<section class="indentDown1 firstIndent0 fontsize10" id="y1fa0afe3-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="147">“<inline class="smallCaps">Sec. 147. </inline></num><heading class="fontsize10 smallCaps">Adjustments for Certain Rates of Pay for the Uniformed Services.—</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “Amounts made available in applicable accounts by section 101—</chapeau><paragraph class="fontsize10" id="y1fa0afe4-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>for monthly basic pay for members of the uniformed services under <ref href="/us/usc/t37/s203/a">section 203(a) of title 37, United States Code</ref>, may be apportioned up to the rate for operations necessary to provide monthly pay consistent with section 4 of Executive Order 13866 of March 28, 2019; and</content></paragraph>
<paragraph class="fontsize10" id="y1fa0afe5-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>for monthly cadet or midshipmen pay for cadets or midshipmen under <ref href="/us/usc/t37/s203/c">section 203(c) of title 37, United States Code</ref>, may be apportioned up to the rate for operations necessary to provide monthly pay consistent with section 4 of Executive Order 13866 of March 28, 2019.</content></paragraph>

<section class="indentDown1 firstIndent0 fontsize10" id="y1fa0afe6-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="148">“<inline class="smallCaps">Sec. 148. </inline></num><content> In addition to amounts provided in section 101, amounts are provided for the Payments in Lieu of Taxes program authorized by <ref href="/us/usc/t31/ch69">chapter 69 of title 31, United States Code</ref>, at a rate for operations of $400,000, to be used solely for administrative expenses.</content></section>
<section class="indentDown1 firstIndent0 fontsize10" id="y1fa0afe7-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="149">“<inline class="smallCaps">Sec. 149. </inline></num><content> Notwithstanding<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1fa0afe8-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Maya</p><p class="leftAlign firstIndent0 fontsize8" id="x1fa0afe9-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">M. Rockeymoore.</p></sidenote> any other provision of this Act, there is hereby appropriated for fiscal year 2020 for payment to Maya M. Rockeymoore, widow of Elijah E. Cummings, late a Representative from the State of Maryland, $174,000.</content></section>

<subclause class="fontsize10" id="y1fa480d0-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>further dividing the funds allocated to non-9/11 related victims of state sponsored terrorism on a pro rata basis, based on the amounts outstanding and unpaid on eligible claims, until such amounts have been paid in full or the Fund is closed; and</content></subclause>
<subclause class="fontsize10" id="y1fa480d1-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>further dividing the funds allocated to 9/11 related victims of state sponsored terrorism on a pro rata basis, based on the amounts outstanding and unpaid on eligible claims, until such amounts have been paid in full or the Fund is closed.</content></subclause>
</clause>
<clause class="indentUp0 fontsize10" id="y1fa480d2-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><chapeau>The limitations described in this clause are as follows:</chapeau><subclause class="fontsize10" id="y1fa480d3-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>In the event that a United States person has an eligible claim that exceeds $20,000,000, the Special Master shall treat that claim as if it were for $20,000,000 for purposes of this section.</content></subclause>
<subclause class="fontsize10" id="y1fa480d4-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>In the event that a non-9/11 related victim of state sponsored terrorism and the immediate family members of such person have claims that if aggregated would exceed $35,000,000, the Special Master shall, for purposes of this section, reduce such claims on a pro rata basis such that in the aggregate such claims do not exceed $35,000,000.</content></subclause>
<subclause class="fontsize10" id="y1fa480d5-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>In the event that a 9/11 victim, 9/11 spouse, or 9/11 dependent and the immediate family members of such person (who are also 9/11 victims, 9/11 spouses, or 9/11 dependents) have claims that if aggregated would exceed $35,000,000, the Special Master shall, for purposes of this section, reduce such claims on a pro rata basis such that in the aggregate such claims do not exceed $35,000,000.</content></subclause>
<subclause class="fontsize10" id="y1fa480d6-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>In the event that a 9/11 family member and the family members of such person (who are also 9/11 family members) have claims that if aggregated would exceed $20,000,000, the Special Master shall, for purposes of this section, reduce such claims on a pro rata basis such that in the aggregate such claims do not exceed $20,000,000.”</content></subclause>

<paragraph class="indentDown2 fontsize10" id="y1fa4cf0d-e81f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><heading class="fontsize10 smallCaps">9/11 dependent<inline class="noSmallCaps">.—</inline></heading><chapeau>The term ‘<term>9/11 dependent</term>’ means a United States person who has an eligible claim under subsection (c) who at the time of a 9/11 victim’s death was—</chapeau><subparagraph class="fontsize10" id="y1fa4cf0e-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a dependent, as defined in <ref href="/us/cfr/t28/s104.3">section 104.3 of title 28, Code of Federal Regulations</ref>, or any successor thereto, of the 9/11 victim; or</content></subparagraph>
<subparagraph class="fontsize10" id="y1fa4cf0f-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the child of the 9/11 victim who has not, before the date of enactment of the United States Victims of State Sponsored Terrorism Fund Clarification Act, received payment from the Fund.<page identifier="/us/stat/133/1143">133 STAT. 1143</page></content></subparagraph>

<paragraph class="indentDown2 fontsize10" id="y1fa4cf10-e81f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12) </num><heading class="fontsize10 smallCaps">9/11 family member<inline class="noSmallCaps">.—</inline></heading><content>The term ‘<term>9/11 family member</term>’ means the immediate family member of an individual described in section 405(c) of the Air Transportation Safety and System Stabilization Act (<ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref>) who is not a 9/11 dependent or a 9/11 spouse.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y1fa4cf13-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/69/dB/tVII/s1701/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1fa4cf14-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s20144">34 USC 20144 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>A determination by the Special Master before the date of enactment of the United States Victims of State Sponsored Terrorism Fund Clarification Act that an award or award determination under section 405 of the Air Transportation Safety and Stabilization Act (<ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref>) was controlling for purposes of the Fund (pursuant to subsection (d)(3)(A)(ii)(III) of the Justice for United States Victims of State Sponsored Terrorism Act (<ref href="/us/usc/t34/s20144/d/3/A/ii/III">34 U.S.C. 20144(d)(3)(A)(ii)(III)</ref>), as such section was in effect on the day before the date of enactment of this Act) shall not prejudice a claim of a 9/11 victim, 9/11 spouse, or 9/11 dependent.</content></subsection>
