<section id="d100775e94" identifier="/us/pl/116/30/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Fairness For Breastfeeding Mothers Act of 2019</shortTitle>”.</content></section>
<section id="d100775e104" identifier="/us/pl/116/30/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>LACTATION ROOM IN PUBLIC BUILDINGS.</heading><subsection class="firstIndent0 fontsize10" id="y5deb9e34-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/30/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Lactation Room in Public Buildings</inline>.—</heading><content><ref href="/us/usc/t40/ch33">Chapter 33 of title 40, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<quotedContent><section class="centered fontsize12" id="y5dec1365-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658164"><num class="fontsize12" value="3318">“§ 3318.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5dec1366-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s3318">40 USC 3318</ref>.</p></sidenote> Lactation room in public buildings</heading><subsection class="firstIndent0 fontsize10" id="y5dec1367-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y5dec1368-e822-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate authority</inline>.—</heading><content>The term ‘<term>appropriate authority</term>’ means the head of a Federal agency, the Architect of the Capitol, or other official authority responsible for the operation of a public building.</content></paragraph>
<paragraph class="fontsize10" id="y5dec1369-e822-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Covered public building</inline>.—</heading><content>The term ‘<term>covered public building</term>’ means a public building (as defined in section 3301) that is open to the public and contains a public restroom, and includes a building listed in section 6301 or 5101.</content></paragraph>
<paragraph class="fontsize10" id="y5dec136a-e822-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Lactation room</inline>.—</heading><chapeau>The term ‘<term>lactation room</term>’ means a hygienic place, other than a bathroom, that—</chapeau><subparagraph class="fontsize10" id="y5dec136b-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is shielded from view;</content></subparagraph>
<subparagraph class="fontsize10" id="y5dec136c-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is free from intrusion; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5dec136d-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>contains a chair, a working surface, and, if the public building is otherwise supplied with electricity, an electrical outlet.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5dec136e-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Lactation Room Required</inline>.—</heading><content>Except as provided in subsection (c), the appropriate authority of a covered public building shall ensure that the building contains a lactation room that is made available for use by members of the public to express breast milk.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5dec136f-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><chapeau>A covered public building may be excluded from the requirement in subsection (b) at the discretion of the appropriate authority if—</chapeau><paragraph class="fontsize10" id="y5dec1370-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>the public building—</chapeau><subparagraph class="fontsize10" id="y5dec1371-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>does not contain a lactation room for employees who work in the building; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5dec1372-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>does not have a room that could be repurposed as a lactation room or a space that could be made private using portable materials, at a reasonable cost; or<page identifier="/us/stat/133/1033">133 STAT. 1033</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5dec1373-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>new construction would be required to create a lactation room in the public building and the cost of such construction is unfeasible.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5dec1374-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">No Unauthorized Entry</inline>.—</heading><content>Nothing in this section shall be construed to authorize an individual to enter a public building or portion thereof that the individual is not otherwise authorized to enter.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y5dec1375-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/30/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Clerical Amendment</inline>.—</heading><content>The table of sections at the beginning of <ref href="/us/usc/t40/ch33">chapter 33 of title 40, United States Code</ref>,<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5dec1376-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s3301">40 USC 3301</ref> prec.<?GPOvSpace 04?></p></sidenote> <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after the item related to section 3316 the following new item:<quotedContent><toc>
