<section id="d97288e94" identifier="/us/pl/116/327/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Competitive Health Insurance Reform Act of 2020</shortTitle>”.</content></section>
<section id="d97288e104" identifier="/us/pl/116/327/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>RESTORING THE APPLICATION OF ANTITRUST LAWS TO THE BUSINESS OF HEALTH INSURANCE.</heading><subsection class="firstIndent0 fontsize10" id="y6160bd2d-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/327/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendment to McCarran-Ferguson Act</inline>.—</heading><content>Section 3 of the Act of March 9, 1945 (<ref href="/us/usc/t15/s1013">15 U.S.C. 1013</ref>), commonly known as the McCarran-Ferguson Act, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y61610b4e-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c)</num><paragraph class="inline" id="y61610b4f-e821-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>Nothing contained in this Act shall modify, impair, or supersede the operation of any of the antitrust laws with respect to the business of health insurance (including the business of dental insurance and limited-scope dental benefits).</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y61610b50-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>Paragraph (1) shall not apply with respect to making a contract, or engaging in a combination or conspiracy—</chapeau><subparagraph class="fontsize10" id="y61610b51-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to collect, compile, or disseminate historical loss data;</content></subparagraph>
<subparagraph class="fontsize10" id="y61610b52-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>to determine a loss development factor applicable to historical loss data;</content></subparagraph>
<subparagraph class="fontsize10" id="y61610b53-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>to perform actuarial services if such contract, combination, or conspiracy does not involve a restraint of trade; or</content></subparagraph>
<subparagraph class="fontsize10" id="y61610b54-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>to develop or disseminate a standard insurance policy form (including a standard addendum to an insurance policy form and standard terminology in an insurance policy form) if such contract, combination, or conspiracy is not to adhere to such standard form or require adherence to such standard form.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y61610b55-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x61610b56-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definitions.</p></sidenote><chapeau>For purposes of this subsection—</chapeau><subparagraph class="fontsize10" id="y61610b57-e821-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the term ‘<term>antitrust laws</term>’ has the meaning given it in subsection (a) of the first section of the Clayton Act (<ref href="/us/usc/t15/s12">15 U.S.C. 12</ref>), except that such term includes section 5 of the Federal Trade Commission Act (<ref href="/us/usc/t15/s45">15 U.S.C. 45</ref>) to the extent that such section 5 applies to unfair methods of competition;</content></subparagraph>
<subparagraph class="fontsize10" id="y61610b58-e821-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the term ‘<term>business of health insurance (including the business of dental insurance and limited-scope dental benefits)</term>’ does not include—</chapeau><clause class="fontsize10" id="y61610b59-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the business of life insurance (including annuities); or<page identifier="/us/stat/134/5098">134 STAT. 5098</page></content></clause>
<clause class="fontsize10" id="y61610b5a-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>the business of property or casualty insurance, including but not limited to—</chapeau><subclause class="fontsize10" id="y61610b5b-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>any insurance or benefits defined as ‘excepted benefits’ under paragraph (1), subparagraph (B) or (C) of paragraph (2), or paragraph (3) of section 9832(c) of the Internal Revenue Code of 1986 (<ref href="/us/usc/t26/s9832/c">26 U.S.C. 9832(c)</ref>) whether offered separately or in combination with insurance or benefits described in paragraph (2)(A) of such section; and</content></subclause>
<subclause class="fontsize10" id="y61610b5c-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>any other line of insurance that is classified as property or casualty insurance under State law;</content></subclause>

</subparagraph>
<subparagraph class="fontsize10" id="y61610b5d-e821-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the term ‘<term>historical loss data</term>’ means information respecting claims paid, or reserves held for claims reported, by any person engaged in the business of insurance; and</content></subparagraph>
<subparagraph class="fontsize10" id="y61610b5e-e821-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>the term ‘<term>loss development factor</term>’ means an adjustment to be made to reserves held for losses incurred for claims reported by any person engaged in the business of insurance, for the purpose of bringing such reserves to an ultimate paid basis.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y6161326f-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/327/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x61613270-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p><p class="leftAlign firstIndent0 fontsize8" id="x61613271-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s1013">15 USC 1013 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Related Provision</inline>.—</heading><content>For purposes of section 5 of the Federal Trade Commission Act (<ref href="/us/usc/t15/s45">15 U.S.C. 45</ref>) to the extent such section applies to unfair methods of competition, section 3(c) of the McCarran-Ferguson Act shall apply with respect to the business of health insurance without regard to whether such business is carried on for profit, notwithstanding the definition of “Corporation” contained in section 4 of the Federal Trade Commission Act.</content></subsection>

<section id="d97288e246" identifier="/us/pl/116/327/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
