<section id="d95396e88" identifier="/us/pl/116/39/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x723f16cb-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1305">42 USC 1305 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Sustaining Excellence in Medicaid Act of 2019</shortTitle>”.</content></section>
<section id="d95396e103" identifier="/us/pl/116/39/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>EXTENSION OF THE COMMUNITY MENTAL HEALTH SERVICES DEMONSTRATION PROGRAM.</heading><content style="-uslm-lc:I658120">  Section 223(d)(3) of the Protecting Access to Medicare Act of 2014 (<ref href="/us/usc/t42/s1396a">42 U.S.C. 1396a note</ref>), as amended by <ref href="/us/pl/116/29">Public Law 116–29</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>July 14, 2019</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>September 13, 2019</quotedText>”.</content></section>
<section id="d95396e125" identifier="/us/pl/116/39/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>EXTENSION OF PROTECTION FOR MEDICAID RECIPIENTS OF HOME AND COMMUNITY-BASED SERVICES AGAINST SPOUSAL IMPOVERISHMENT.</heading><subsection class="firstIndent0 fontsize10" id="y723f8bfc-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/39/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/pl/111/148/s2404">Section 2404 of Public Law 111–148</ref> (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>September 30, 2019</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>December 31, 2019</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y723f8bfd-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/39/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x723f8bfe-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1396a">42 USC 1396a note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><chapeau>Nothing in <ref href="/us/pl/111/148/s2404">section 2404 of Public Law 111–148</ref> (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5 note</ref>) or section 1902(a)(17) or 1924 of the Social Security Act (<ref href="/us/usc/t42/s1396a/a/17">42 U.S.C. 1396a(a)(17)</ref>, 1396r–5) shall be construed as prohibiting a State from applying an income or resource disregard under a methodology authorized under section 1902(r)(2) of such Act (<ref href="/us/usc/t42/s1396a/r/2">42 U.S.C. 1396a(r)(2)</ref>)—</chapeau><paragraph class="fontsize10" id="y723f8bff-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/39/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to the income or resources of an individual described in section 1902(a)(10)(A)(ii)(VI) of such Act (<ref href="/us/usc/t42/s1396a/a/10/A/ii/VI">42 U.S.C. 1396a(a)(10)(A)(ii)(VI)</ref>) (including a disregard of the income or resources of such individual’s spouse); or</content></paragraph>
<paragraph class="fontsize10" id="y723f8c00-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/39/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>on the basis of an individual’s need for home and community-based services authorized under subsection (c), (d), (i), or (k) of section 1915 of such Act (<ref href="/us/usc/t42/s1396n">42 U.S.C. 1396n</ref>) or under section 1115 of such Act (<ref href="/us/usc/t42/s1315">42 U.S.C. 1315</ref>).</content></paragraph>

<section id="d95396e203" identifier="/us/pl/116/39/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>EXTENSION OF MONEY FOLLOWS THE PERSON REBALANCING DEMONSTRATION.</heading><content style="-uslm-lc:I658120">  Section 6071(h)(1)(F) of the Deficit Reduction Act of 2005 (<ref href="/us/usc/t42/s1396a">42 U.S.C. 1396a note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>$132,000,000</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>$254,500,000</quotedText>”.<page identifier="/us/stat/133/1062">133 STAT. 1062</page></content></section>
<section id="d95396e224" identifier="/us/pl/116/39/s5" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>EXTENSION FOR FAMILY-TO-FAMILY HEALTH INFORMATION CENTERS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x723fb311-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 501(c) of the Social Security Act (<ref href="/us/usc/t42/s701/c">42 U.S.C. 701(c)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y723fb312-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/39/s5/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1)(A)(vii), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and 2019</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>through 2024</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y723fb313-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/39/s5/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (3)(C), by <amendingAction type="delete">striking</amendingAction> “<quotedText>fiscal years 2018 and 2019</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>fiscal year 2018 and each fiscal year thereafter</quotedText>”.</content></paragraph>

<section id="d95396e261" identifier="/us/pl/116/39/s6" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>REDUCED WHOLESALE ACQUISITION COST (WAC)-BASED PAYMENTS FOR NEW DRUGS AND BIOLOGICALS.</heading><content class="firstIndent0 fontsize10" id="x723fda24-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 1847A(c)(4) of the Social Security Act (<ref href="/us/usc/t42/s1395w–3a/c/4">42 U.S.C. 1395w–3a(c)(4)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>payable under this section for the drug or biological based on—</quotedText>” and all that follows through the period at the end and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“payable under this section—<subparagraph class="indentUp2 fontsize10" id="y72402845-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>in the case of a drug or biological furnished prior to January 1, 2019, based on—</chapeau><clause class="fontsize10" id="y72402846-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the wholesale acquisition cost; or</content></clause>
<clause class="fontsize10" id="y72402847-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the methodologies in effect under this part on November 1, 2003, to determine payment amounts for drugs or biologicals; and</content></clause>
</subparagraph>
<subparagraph class="indentUp2 fontsize10" id="y72402848-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>in the case of a drug or biological furnished on or after January 1, 2019—</chapeau><clause class="fontsize10" id="y72402849-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>at an amount not to exceed 103 percent of the wholesale acquisition cost; or</content></clause>
<clause class="fontsize10" id="y7240284a-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>based on the methodologies in effect under this part on November 1, 2003, to determine payment amounts for drugs or biologicals.”</content></clause>
