<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula>
<section id="d92923e85" identifier="/us/pl/116/63/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>TRANSFER AUTHORITY.</heading><subsection class="firstIndent0 fontsize10" id="y5942b7b5-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds that—</chapeau><paragraph class="fontsize10" id="y5942b7b6-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>lead is a toxic chemical that—</chapeau><subparagraph class="fontsize10" id="y5942b7b7-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is particularly harmful to young children; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5942b7b8-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>can cause reduced intelligence quotients, attention disorders, and other serious health problems;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5942b7b9-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>excessive and harmful levels of lead have been found in water systems across all 50 States and those water systems serve drinking water to millions of people in the United States;</content></paragraph>
<paragraph class="fontsize10" id="y5942b7ba-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>hundreds of the water systems described in paragraph (2) are water systems that provide drinking water to schools or day care centers;</content></paragraph>
<paragraph class="fontsize10" id="y5942b7bb-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>not all States have sufficient funds in the drinking water revolving fund of that State to address the threat to public health from heightened exposure to lead in drinking water; and</content></paragraph>
<paragraph class="fontsize10" id="y5942b7bc-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>some States have available funds in the clean water revolving fund of that State that could be used to provide additional resources to help address lead in drinking water.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5942b7bd-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y5942b7be-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/b/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Clean water revolving fund</inline>.—</heading><content>The term “<term>clean water revolving fund</term>” means a State water pollution control revolving fund established under title VI of the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1381/etseq">33 U.S.C. 1381 et seq.</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y5942b7bf-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/b/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Drinking water revolving fund</inline>.—</heading><content>The term “<term>drinking water revolving fund</term>” means a State drinking water treatment revolving loan fund established under section 1452 of the Safe Drinking Water Act (<ref href="/us/usc/t42/s300j–12">42 U.S.C. 300j–12</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5942b7c0-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/63/s1/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Authority</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5942b7c1-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x5942b7c2-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x5942b7c3-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>In addition to the transfer authority in section 302(a) of the Safe Drinking Water Act Amendments of 1996 (<ref href="/us/usc/t42/s300j–12">42 U.S.C. 300j–12 note</ref>; <ref href="/us/pl/104/182">Public Law 104–182</ref>), and notwithstanding section 1452(d) of the Safe Drinking Water Act (<ref href="/us/usc/t42/s300j–12/d">42 U.S.C. 300j–12(d)</ref>), during the 1-year period beginning on the date of enactment of this Act, if a State, in consultation with the Administrator of the Environmental Protection Agency, determines that available funds in the clean water revolving fund of the State are necessary to address a threat to public health as a result of heightened exposure to lead in drinking water, the State may transfer an <page identifier="/us/stat/133/1121">133 STAT. 1121</page>
amount equal to not more than 5 percent of the cumulative clean water revolving fund Federal grant dollars to the State to the drinking water revolving fund of the State. Funds transferred pursuant to this subsection shall be used by the State to provide additional subsidy to eligible recipients in the form of forgiveness of principal, negative interest loans, or grants (or any combination of these).</content></subsection>
