<section id="d96380e108" identifier="/us/pl/116/34/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act</shortTitle>”.</content></section>
<section id="d96380e118" identifier="/us/pl/116/34/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SEPTEMBER 11TH VICTIM COMPENSATION FUND OF 2001.</heading><subsection class="firstIndent0 fontsize10" id="yd74c3b0f-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Authorization and Funding</inline>.—</heading><chapeau>Section 410 of the Air Transportation Safety and System Stabilization Act (<ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd74c3b10-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (c), by <amendingAction type="delete">striking</amendingAction> “<quotedText>$4,600,000,000</quotedText>” and all that follows through “<quotedText>expended</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>such sums as may be necessary for fiscal year 2019 and each fiscal year thereafter through fiscal year 2092, to remain available until expended</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yd74c3b11-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (e), by <amendingAction type="delete">striking</amendingAction> “<quotedText>Upon completion of all payments under this title</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>On October 1, 2092, or at such time thereafter as all funds are expended</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd74c3b12-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd74c3b13-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s40101">49 USC 40101 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Extension of Limitation on Claim Filing</inline>.—</heading><content>Section 405(a)(3)(B) of the Air Transportation Safety and System Stabilization Act (<ref href="/us/usc/t40/s401010">40 U.S.C. 401010 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>the date that is 5 years after the date of enactment of the James Zadroga 9/11 Victim Compensation Fund Reauthorization Act</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>October 1, 2090</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd74c3b14-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Compensation Reduced by Special Master Due to Lack of Funding</inline>.—</heading><content>Section 406(d)(2) of the Air Transportation Safety and System Stabilization Act (<ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentUp2 fontsize10" id="yd74c8935-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Compensation reduced by special master due to insufficient funding</inline>.—</heading><clause class="fontsize10" id="yd74c8936-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd74c8937-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="xd74c8938-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In any claim in Group B as described in section 405(a)(3)(C)(iii) in which, prior to the enactment of the Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act, the Special Master had advised the claimant that the amount of compensation has been reduced on the basis of insufficient funding, the Special Master shall, in the first fiscal year beginning after sufficient funding becomes available under such <page identifier="/us/stat/133/1041">133 STAT. 1041</page>
Act, pay to the claimant an amount that is, as determined by the Special Master, equal to the difference between—</chapeau><subclause class="fontsize10" id="yd74c8939-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the amount the claimant would have been paid under this title if sufficient funding was available to the Special Master at the time the Special Master determined the amount due the claimant under this title; and</content></subclause>
<subclause class="fontsize10" id="yd74c893a-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the amount the claimant was paid under this title.</content></subclause>
</clause>
<clause class="fontsize10" id="yd74c893b-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>For purposes of this subparagraph:</chapeau><subclause class="fontsize10" id="yd74c893c-e820-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">Insufficient funding</inline>.—</heading><chapeau>The term ‘<term>insufficient funding</term>’ means funding—</chapeau><item class="fontsize10" id="yd74c893d-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>that is available to the Special Master under section 410(c) on the day before the date of enactment of the Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act for purposes of compensating claims in Group B as described in section 405(a)(3)(C)(iii); and</content></item>
<item class="fontsize10" id="yd74c893e-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>that the Special Master determines is insufficient for purposes of compensating all such claims and complying with subparagraph (A).</content></item>
</subclause>
<subclause class="fontsize10" id="yd74c893f-e820-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Sufficient funding</inline>.—</heading><chapeau>The term ‘<term>sufficient funding</term>’ means funding—</chapeau><item class="fontsize10" id="yd74c8940-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>made available to the Special Master for purposes of compensating claims in Group B as described in section 405(a)(3)(C)(iii) through an Act of Congress that is enacted after the date on which the amount of the claim described in clause (i) has been reduced; and</content></item>
<item class="fontsize10" id="yd74c8941-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>that the Special Master determines is sufficient for purposes of compensating all claims in such Group B.”</content></item>

<subsection class="firstIndent0 fontsize10" id="yd74c8942-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/d" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Limitations on Noneconomic Loss</inline>.—</heading><chapeau>Section 405(b)(7)(A) of the of the Air Transportation Safety and System Stabilization Act (<ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd74c8943-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> clauses (i) and (ii) as subclauses (I) and (II) respectively, and adjusting the margins accordingly;</content></paragraph>
<paragraph class="fontsize10" id="yd74c8944-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>With respect to</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><clause class="indentUp2 fontsize10" id="yd74c8945-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in clause (ii), with respect to”</content></clause>

<paragraph class="fontsize10" id="yd74c8946-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentUp2 fontsize10" id="yd74cb057-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd74cb058-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>The Special Master may exceed the applicable limitation in clause (i) for a claim in Group B as described in subsection (a)(3)(C)(iii) if the Special Master determines that the claim presents special circumstances.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="yd74cb059-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s2/e" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd74cb05a-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s40101">49 USC 40101 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Adjustment of Annual Gross Income Limitation</inline>.—</heading><content>Section 405(b)(7)(B)(ii) of the Air Transportation Safety and System Stabilization Act (<ref href="/us/usc/t40/s40101">40 U.S.C. 40101 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>$200,000.</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>the annual gross income limitation. The <page identifier="/us/stat/133/1042">133 STAT. 1042</page>
annual gross income limitation in effect on the date of enactment of the Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act is $200,000. The Special Master shall periodically adjust that annual gross income limitation to account for inflation.</quotedText>”.</content></subsection>

<section id="d96380e395" identifier="/us/pl/116/34/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>APPOINTMENT OF SPECIAL MASTER AND DEPUTY SPECIAL MASTERS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd74cb05b-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 404 of the Air Transportation Safety and System Stabilization Act (<ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd74cb05c-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (b) as subsection (c); and</content></paragraph>
<paragraph class="fontsize10" id="yd74cb05d-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (a) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yd74cd76e-e820-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Appointment of Special Master and Deputy Special Masters</inline>.—</heading><content>The Attorney General may appoint a Special Master and no more than two Deputy Special Masters without regard to the provisions of <ref href="/us/usc/t5">title 5, United States Code</ref>, governing appointments in the competitive service. Any such employee shall serve at the pleasure of the Attorney General. The Attorney General shall fix the annual salary of the Special Master and the Deputy Special Masters.”</content></subsection>

<section id="d96380e442" identifier="/us/pl/116/34/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>BUDGETARY EFFECTS.</heading><subsection class="firstIndent0 fontsize10" id="yd74cd76f-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Statutory PAYGO Scorecards</inline>.—</heading><content>The budgetary effects of this Act shall not be entered on either PAYGO scorecard maintained pursuant to section 4(d) of the Statutory Pay-As-You-Go Act of 2010.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd74cfe80-e820-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/34/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Senate PAYGO Scorecards</inline>.—</heading><content>The budgetary effects of this Act shall not be entered on any PAYGO scorecard maintained for purposes of section 4106 of House Concurrent Resolution 71 (115th Congress).</content></subsection>
