<section id="d97554e102" identifier="/us/pl/116/325/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Bankruptcy Administration Improvement Act of 2020</shortTitle>”.</content></section>
<section id="d97554e112" identifier="/us/pl/116/325/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70ce7a18-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t28/s1930">28 USC 1930 note</ref>.</p></sidenote><heading>FINDINGS AND PURPOSE.</heading><subsection class="firstIndent0 fontsize10" id="y70ceef49-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds the following:</chapeau><paragraph class="fontsize10" id="y70ceef4a-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Because of the importance of the goal that the bankruptcy system is self-funded, at no cost to the taxpayer, Congress has closely monitored the funding needs of the bankruptcy system, including by requiring periodic reporting by the Attorney General regarding the United States Trustee System Fund.</content></paragraph>
<paragraph class="fontsize10" id="y70ceef4b-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Congress has amended the various bankruptcy fees as necessary to ensure that the bankruptcy system remains self-supporting, while also fairly allocating the costs of the system among those who use the system.</content></paragraph>
<paragraph class="fontsize10" id="y70ceef4c-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Because the bankruptcy system is interconnected, the result has been a system of fees, including filing fees, quarterly fees in chapter 11 cases, and other fees, that together fund the courts, judges, United States trustees, and chapter 7 case trustees necessary for the bankruptcy system to function.</content></paragraph>
<paragraph class="fontsize10" id="y70ceef4d-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>This Act and the amendments made by this Act—</chapeau><subparagraph class="fontsize10" id="y70ceef4e-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s2/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>ensure adequate funding of the United States trustees, supports the preservation of existing bankruptcy judgeships that are urgently needed to handle existing and anticipated increases in business and consumer caseloads, and provides long-overdue additional compensation for chapter 7 case trustees whose caseloads include chapter 11 reorganization cases that were converted to chapter 7 liquidation cases; and</content></subparagraph>
<subparagraph class="fontsize10" id="y70ceef4f-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s2/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>confirm the longstanding intention of Congress that quarterly fee requirements remain consistent across all Federal judicial districts.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y70ceef50-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Purpose</inline>.—</heading><content>The purpose of this Act and the amendments made by this Act is to further the long-standing goal of Congress of ensuring that the bankruptcy system is self-funded, at no cost to the taxpayer.<page identifier="/us/stat/134/5087">134 STAT. 5087</page></content></subsection>
</section>
<section id="d97554e173" identifier="/us/pl/116/325/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>UNITED STATES TRUSTEE SYSTEM FUND; BANKRUPTCY FEES.</heading><subsection class="firstIndent0 fontsize10" id="y70cfd9b1-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70cfd9b2-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t28/s589a">28 USC 589a note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Deposits of Certain Fees for Fiscal Years 2021 Through 2026</inline>.—</heading><chapeau>Notwithstanding <ref href="/us/usc/t28/s589a/b">section 589a(b) of title 28, United States Code</ref>, for each of fiscal years 2021 through 2026—</chapeau><paragraph class="fontsize10" id="y70d000c3-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the fees collected under section 1930(a)(6) of such title, less the amount specified in subparagraph (2), shall be deposited as specified in subsection (b); and</content></paragraph>
<paragraph class="fontsize10" id="y70d000c4-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>$5,400,000 of the fees collected under section 1930(a)(6) of such title shall be deposited in the general fund of the Treasury.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y70d000c5-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s3/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">United States Trustee System Fund</inline>.—</heading><content><ref href="/us/usc/t28/s589a">Section 589a of title 28, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y70d027d6-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f)</num><paragraph class="inline" id="y70d027d7-e821-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70d027d8-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><chapeau>During each of fiscal years 2021 through 2026 and notwithstanding subsections (b) and (c), the fees collected under section 1930(a)(6), less the amount specified in paragraph (2), shall be deposited as follows, in the following order:</chapeau><subparagraph class="fontsize10" id="y70d027d9-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>First, the amounts specified in the Department of Justice appropriations for that fiscal year, shall be deposited as discretionary offsetting collections to the “United States Trustee System Fund”, pursuant to subsection (a), to remain available until expended.</content></subparagraph>
<subparagraph class="fontsize10" id="y70d027da-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70d027db-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x70d027dc-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reimbursement.</p></sidenote><content>Second, the amounts determined annually by the Director of the Administrative Office of the United States Courts that are necessary to reimburse the judiciary for the costs of administering payments under section 330(e) of title 11, shall be deposited as mandatory offsetting collections to the ‘United States Trustee System Fund’, and transferred and deposited into the special fund established under section 1931(a), and notwithstanding subsection (a), shall be available for expenditure without further appropriation.</content></subparagraph>
<subparagraph class="fontsize10" id="y70d027dd-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70d027de-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>Third, the amounts determined annually by the Director of the Administrative Office of the United States Courts that are necessary to pay trustee compensation authorized by section 330(e)(2) of title 11, shall be deposited as mandatory offsetting collections to the ‘United States Trustee System Fund’, and transferred and deposited into the Chapter 7 Trustee Fund established under section 330(e) of title 11 for payment to trustees serving in cases under chapter 7 of title 11 (in addition to the amounts paid under section 330(b) of title 11), in accordance with that section, and notwithstanding subsection (a), shall be available for expenditure without further appropriation.</content></subparagraph>
<subparagraph class="fontsize10" id="y70d027df-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>Fourth, any remaining amounts shall be deposited as discretionary offsetting collections to the ‘United States Trustee System Fund’, to remain available until expended.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y70d027e0-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70d027e1-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>Notwithstanding subsection (b), for each of fiscal years 2021 through 2026, $5,400,000 of the fees collected under section 1930(a)(6) shall be deposited in the general fund of the Treasury.”</content></paragraph>
</subsection>

<subsection class="firstIndent0 fontsize10" id="y70d027e2-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s3/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Compensation of Officers</inline>.—</heading><content><ref href="/us/usc/t11/s330">Section 330 of title 11, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y70d07603-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e)</num><paragraph class="inline" id="y70d07604-e821-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>There is established a fund in the Treasury of the United States, to be known as the ‘Chapter 7 Trustee Fund’, which shall be administered by the Director of the Administrative Office of the United States Courts.<page identifier="/us/stat/134/5088">134 STAT. 5088</page></content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y70d07605-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Deposits into the Chapter 7 Trustee Fund under section 589a(f)(1)(C) of title 28 shall be available until expended for the purposes described in paragraph (3).</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y70d07606-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70d07607-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><content>For fiscal years 2021 through 2026, the Chapter 7 Trustee Fund shall be available to pay the trustee serving in a case that is filed under chapter 7 or a case that is converted to a chapter 7 case in the most recent fiscal year (referred to in this subsection as a ‘chapter 7 case’) the amount described in paragraph (4) for the chapter 7 case in which the trustee has rendered services in that fiscal year.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y70d07608-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>The amount described in this paragraph shall be the lesser of—</chapeau><subparagraph class="fontsize10" id="y70d07609-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>$60; or</content></subparagraph>
<subparagraph class="fontsize10" id="y70d0760a-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a pro rata share, for each chapter 7 case, of the fees collected under section 1930(a)(6) of title 28 and deposited to the United States Trustee System Fund under section 589a(f)(1) of title 28, less the amounts specified in section 589a(f)(1)(A) and (B) of title 28.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y70d0760b-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>The payment received by a trustee under paragraph (3) shall be paid in addition to the amount paid under subsection (b).</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y70d0760c-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70d0760d-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x70d0760e-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Regulations.</p></sidenote><content>Not later than September 30, 2021, the Director of the Administrative Office of the United States Courts shall promulgate regulations for the administration of this subsection.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y70d0760f-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s3/d" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Bankruptcy Fees</inline>.—</heading><chapeau><ref href="/us/usc/t28/s1930/a">Section 1930(a) of title 28, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y70d07610-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s3/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (6)(B) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="fontsize10" id="y70d09d21-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline" id="y70d09d22-e821-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x70d09d23-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p><p class="leftAlign firstIndent0 fontsize8" id="x70d09d24-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><content>During the 5-year period beginning on January 1, 2021, in addition to the filing fee paid to the clerk, a quarterly fee shall be paid to the United States trustee, for deposit in the Treasury, in each open and reopened case under chapter 11 of title 11, other than under subchapter V, for each quarter (including any fraction thereof) until the case is closed, converted, or dismissed, whichever occurs first.</content></clause>
<clause class="indentUp0 fontsize10" id="y70d09d25-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>The fee shall be the greater of—</chapeau><subclause class="fontsize10" id="y70d09d26-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>0.4 percent of disbursements or $250 for each quarter in which disbursements total less than $1,000,000; and</content></subclause>
<subclause class="fontsize10" id="y70d09d27-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>0.8 percent of disbursements but not more than $250,000 for each quarter in which disbursements total at least $1,000,000.</content></subclause>
</clause>
<clause class="indentUp0 fontsize10" id="y70d09d28-e821-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>The fee shall be payable on the last day of the calendar month following the calendar quarter for which the fee is owed.”</content></clause>
</subparagraph>
</quotedContent>; and</content></paragraph>
<paragraph class="fontsize10" id="y70d09d29-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s3/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (7), in the first sentence, by <amendingAction type="delete">striking</amendingAction> “<quotedText>may</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>shall</quotedText>”.</content></paragraph>
</subsection>

<subparagraph class="fontsize10" id="y70d3aadd-e821-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/325/s4/f/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content></subparagraph>
