<section id="d173124e104" identifier="/us/pl/116/340/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Direct Enhancement of Snapper Conservation and the Economy through Novel Devices Act of 2020</shortTitle>” or the “<shortTitle role="act">DESCEND Act of 2020</shortTitle>”.</content></section>
<section id="d173124e117" identifier="/us/pl/116/340/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SENSE OF CONGRESS.</heading><content style="-uslm-lc:I658120">  It is the sense of Congress that commercial and recreational fishermen (which, for the purpose of this Act shall include charter fishing) for Gulf reef fish are expected to use a venting tool or a descending device required for possession under section 3 when releasing fish that are exhibiting signs of barotrauma. The Secretary of Commerce (referred to in this Act as the “Secretary”), in coordination with the Gulf of Mexico Fishery Management Council, should develop and disseminate to fishermen education and outreach materials related to proper use of venting tools and descending devices, and strongly encourage their use by commercial and recreational fishermen when releasing fish that are exhibiting signs of barotrauma.</content></section>
<section id="d173124e124" identifier="/us/pl/116/340/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REQUIRED POSSESSION OF DESCENDING DEVICES.</heading><subsection class="firstIndent0 fontsize10" id="yd5781765-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Required Gear in the Gulf Reef Fish Fishery</inline>.—</heading><content>Title III of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1851/etseq">16 U.S.C. 1851 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="yd5783e76-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="321">“SEC. 321. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd5786587-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1870">16 USC 1870</ref>.</p></sidenote><heading class="fontsize12">REQUIRED POSSESSION OF DESCENDING DEVICES.</heading><subsection class="firstIndent0 fontsize10" id="yd5786588-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Require Gear in the Gulf Reef Fish Fishery</inline>.—</heading><content>It shall be unlawful for a person on board a commercial or recreational vessel to fish for Gulf reef fish in the Gulf of Mexico Exclusive Economic Zone without possessing on board the vessel a venting tool or a descending device that is rigged and ready for use while fishing is occurring.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd5786589-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Savings Clause</inline>.—</heading><content>No provision of this section shall be interpreted to affect any program or activity carried out by the Gulf Coast Ecosystem Restoration Council established by the Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies of the Gulf Coast States Act of 2012 (<ref href="/us/usc/t33/s1321">33 U.S.C. 1321 note</ref>), or any project contained in an approved Restoration Plan developed by any Natural Resources Damage Assessment <page identifier="/us/stat/134/5129">134 STAT. 5129</page>

<subsection class="firstIndent0 fontsize10" id="yd578658a-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yd578658b-e820-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Descending device</inline>.—</heading><chapeau>The term ‘<term>descending device</term>’ means an instrument that—</chapeau><subparagraph class="fontsize10" id="yd578658c-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>will release fish at a depth sufficient for the fish to be able to recover from the effects of barotrauma;</content></subparagraph>
<subparagraph class="fontsize10" id="yd578658d-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is a weighted hook, lip clamp, or box that will hold the fish while it is lowered to depth, or another device determined to be appropriate by the Secretary; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd578658e-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>is capable of—</chapeau><clause class="fontsize10" id="yd578658f-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>releasing the fish automatically;</content></clause>
<clause class="fontsize10" id="yd5786590-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>releasing the fish by actions of the operator of the device; or</content></clause>
<clause class="fontsize10" id="yd5786591-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>allowing the fish to escape on its own.</content></clause>

</paragraph>
<paragraph class="fontsize10" id="yd5786592-e820-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Venting tool</inline>.—</heading><content>The term ‘<term>venting tool</term>’ has the meaning given to it by the Gulf of Mexico Fishery Management Council.</content></paragraph>
<paragraph class="fontsize10" id="yd5786593-e820-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Gulf reef fish</inline>.—</heading><content>The term ‘<term>Gulf reef fish</term>’ means any fish chosen by the Gulf of Mexico Fishery Management Council that is in the reef Fishery Management Plan for the purposes of this Act.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yd5786594-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s3/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Civil Penalties</inline>.—</heading><content>Section 308(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1858/a">16 U.S.C. 1858(a)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or section 321</quotedText>” after “<quotedText>section 307</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd5786595-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd5786596-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1858">16 USC 1858 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by this Act shall take effect 1 year after the date of the enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd5786597-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s3/d" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>Title III of the table of contents of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1851/etseq">16 U.S.C. 1851 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> the item relating to section 305 and all that follows through the end of the items relating to such title and <amendingAction type="insert">inserting</amendingAction> the following:<?GPOvSpace 04?>

and produce a report on discard mortality in the Gulf of Mexico reef fish fisheries.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd578dad4-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p><p class="leftAlign firstIndent0 fontsize8" id="xd578dad5-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xd578dad6-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote> The study shall include—</chapeau><paragraph class="fontsize10" id="yd578dad7-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>assessment of gaps and biases in reporting of discards and associated discard mortality;</content></paragraph>
<paragraph class="fontsize10" id="yd578dad8-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>assessment of uncertainty and likely impacts of such uncertainty in discard mortality;</content></paragraph>
<paragraph class="fontsize10" id="yd578dad9-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>assessment of the effectiveness and usage rates of barotrauma-reducing devices;</content></paragraph>
<paragraph class="fontsize10" id="yd578dada-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>recommendations for future research priorities; and</content></paragraph>
<paragraph class="fontsize10" id="yd578dadb-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>recommendations for standardized reporting and quantification of discards in the same metric as landings for fisheries under the Gulf of Mexico Reef Fish Fishery Management Plan.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yd578dadc-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd578dadd-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Deadlines</inline>.—</heading><content>Not later than 2 years after the date of the enactment of this Act, the National Academy of Sciences shall complete the study required under subsection (a) and transmit the final report to the Secretary. Not later than 3 months after receiving the study and report in accordance with this subsection, the Secretary shall submit the study and report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd578dade-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd578dadf-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Plan</inline>.—</heading><chapeau>Not later than 1 year after the Secretary receives the study and report required under subsection (a), Secretary and the Gulf of Mexico Fishery Management Council shall develop—</chapeau><paragraph class="fontsize10" id="yd578dae0-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>guidance for minimum standards for quantifying and reporting discards and associated mortality in the Gulf of Mexico Reef Fish Fishery Management Plan; and</content></paragraph>
<paragraph class="fontsize10" id="yd578dae1-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd578dae2-e820-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>a plan to assess and monitor the effectiveness and usage of barotrauma-reducing devices and the impact on discard mortality rates in Gulf of Mexico reef fish fisheries.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yd578dae3-e820-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/340/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Follow-Up Report</inline>.—</heading><content>Not later than 3 years after developing minimum standards and developing the assessment and monitoring plan under subsection (c), the Secretary shall provide a detailed report on implementation to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives.</content></subsection>

<section id="d173124e570" identifier="/us/pl/116/340/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the <page identifier="/us/stat/134/5131">134 STAT. 5131</page>
Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
