd4e-e81e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/72/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t18/s48">Section 48 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="yfb28998f-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658162"><num class="fontsize12" value="48">“§ 48.</num><heading class="fontsize12"> Animal crushing</heading><subsection class="firstIndent0 fontsize10" id="yfb289990-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Offenses</inline>.—</heading><paragraph class="fontsize10" id="yfb289991-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Crushing</inline>.—</heading><content>It shall be unlawful for any person to purposely engage in animal crushing in or affecting interstate or foreign commerce or within the special maritime and territorial jurisdiction of the United States.</content></paragraph>
<paragraph class="fontsize10" id="yfb289992-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Creation of animal crush videos</inline>.—</heading><chapeau>It shall be unlawful for any person to knowingly create an animal crush video, if—</chapeau><subparagraph class="fontsize10" id="yfb289993-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the person intends or has reason to know that the animal crush video will be distributed in, or using a means or facility of, interstate or foreign commerce; or</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfa4-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the animal crush video is distributed in, or using a means or facility of, interstate or foreign commerce.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfb28bfa5-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Distribution of animal crush videos</inline>.—</heading><content>It shall be unlawful for any person to knowingly sell, market, advertise, exchange, or distribute an animal crush video in, or using a means or facility of, interstate or foreign commerce.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfb28bfa6-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Extraterritorial Application</inline>.—</heading><chapeau>This section applies to the knowing sale, marketing, advertising, exchange, distribution, or creation of an animal crush video outside of the United States, if—</chapeau><paragraph class="fontsize10" id="yfb28bfa7-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the person engaging in such conduct intends or has reason to know that the animal crush video will be transported into the United States or its territories or possessions; or</content></paragraph>
<paragraph class="fontsize10" id="yfb28bfa8-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the animal crush video is transported into the United States or its territories or possessions.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfb28bfa9-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Penalties</inline>.—</heading><content>Whoever violates this section shall be fined under this title, imprisoned for not more than 7 years, or both.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfb28bfaa-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><page identifier="/us/stat/133/1152">133 STAT. 1152</page>
<paragraph class="fontsize10" id="yfb28bfab-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>This section does not apply with regard to any conduct, or a visual depiction of that conduct, that is—</chapeau><subparagraph class="fontsize10" id="yfb28bfac-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a customary and normal veterinary, agricultural husbandry, or other animal management practice;</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfad-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the slaughter of animals for food;</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfae-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>hunting, trapping, fishing, a sporting activity not otherwise prohibited by Federal law, predator control, or pest control;</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfaf-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>medical or scientific research;</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfb0-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>necessary to protect the life or property of a person; or</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfb1-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>performed as part of euthanizing an animal.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfb28bfb2-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Good-faith distribution</inline>.—</heading><chapeau>This section does not apply to the good-faith distribution of an animal crush video to—</chapeau><subparagraph class="fontsize10" id="yfb28bfb3-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a law enforcement agency; or</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfb4-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a third party for the sole purpose of analysis to determine if referral to a law enforcement agency is appropriate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfb28bfb5-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Unintentional conduct</inline>.—</heading><content>This section does not apply to unintentional conduct that injures or kills an animal.</content></paragraph>
<paragraph class="fontsize10" id="yfb28bfb6-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Consistency with rfra</inline>.—</heading><content>This section shall be enforced in a manner that is consistent with section 3 of the Religious Freedom Restoration Act of 1993 (<ref href="/us/usc/t42/s2000bb–1">42 U.S.C. 2000bb–1</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfb28bfb7-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">No Preemption</inline>.—</heading><content>Nothing in this section shall be construed to preempt the law of any State or local subdivision thereof to protect animals.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfb28bfb8-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="yfb28bfb9-e81e-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the term ‘<term>animal crushing</term>’ means actual conduct in which one or more living non-human mammals, birds, reptiles, or amphibians is purposely crushed, burned, drowned, suffocated, impaled, or otherwise subjected to serious bodily injury (as defined in section 1365 and including conduct that, if committed against a person and in the special maritime and territorial jurisdiction of the United States, would violate section 2241 or 2242);</content></paragraph>
<paragraph class="fontsize10" id="yfb28bfba-e81e-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>the term ‘<term>animal crush video</term>’ means any photograph, motion-picture film, video or digital recording, or electronic image that—</chapeau><subparagraph class="fontsize10" id="yfb28bfbb-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>depicts animal crushing; and</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfbc-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is obscene; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfb28bfbd-e81e-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>the term ‘<term>euthanizing an animal</term>’ means the humane destruction of an animal accomplished by a method that—</chapeau><subparagraph class="fontsize10" id="yfb28bfbe-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>produces rapid unconsciousness and subsequent death without evidence of pain or distress; or</content></subparagraph>
<subparagraph class="fontsize10" id="yfb28bfbf-e81e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>uses anesthesia produced by an agent that causes painless loss of consciousness and subsequent death.”</content></subparagraph>

As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
