<section id="d175635e101" identifier="/us/pl/116/3/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6694df8b-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1305">42 USC 1305 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Medicaid Extenders Act of 2019</shortTitle>”.</content></section>
<section id="d175635e116" identifier="/us/pl/116/3/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>EXTENSION OF MONEY FOLLOWS THE PERSON REBALANCING DEMONSTRATION.</heading><subsection class="firstIndent0 fontsize10" id="y669554bc-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">General Funding</inline>.—</heading><chapeau>Section 6071(h) of the Deficit Reduction Act of 2005 (<ref href="/us/usc/t42/s1396a">42 U.S.C. 1396a note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y669554bd-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y669554be-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (D), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” after the semicolon;</content></subparagraph>

<paragraph class="fontsize10" id="y669554c5-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentUp0 fontsize10" id="y66957bd6-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x66957bd7-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Grants.</p><p class="leftAlign firstIndent0 fontsize8" id="x66957bd8-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">State and local governments.</p><p class="leftAlign firstIndent0 fontsize8" id="x66957bd9-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Special rule for fy </inline>2019.—</heading><content>Funds appropriated under paragraph (1)(F) shall be made available for grants to States only if such States have an approved MFP demonstration project under this section as of December 31, 2018.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y66957bda-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Funding for Quality Assurance and Improvement; Technical Assistance; Oversight</inline>.—</heading><content>Section 6071(f) of the Deficit Reduction Act of 2005 (<ref href="/us/usc/t42/s1396a">42 U.S.C. 1396a note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> paragraph (2) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="fontsize10" id="y66957bdb-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Funding</inline>.—</heading><content>From the amounts appropriated under subsection (h)(1)(F) for fiscal year 2019, $500,000 shall be available to the Secretary for such fiscal year to carry out this subsection.”</content></paragraph>

<section id="d175635e303" identifier="/us/pl/116/3/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>EXTENSION OF PROTECTION FOR MEDICAID RECIPIENTS OF HOME AND COMMUNITY-BASED SERVICES AGAINST SPOUSAL IMPOVERISHMENT.</heading><subsection class="firstIndent0 fontsize10" id="y6695c9ff-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6695ca00-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/pl/111/148/s2404">Section 2404 of Public Law 111–148</ref> (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>the 5-year period that begins on January 1, 2014,</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>the period beginning on January 1, 2014, and ending on March 31, 2019,</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6695ca01-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6695ca02-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1396r–5">42 USC 1396r–5 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><paragraph class="fontsize10" id="y6695ca03-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Protecting state spousal income and asset disregard flexibility under waivers and plan amendments</inline>.—</heading><content>Nothing in <ref href="/us/pl/111/148/s2404">section 2404 of Public Law 111–148</ref> (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5 note</ref>) or section 1924 of the Social Security Act (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5</ref>) shall be construed as prohibiting a State from disregarding an individual’s spousal income and assets under a State waiver or plan amendment described in paragraph (2) for purposes of making determinations of eligibility for home and community-based services or home and community-based attendant services and supports under such waiver or plan amendment.</content></paragraph>
<paragraph class="fontsize10" id="y6695ca04-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">State waiver or plan amendment described</inline>.—</heading><chapeau>A State waiver or plan amendment described in this paragraph is any of the following:</chapeau><subparagraph class="fontsize10" id="y6695ca05-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s3/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>A waiver or plan amendment to provide medical assistance for home and community-based services under a waiver or plan amendment under subsection (c), (d), or (i) of section 1915 of the Social Security Act (<ref href="/us/usc/t42/s1396n">42 U.S.C. 1396n</ref>) or under section 1115 of such Act (<ref href="/us/usc/t42/s1315">42 U.S.C. 1315</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y6695ca06-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s3/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>A plan amendment to provide medical assistance for home and community-based services for individuals by reason of being determined eligible under section 1902(a)(10)(C) of such Act (<ref href="/us/usc/t42/s1396a/a/10/C">42 U.S.C. 1396a(a)(10)(C)</ref>) or by reason of section 1902(f) of such Act (<ref href="/us/usc/t42/s1396a/f">42 U.S.C. 1396a(f)</ref>) or otherwise on the basis of a reduction of income based on costs incurred for medical or other remedial care under which the State disregarded the income and assets of the individual’s spouse in determining the initial and ongoing financial eligibility of an individual for such services in place of the spousal impoverishment provisions applied under section 1924 of such Act (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y6695ca07-e822-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/3/s3/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>A plan amendment to provide medical assistance for home and community-based attendant services and supports under section 1915(k) of such Act (<ref href="/us/usc/t42/s1396n/k">42 U.S.C. 1396n(k)</ref>).</content></subparagraph>

<section id="d175635e413" identifier="/us/pl/116/3/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>REDUCTION IN FMAP AFTER 2020 FOR STATES WITHOUT ASSET VERIFICATION PROGRAM.</heading><content class="firstIndent0 fontsize10" id="x6695f118-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 1940 of the Social Security Act (<ref href="/us/usc/t42/s1396w">42 U.S.C. 1396w</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y66963f39-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="k">“(k) </num><heading class="fontsize10"><inline class="smallCaps">Reduction in FMAP After </inline>2020 <inline class="smallCaps">for Non-Compliant States</inline>.—</heading><paragraph class="fontsize10" id="y66963f3a-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x66963f3b-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>With respect to a calendar quarter beginning on or after January 1, 2021, the Federal medical assistance percentage otherwise determined under section 1905(b) for a non-compliant State shall be reduced—</chapeau><subparagraph class="fontsize10" id="y66963f3c-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>for calendar quarters in 2021 and 2022, by 0.12 percentage points;<page identifier="/us/stat/133/8">133 STAT. 8</page></content></subparagraph>
<subparagraph class="fontsize10" id="y66963f3d-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>for calendar quarters in 2023, by 0.25 percentage points;</content></subparagraph>
<subparagraph class="fontsize10" id="y66963f3e-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>for calendar quarters in 2024, by 0.35 percentage points; and</content></subparagraph>
<subparagraph class="fontsize10" id="y66963f3f-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>for calendar quarters in 2025 and each year thereafter, by 0.5 percentage points. </content></subparagraph>

<paragraph class="fontsize10" id="y66963f40-e822-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Non-compliant state defined</inline>.—</heading><chapeau>For purposes of this subsection, the term ‘<term>non-compliant State</term>’ means a State—</chapeau><subparagraph class="fontsize10" id="y66963f41-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>that is one of the 50 States or the District of Columbia;</content></subparagraph>
<subparagraph class="fontsize10" id="y66963f42-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>with respect to which the Secretary has not approved a State plan amendment submitted under subsection (a)(2); and</content></subparagraph>
<subparagraph class="fontsize10" id="y66963f43-e822-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>that is not operating, on an ongoing basis, an asset verification program in accordance with this section.”</content></subparagraph>

<section id="d175635e502" identifier="/us/pl/116/3/s5" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>MEDICAID IMPROVEMENT FUND.</heading><content style="-uslm-lc:I658120">  Section 1941(b)(1) of the Social Security Act (<ref href="/us/usc/t42/s1396w–1/b/1">42 U.S.C. 1396w–1(b)(1)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>$31,000,000</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>$6,000,000</quotedText>”.</content></section>
