<section id="d94704e94" identifier="/us/pl/116/50/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Creating Advanced Streamlined Electronic Services for Constituents Act of 2019</shortTitle>” or the “<shortTitle role="act">CASES Act</shortTitle>”.</content></section>
<section id="d94704e107" identifier="/us/pl/116/50/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SENSE OF CONGRESS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xf1f7e2a1-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="yf1f7e2a2-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>congressional offices provide crucial services to constituents by acting as a liaison between the constituents and the respective agencies;</content></paragraph>
<paragraph class="fontsize10" id="yf1f7e2a3-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>this includes assisting constituents by making inquiries and working toward resolutions on behalf of the constituent with the respective agencies; and</content></paragraph>
<paragraph class="fontsize10" id="yf1f7e2a4-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>this process should be simplified through the creation of electronic forms that may be submitted under <ref href="/us/usc/t5/s552a">section 552a of title 5, United States Code</ref> (commonly referred to as the Privacy Act), thus modernizing the process for constituents and improving access and efficiency of Government services and agencies in order to expedite the resolution of the problem for which constituents sought help.</content></paragraph>

<section id="d94704e133" identifier="/us/pl/116/50/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf1f7e2a5-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s552a">5 USC 552a note</ref>.</p></sidenote><heading>OMB GUIDANCE ON ELECTRONIC CONSENT AND ACCESS FORMS.</heading><subsection class="firstIndent0 fontsize10" id="yf1f857d6-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf1f857d7-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Guidance</inline>.—</heading><chapeau>Not later than 1 year after the date of the enactment of this Act, the Director shall issue guidance that does the following:</chapeau><paragraph class="fontsize10" id="yf1f857d8-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Requires each agency to accept electronic identity proofing and authentication processes for the purposes of allowing an individual to provide prior written consent for the disclosure of the individual’s records under <ref href="/us/usc/t5/s552a/b">section 552a(b) of title 5, United States Code</ref>, or for individual access to records under section 552a(d) of such title.</content></paragraph>
<paragraph class="fontsize10" id="yf1f857d9-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf1f857da-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><content>Creates a template for electronic consent and access forms and requires each agency to post the template on the agency website and to accept the forms from any individual properly identity proofed and authenticated in accordance with paragraph (1) for the purpose of authorizing disclosure of the individual’s records under section 552a(b) of title 5, United <page identifier="/us/stat/133/1074">133 STAT. 1074</page>
States Code, or for individual access to records under section 552a(d) of such title.</content></paragraph>
<paragraph class="fontsize10" id="yf1f857db-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Requires each agency to accept the electronic consent and access forms described in paragraph (2) from any individual properly identity proofed and authenticated in accordance with paragraph (1) for the purpose of authorizing disclosure of the individual’s records to another entity, including a congressional office, in accordance with <ref href="/us/usc/t5/s552a/b">section 552a(b) of title 5, United States Code</ref>, or for individual access to records under section 552a(d).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yf1f857dc-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf1f857dd-e81f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Agency Compliance</inline>.—</heading><content>Each agency shall comply with the guidance issued pursuant to subsection (a) not later than 1 year after the date on which such guidance is issued.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf1f857de-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yf1f857df-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency; individual; record</inline>.—</heading><content>The terms “agency”, “individual”, and “record” have the meanings given those terms in <ref href="/us/usc/t5/s552a/a">section 552a(a) of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="yf1f857e0-e81f-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/50/s3/c/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term “<term>Director</term>” means the Director of the Office of Management and Budget.</content></paragraph>

<section id="d94704e229" identifier="/us/pl/116/50/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>NO ADDITIONAL FUNDS AUTHORIZED.</heading><content style="-uslm-lc:I658120">  No additional funds are authorized to carry out the requirements of this Act. Such requirements shall be carried out using amounts otherwise authorized.</content></section>
<section id="d94704e236" identifier="/us/pl/116/50/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
