<section id="d94580e92" identifier="/us/pl/116/52/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Honoring American Veterans in Extreme Need Act of 2019</shortTitle>” or the “<shortTitle role="act">HAVEN Act</shortTitle>”.</content></section>
<section id="d94580e105" identifier="/us/pl/116/52/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITION OF CURRENT MONTHLY INCOME.</heading><content class="firstIndent0 fontsize10" id="xd0a96d22-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t11/s101/10A">Section 101(10A) of title 11, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> subparagraph (B) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="indentUp2 fontsize10" id="yd0a9bb43-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline" id="yd0a9e254-e81f-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><content>includes any amount paid by any entity other than the debtor (or in a joint case the debtor and the debtor’s spouse), on a regular basis for the household expenses of the debtor or the debtor’s dependents (and in a joint case the debtor’s spouse if not otherwise a dependent); and</content></clause>
<clause class="indentUp0 fontsize10" id="yd0a9e255-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>excludes—</chapeau><subclause class="fontsize10" id="yd0a9e256-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>benefits received under the Social Security Act (<ref href="/us/usc/t42/s301/etseq">42 U.S.C. 301 et seq.</ref>);</content></subclause>
<subclause class="fontsize10" id="yd0a9e257-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>payments to victims of war crimes or crimes against humanity on account of their status as victims of such crimes;</content></subclause>
<subclause class="fontsize10" id="yd0a9e258-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>payments to victims of international terrorism or domestic terrorism, as those terms are defined in section 2331 of title 18, on account of their status as victims of such terrorism; and</content></subclause>
<subclause class="fontsize10" id="yd0a9e259-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>any monthly compensation, pension, pay, annuity, or allowance paid under title 10, 37, or 38 in connection with a disability, combat-related injury or disability, or death of a member of the uniformed services, except that any retired pay excluded under this subclause shall include retired pay paid under chapter 61 of title 10 only to the extent that such retired pay exceeds the amount of retired pay to which the debtor would otherwise be entitled if retired under any provision of title 10 other than chapter 61 of that title.”</content></subclause>

<section id="d94580e165" identifier="/us/pl/116/52/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of <page identifier="/us/stat/133/1077">133 STAT. 1077</page>
PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
