<section id="d100211e94" identifier="/us/pl/116/31/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Effective Prosecution of Possession of Biological Toxins and Agents Act of 2019</shortTitle>”.</content></section>
<section id="d100211e104" identifier="/us/pl/116/31/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PROHIBITION ON THE POSSESSION OF BIOLOGICAL TOXINS AND AGENTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x07d3854b-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t18/s175b">Section 175b of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y07d3854c-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/31/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y07d3854d-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/31/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>(a)(1) No restricted</quotedText>” and all that follows through the end of paragraph (1) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="y07d3ac5e-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Offense</inline>.—</heading><paragraph class="fontsize10" id="y07d3ac5f-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>It shall be unlawful for a restricted person to—</chapeau><subparagraph class="fontsize10" id="y07d3ac60-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>ship, transport, or possess in or affecting interstate or foreign commerce any biological agent or toxin described in paragraph (2); or</content></subparagraph>
<subparagraph class="fontsize10" id="y07d3ac61-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>receive any biological agent or toxin described in paragraph (2) that has been shipped or transported in interstate or foreign commerce.</content></subparagraph>

<paragraph class="fontsize10" id="y07d3ac62-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Agents and toxins covered</inline>.—</heading><chapeau>A biological agent or toxin described in this paragraph is a biological agent or toxin that—</chapeau><subparagraph class="fontsize10" id="y07d3ac63-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is listed as a non-overlap or overlap select biological agent or toxin under <ref href="/us/cfr/t42/pt73">part 73 of title 42, Code of Federal Regulations</ref>, pursuant to section 351A of the Public Health Service Act (<ref href="/us/usc/t42/s262a">42 U.S.C. 262a</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="y07d3ac64-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is not excluded or exempted under <ref href="/us/cfr/t42/pt73">part 73 of title 42, Code of Federal Regulations</ref>.”</content></subparagraph>

<subparagraph class="fontsize10" id="y07d3ac65-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/31/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>(2) Whoever</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(3) <headingText class="smallCaps">Penalty</headingText>.—Whoever</quotedText>” and adjusting the margin accordingly; and<page identifier="/us/stat/133/1035">133 STAT. 1035</page></content></subparagraph>
