<section id="d101581e102" identifier="/us/pl/116/289/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Young Fishermen’s Development Act</shortTitle>”.</content></section>
<section id="d101581e112" identifier="/us/pl/116/289/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcbc5dfe1-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t33/s1141">33 USC 1141</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xcbc606f2-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="ycbc606f3-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Sea grant institution</inline>.—</heading><content>The term “<term>Sea Grant Institution</term>” means a sea grant college or sea grant institute, as those terms are defined in section 203 of the National Sea Grant College Program Act (<ref href="/us/usc/t33/s1122">33 U.S.C. 1122</ref>).</content></paragraph>
<paragraph class="fontsize10" id="ycbc606f4-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Tribal organization</inline>.—</heading><content>The term “<term>Tribal organization</term>” has the meaning given the term “<term>tribal organization</term>” in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>).</content></paragraph>
<paragraph class="fontsize10" id="ycbc606f5-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Young fisherman</inline>.—</heading><chapeau>The term “<term>young fisherman</term>” means an individual who—</chapeau><subparagraph class="fontsize10" id="ycbc606f6-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>desires to participate in the commercial fisheries of the United States, including the Great Lakes fisheries;</content></subparagraph>
<subparagraph class="fontsize10" id="ycbc606f7-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>has worked as a captain, crew member, or deckhand on a commercial fishing vessel for not more than 10 years of cumulative service; or</content></subparagraph>
<subparagraph class="fontsize10" id="ycbc606f8-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s2/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>is a beginning commercial fisherman.</content></subparagraph>
</paragraph>
</section>
<section id="d101581e174" identifier="/us/pl/116/289/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcbc606f9-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t33/s1142">33 USC 1142</ref>.</p></sidenote><heading>ESTABLISHMENT OF PROGRAM.</heading><content style="-uslm-lc:I658120">  The Secretary of Commerce, acting through the National Sea Grant Office, shall establish a program to provide training, education, outreach, and technical assistance initiatives for young fishermen, to be known as the “Young Fishermen’s Development Grant Program” (referred to in this section as the “Program”).</content></section>
<section id="d101581e187" identifier="/us/pl/116/289/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcbc62e0a-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t33/s1143">33 USC 1143</ref>.</p></sidenote><heading>GRANTS.</heading><subsection class="firstIndent0 fontsize10" id="ycbc7668b-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>In carrying out the Program, the Secretary shall make competitive grants to support new and established local and regional training, education, outreach, and technical assistance initiatives for young fishermen, including programs, workshops, and services relating to—</chapeau><paragraph class="fontsize10" id="ycbc7668c-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>seamanship, navigation, electronics, and safety;</content></paragraph>
<paragraph class="fontsize10" id="ycbc7668d-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>vessel and engine care, maintenance, and repair;</content></paragraph>
<paragraph class="fontsize10" id="ycbc7668e-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>innovative conservation fishing gear engineering and technology;<page identifier="/us/stat/134/4887">134 STAT. 4887</page></content></paragraph>
<paragraph class="fontsize10" id="ycbc7668f-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>sustainable fishing practices;</content></paragraph>
<paragraph class="fontsize10" id="ycbc76690-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>entrepreneurship and good business practices;</content></paragraph>
<paragraph class="fontsize10" id="ycbc76691-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>direct marketing, supply chain, and traceability;</content></paragraph>
<paragraph class="fontsize10" id="ycbc76692-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>financial and risk management, including vessel, permit, and quota purchasing;</content></paragraph>
<paragraph class="fontsize10" id="ycbc76693-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>State and Federal legal requirements for specific fisheries, including reporting, monitoring, licenses, and regulations;</content></paragraph>
<paragraph class="fontsize10" id="ycbc76694-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>State and Federal fisheries policy and management;</content></paragraph>
<paragraph class="fontsize10" id="ycbc76695-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>mentoring, apprenticeships, or internships; and</content></paragraph>
<paragraph class="fontsize10" id="ycbc76696-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/a/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>any other activities, opportunities, or programs, as the Secretary determines appropriate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ycbc76697-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility</inline>.—</heading><paragraph class="fontsize10" id="ycbc76698-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Applicants</inline>.—</heading><chapeau>To be eligible to receive a grant under the Program, a recipient shall be a collaborative State, Tribal, local, or regionally based network or partnership of public or private entities, which may include—</chapeau><subparagraph class="fontsize10" id="ycbc76699-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a Sea Grant Institution;</content></subparagraph>
<subparagraph class="fontsize10" id="ycbc7669a-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a Federal or State agency or a Tribal organization;</content></subparagraph>
<subparagraph class="fontsize10" id="ycbc7669b-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>a community-based nongovernmental organization;</content></subparagraph>
<subparagraph class="fontsize10" id="ycbc7669c-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>fishermen’s cooperatives or associations;</content></subparagraph>
<subparagraph class="fontsize10" id="ycbc7669d-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>an institution of higher education (including an institution awarding an associate’s degree), or a foundation maintained by an institution of higher education; or</content></subparagraph>
<subparagraph class="fontsize10" id="ycbc7669e-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>any other appropriate entity, as the Secretary determines appropriate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ycbc7669f-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Participants</inline>.—</heading><content>All young fishermen seeking to participate in the commercial fisheries of the United States and the Great Lakes are eligible to participate in the activities funded through grants provided for in this section, except that participants in such activities shall be selected by each grant recipient.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ycbc766a0-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Maximum Term and Amount of Grant</inline>.—</heading><paragraph class="fontsize10" id="ycbc766a1-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>A grant under this section shall—</chapeau><subparagraph class="fontsize10" id="ycbc766a2-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>have a term of no more than 3 fiscal years; and</content></subparagraph>
<subparagraph class="fontsize10" id="ycbc766a3-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>be in an amount that is not more than $200,000 for each fiscal year.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ycbc766a4-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Consecutive grants</inline>.—</heading><content>An eligible recipient may receive consecutive grants under this section.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ycbc766a5-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Matching Requirement</inline>.—</heading><content>To be eligible to receive a grant under this section, a recipient shall provide a match in the form of cash or in-kind contributions from the recipient in the amount equal to or greater than 25 percent of the funds provided by the grant.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ycbc766a6-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Regional Balance</inline>.—</heading><content>In making grants under this section, the Secretary shall, to the maximum extent practicable, ensure geographic diversity.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ycbc766a7-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcbc766a8-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Cooperation and Evaluation Criteria</inline>.—</heading><chapeau>In carrying out this section and in developing criteria for evaluating grant applications, the Secretary shall consult, to the maximum extent practicable, with—</chapeau><paragraph class="fontsize10" id="ycbc766a9-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Sea Grant Institutions and extension agents of such institutions;</content></paragraph>
<paragraph class="fontsize10" id="ycbc766aa-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>community-based nongovernmental fishing organizations;</content></paragraph>
<paragraph class="fontsize10" id="ycbc766ab-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/f/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Federal and State agencies, including Regional Fishery Management Councils established under the Magnuson-Stevens <page identifier="/us/stat/134/4888">134 STAT. 4888</page>
Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1851/etseq">16 U.S.C. 1851 et seq.</ref>);</content></paragraph>
<paragraph class="fontsize10" id="ycbc766ac-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/f/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>institutions of higher education with fisheries expertise and programs; and</content></paragraph>
<paragraph class="fontsize10" id="ycbc766ad-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/f/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>partners, as the Secretary determines.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ycbc766ae-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s4/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition</inline>.—</heading><content>A grant under this section may not be used to purchase any fishing license, permit, quota, or other harvesting right.</content></subsection>
</section>
<section id="d101581e432" identifier="/us/pl/116/289/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcbc766af-e822-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t33/s1144">33 USC 1144</ref>.</p></sidenote><heading>FUNDING.</heading><subsection class="firstIndent0 fontsize10" id="ycbc78cc0-e822-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/289/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Authorizations</inline>.—</heading><content>There are authorized to be appropriated to carry out this Act $2,000,000 for each of fiscal years 2022 through 2026.</content></subsection>
