<section id="d172223e98" identifier="/us/pl/116/5/s1" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="1"><inline class="smallCaps">Section 1. </inline></num><heading class="smallCaps">short title. </heading><content class="inline">This joint resolution may be cited as the “<shortTitle role="jointResolution">Further Additional Continuing Appropriations Act, 2019</shortTitle>”.</content></section>
<section id="d172223e111" identifier="/us/pl/116/5/s101" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="101"><inline class="smallCaps">Sec. 101. </inline> </num><chapeau class="inline" id="xf3a7679f-e81f-11f0-bc57-ad3ac4b1618c">The Continuing Appropriations Act, 2019 (<ref href="/us/pl/115/245/dC">division C of Public Law 115–245</ref>) is further amended—</chapeau><paragraph class="fontsize10" id="yf3a767a0-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/5/s101/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> the date specified in section 105(3)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a78eb1-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/stat/132/3124">132 Stat. 3124</ref>.</p></sidenote> and <amendingAction type="insert">inserting</amendingAction> “<quotedText>February 15, 2019</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yf3a78eb2-e81f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/5/s101/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> after section 136 the following:<quotedContent><section class="indentDown1 firstIndent0 fontsize10" id="yf3a7b5c3-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="137">“<inline class="smallCaps">Sec. 137. </inline></num><content> Amounts made available in this Act for personnel pay, allowances, and benefits in each department and agency shall be available for obligations incurred pursuant to subsection (c) of <ref href="/us/usc/t31/s1341">section 1341 of title 31, United States Code</ref>.</content></section>
<section class="indentDown1 firstIndent0 fontsize10" id="yf3a7b5c4-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="138">“<inline class="smallCaps">Sec. 138. </inline></num><content> All obligations incurred and in anticipation of the appropriations made and authority granted by this Act for the purposes of maintaining the essential level of activity to protect life and property and bringing about orderly termination of Government function, and for purposes as otherwise authorized by law, are hereby ratified and approved if otherwise in accord with the provisions of this Act.</content></section>
<section class="indentDown1 firstIndent0 fontsize10" id="yf3a7b5c5-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="139">“<inline class="smallCaps">Sec. 139.</inline></num><subsection class="inline" id="yf3a7b5c6-e81f-11f0-bc57-ad3ac4b1618c"><num value="a"> (a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a7b5c7-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">State and local governments.</p><p class="leftAlign firstIndent0 fontsize8" id="xf3a7b5c8-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Furlough.</p><p class="leftAlign firstIndent0 fontsize8" id="xf3a7b5c9-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reimbursements.</p></sidenote><chapeau>If a State (or another Federal grantee) used State funds (or the grantee’s non-Federal funds) to continue carrying out a Federal program or furloughed State employees (or the grantee’s employees) whose compensation is advanced or reimbursed in whole or in part by the Federal Government—</chapeau><paragraph class="fontsize10" id="yf3a7b5ca-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>such furloughed employees shall be compensated at their standard rate of compensation for such period;</content></paragraph>
<paragraph class="fontsize10" id="yf3a7b5cb-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the State (or such other grantee) shall be reimbursed for expenses that would have been paid by the Federal Government during such period had appropriations been available, including the cost of compensating such furloughed employees, together with interest thereon calculated under <ref href="/us/usc/t31/s6503/d">section 6503(d) of title 31, United States Code</ref>; and</content></paragraph>
<paragraph class="fontsize10" id="yf3a7b5cc-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the State (or such other grantee) may use funds available to the State (or the grantee) under such Federal program to reimburse such State (or the grantee), together with interest thereon calculated under <ref href="/us/usc/t31/s6503/d">section 6503(d) of title 31, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yf3a7b5cd-e81f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a7b5ce-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definitions.</p></sidenote><content>For purposes of this section, the term ‘<term>State</term>’ and the term ‘<term>grantee</term>’ shall have the meaning as such term is defined under the applicable Federal program under subsection (a). In addition, ‘to continue carrying out a Federal program’ means the <page identifier="/us/stat/133/11">133 STAT. 11</page>
continued performance by a State or other Federal grantee, during the period of a lapse in appropriations, of a Federal program that the State or such other grantee had been carrying out prior to the period of the lapse in appropriations.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf3a7b5cf-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a7dce0-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>The authority under this section applies with respect to any period in fiscal year 2019 (not limited to periods beginning or ending after the date of the enactment of this Act) during which there occurs a lapse in appropriations with respect to any department or agency of the Federal Government which, but for such lapse in appropriations, would have paid, or made reimbursement relating to, any of the expenses referred to in this section with respect to the program involved. Payments and reimbursements under this authority shall be made only to the extent and in amounts provided in advance in appropriations Acts.</content></subsection>
</section>
<section class="indentDown1 firstIndent0 fontsize10" id="yf3a7dce1-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="140">“<inline class="smallCaps">Sec. 140.</inline></num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a7dce2-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote></heading><content> Notwithstanding section 251(a)(1) of the Balanced Budget and Emergency Deficit Control Act of 1985 and the timetable in section 254(a) of such Act, the final sequestration report for fiscal year 2019 pursuant to section 254(f)(1) of such Act and any order for fiscal year 2019 pursuant to section 254(f)(5) of such Act shall be issued, for the Congressional Budget Office, 10 days after the date specified in section 105(3), and for the Office of Management and Budget, 15 days after the date specified in section 105(3).</content></section>
<section class="indentDown1 firstIndent0 fontsize10" id="yf3a7dce3-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="141">“<inline class="smallCaps">Sec. 141.</inline></num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a7dce4-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Extension date.</p></sidenote></heading><content> Section 319L(e)(1)(A) of the Public Health Service Act (<ref href="/us/usc/t42/s247d–7e/e/1/A">42 U.S.C. 247d–7e(e)(1)(A)</ref>) shall continue in effect through the date specified in section 105(3) of this Act.</content></section>
<section class="indentDown1 firstIndent0 fontsize10" id="yf3a7dce5-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="142">“<inline class="smallCaps">Sec. 142.</inline></num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a7dce6-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Extension date.</p></sidenote></heading><content> Section 405(a) of the Pandemic and All Hazards Preparedness Act (<ref href="/us/usc/t42/s247d–6a">42 U.S.C. 247d–6a note</ref>) shall continue in effect through the date specified in section 105(3) of this Act.”</content></section>

</section>
<section id="d172223e272" identifier="/us/pl/116/5/s102" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="102"><inline class="smallCaps">Sec. 102.</inline>  </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a7dce7-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content class="inline">For the purposes of <ref href="/us/pl/115/245/dC">division C of Public Law 115–245</ref>, the time covered by such division shall be considered to include the period which began on or about December 22, 2018, during which there occurred a lapse in appropriations.</content></section>
<section id="d172223e288" identifier="/us/pl/116/5/s103" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="103"><inline class="smallCaps">Sec. 103. </inline> </num><content class="inline">Subsection (c)(2) of <ref href="/us/usc/t31/s1341">section 1341 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, and subject to the enactment of appropriations Acts ending the lapse</quotedText>” before the period.</content></section>
<section id="d172223e306" identifier="/us/pl/116/5/s104" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="104"><inline class="smallCaps">Sec. 104.</inline>  </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3a7dce8-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xf3a7dce9-e81f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><content class="inline">For the purposes of the annual report issued pursuant to section 5 of the Statutory Pay-As-You-Go Act of 2010 (<ref href="/us/usc/t2/s934">2 U.S.C. 934</ref>) after adjournment of the second session of the 115th Congress, and for determining whether a sequestration order is necessary under such section, the debit for the budget year on the 5-year <page identifier="/us/stat/133/12">133 STAT. 12</page>
scorecard, if any, and the 10-year scorecard, if any, shall be deducted from such scorecard in 2019 and added to such scorecard in 2020.</content></section>
