<section id="d165458e99" identifier="/us/pl/116/65/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Christa McAuliffe Commemorative Coin Act of 2019</shortTitle>”.</content></section>
<section id="d165458e109" identifier="/us/pl/116/65/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x3e17c304-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="y3e17c305-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Christa McAuliffe was a social studies teacher at Concord High School in Concord, New Hampshire.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c306-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>In 1985, Christa McAuliffe was selected to be the first participant in the Teacher in Space program of the National Aeronautics and Space Administration.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c307-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>On January 28, 1986, Christa McAuliffe and 6 other astronauts were tragically killed during the Space Shuttle Challenger disaster.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c308-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>In 1989, For Inspiration and Recognition of Science and Technology (in this Act referred to as “FIRST”) was founded to inspire young people’s interest and participation in science and technology.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c309-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>The mission of FIRST “is to inspire young people to be science and technology leaders, by engaging them in exciting mentor-based programs that build science, engineering, and technology skills, that inspire innovation, and that foster well-rounded life capabilities including self-confidence, communication, and leadership”.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c30a-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>2019 marks the 30th anniversary of the founding of FIRST.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c30b-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>Each year, more than 1,000,000 children from the United States and more than 86 countries participate in a FIRST program.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c30c-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>Studies have shown that alumni of FIRST programs are more likely to become scientists and engineers and to volunteer in their communities.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c30d-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>FIRST is dedicated to carrying on the mission of Christa McAuliffe of inspiring students and creating a new generation of dreamers and in­no­va­tors.</content></paragraph>
<paragraph class="fontsize10" id="y3e17c30e-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s2/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>2016 marked the 30th anniversary of the Space Shuttle Challenger tragedy.<page identifier="/us/stat/133/1125">133 STAT. 1125</page></content></paragraph>
</section>
<section id="d165458e170" identifier="/us/pl/116/65/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>COIN SPECIFICATIONS.</heading><subsection class="firstIndent0 fontsize10" id="y3e17ea1f-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Denominations</inline>.—</heading><chapeau>In commemoration of Christa McAuliffe, the Secretary of the Treasury (hereafter referred to in this Act as the “Secretary”) shall mint and issue not more than 350,000 $1 coins, each of which shall—</chapeau><paragraph class="fontsize10" id="y3e17ea20-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>weigh 26.73 grams;</content></paragraph>
<paragraph class="fontsize10" id="y3e17ea21-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>have a diameter of 1.500 inches; and</content></paragraph>
<paragraph class="fontsize10" id="y3e17ea22-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>contain at least 90 percent silver.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3e17ea23-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Legal Tender</inline>.—</heading><content>The coins minted under this Act shall be legal tender, as provided in <ref href="/us/usc/t31/s5103">section 5103 of title 31, United States Code</ref>.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3e17ea24-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Numismatic Items</inline>.—</heading><content>For purposes of sections 5134 and 5136 of <ref href="/us/usc/t31">title 31, United States Code</ref>, all coins minted under this Act shall be considered to be numismatic items.</content></subsection>

<section id="d165458e226" identifier="/us/pl/116/65/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DESIGN OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="y3e183845-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Design Requirements</inline>.—</heading><paragraph class="fontsize10" id="y3e183846-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The design of the coins minted under this Act shall bear—</chapeau><subparagraph class="fontsize10" id="y3e183847-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an image of and the name of Christa McAuliffe on the obverse side; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3e185f58-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a design on the reverse side that depicts the legacy of Christa McAuliffe as a teacher.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y3e185f59-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Designation and inscriptions</inline>.—</heading><chapeau>On each coin minted under this Act, there shall be—</chapeau><subparagraph class="fontsize10" id="y3e185f5a-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a designation of the value of the coin;</content></subparagraph>
<subparagraph class="fontsize10" id="y3e185f5b-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an inscription of the year “2021”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3e185f5c-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>inscriptions of the words “Liberty”, “In God We Trust”, “United States of America”, and “E Pluribus Unum”.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3e185f5d-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Selection</inline>.—</heading><chapeau>The design for the coins minted under this Act shall be—</chapeau><paragraph class="fontsize10" id="y3e185f5e-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3e185f5f-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>selected by the Secretary, after consultation with the family of Christa McAuliffe, FIRST, and the Commission of Fine Arts; and</content></paragraph>
<paragraph class="fontsize10" id="y3e185f60-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3e185f61-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Review.</p></sidenote><content>reviewed by the Citizens Coinage Advisory Committee</content></paragraph>
</subsection>
</section>
<section id="d165458e307" identifier="/us/pl/116/65/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>ISSUANCE OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="y3e185f62-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Quality of Coins</inline>.—</heading><content>Coins minted under this Act shall be issued in uncirculated and proof qualities.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3e185f63-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Mint Facility</inline>.—</heading><content>Only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3e185f64-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Period for Issuance</inline>.—</heading><content>The Secretary may issue coins under this Act only during the period beginning on January 1, 2021, and ending on December 31, 2021.</content></subsection>

<section id="d165458e339" identifier="/us/pl/116/65/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>SALE OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="y3e18d395-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sale Price</inline>.—</heading><chapeau>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</chapeau><paragraph class="fontsize10" id="y3e18d396-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the face value of the coins;</content></paragraph>
<paragraph class="fontsize10" id="y3e18d397-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the surcharge provided under section 7(a) with respect to the coins; and</content></paragraph>
<paragraph class="fontsize10" id="y3e18d398-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>the cost of designing and issuing the coins, including—</chapeau><subparagraph class="fontsize10" id="y3e18d399-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>labor;</content></subparagraph>
<subparagraph class="fontsize10" id="y3e18d39a-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>materials;</content></subparagraph>
<subparagraph class="fontsize10" id="y3e18d39b-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>dies;</content></subparagraph>
<subparagraph class="fontsize10" id="y3e18d39c-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>use of machinery;<page identifier="/us/stat/133/1126">133 STAT. 1126</page></content></subparagraph>
<subparagraph class="fontsize10" id="y3e18d39d-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>overhead expenses;</content></subparagraph>
<subparagraph class="fontsize10" id="y3e18d39e-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/3/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>marketing; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3e18d39f-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/a/3/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>shipping.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3e18d3a0-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Bulk Sales</inline>.—</heading><content>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3e18d3a1-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Prepaid Orders</inline>.—</heading><paragraph class="fontsize10" id="y3e18d3a2-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of the coins.</content></paragraph>
<paragraph class="fontsize10" id="y3e18d3a3-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s6/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Discount</inline>.—</heading><content>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</content></paragraph>

<section id="d165458e442" identifier="/us/pl/116/65/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>SURCHARGES.</heading><subsection class="firstIndent0 fontsize10" id="y3e18fab4-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>All sales of coins issued under this Act shall include a surcharge of $10 per coin.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3e18fab5-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Distribution</inline>.—</heading><content>Subject to <ref href="/us/usc/t31/s5134/f">section 5134(f) of title 31, United States Code</ref>, and section 8(2), all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the FIRST robotics program for the purpose of engaging and inspiring young people, through mentor-based programs, to become leaders in the fields of science, technology, engineering, and mathematics.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3e18fab6-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Audits</inline>.—</heading><content>The FIRST robotics program shall be subject to the audit requirements of <ref href="/us/usc/t31/s5134/f/2">section 5134(f)(2) of title 31, United States Code</ref>, with respect to the amounts received under subsection (b).</content></subsection>

<section id="d165458e482" identifier="/us/pl/116/65/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>FINANCIAL ASSURANCES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x3e1921c7-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The Secretary shall take such actions as may be necessary to ensure that—</chapeau><paragraph class="fontsize10" id="y3e1921c8-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s8/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>minting and issuing coins under this Act result in no net cost to the Federal Government; and</content></paragraph>
<paragraph class="fontsize10" id="y3e1921c9-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/65/s8/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>no funds, including applicable surcharges, are disbursed to any recipient designated in section 7(b) until the total cost of designing and issuing all of the coins authorized by this Act, including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping, is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of <ref href="/us/usc/t31">title 31, United States Code</ref>.</content></paragraph>
