<section id="d102341e100" identifier="/us/pl/116/279/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Child Care Protection Improvement Act of 2020</shortTitle>”.</content></section>
<section id="d102341e110" identifier="/us/pl/116/279/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>TASK FORCE TO ASSIST IN IMPROVING CHILD SAFETY.</heading><subsection class="firstIndent0 fontsize10" id="y3ad6a44a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a44b-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a44c-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a44d-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established a task force, to be known as the Interagency Task Force for Child Safety (referred to in this section as the “Task Force”) to identify, evaluate, and recommend best practices and technical assistance to assist Federal and State agencies in fully implementing the requirements of section 658H(b) of the Child Care and Development Block Grant Act of 1990 (<ref href="/us/usc/t42/s9858f/b">42 U.S.C. 9858f(b)</ref>) for child care staff members.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a44e-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a44f-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a450-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Composition</inline>.—</heading><chapeau>Not later than 60 days after the date of enactment of this Act, the President shall appoint the members of the Task Force, which shall—</chapeau><paragraph class="fontsize10" id="y3ad6a451-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>consist of only Federal officers and employees; and</content></paragraph>
<paragraph class="fontsize10" id="y3ad6a452-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>include—</chapeau><subparagraph class="fontsize10" id="y3ad6a453-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Director of the Office of Child Care of the Department of Health and Human Services (or the Director’s designee), the Associate Commissioner of the Children’s Bureau of the Department of Health and Human Services (or the Associate Commissioner’s designee), and the Director of the Federal Bureau of Investigation (or the Director’s designee); and</content></subparagraph>
<subparagraph class="fontsize10" id="y3ad6a454-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>such other Federal officers and employees (or their designees) as may be appointed by the President.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a455-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Chairperson</inline>.—</heading><content>The chairperson of the Task Force shall be the Assistant Secretary of the Administration for Children and Families of the Department of Health and Human Services.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a456-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>The Task Force shall consult with representatives from State child care agencies, State child protective services, State criminal justice agencies, providers of child care services, including providers in the private sector, and other relevant stakeholders on identifying problems in implementing, and proposing solutions to implement, the requirements of section 658H(b) of the Child Care and Development Block Grant Act of 1990, as described in that section. Such consultation shall include consultation with State agencies that are at different stages of such implementation.<page identifier="/us/stat/134/3377">134 STAT. 3377</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a457-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a458-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a459-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Task Force Duties</inline>.—</heading><chapeau>The Task Force shall—</chapeau><paragraph class="fontsize10" id="y3ad6a45a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>develop recommendations for improving implementation of the requirements of section 658H(b) of the Child Care and Development Block Grant Act of 1990, including recommendations about how the Task Force and member agencies will collaborate and coordinate efforts to implement such requirements, as described in that section; and</content></paragraph>
<paragraph class="fontsize10" id="y3ad6a45b-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>develop recommendations in which the Task Force identifies best practices and evaluates technical assistance to assist relevant Federal and State agencies in implementing section 658H(b) of the Child Care and Development Block Grant Act of 1990, which identification and evaluation shall include—</chapeau><subparagraph class="fontsize10" id="y3ad6a45c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a45d-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a45e-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>an analysis of available research and information at the Federal and State levels regarding the status of the interstate requirements of that section for child care staff members who have resided in one or more States during the previous 5 years and who seek employment in a child care program in a different State;</content></subparagraph>
<subparagraph class="fontsize10" id="y3ad6a45f-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a460-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote><content>a list of State agencies that are not responding to interstate requests covered by that section for relevant information on child care staff members;</content></subparagraph>
<subparagraph class="fontsize10" id="y3ad6a461-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>identification of the challenges State agencies are experiencing in responding to such interstate requests;</content></subparagraph>
<subparagraph class="fontsize10" id="y3ad6a462-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>an analysis of the length of time it takes the State agencies in a State to receive such results from State agencies in another State in response to such an interstate request, in accordance with that section;</content></subparagraph>
<subparagraph class="fontsize10" id="y3ad6a463-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a464-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote><content>an analysis of the average processing time for the interstate requests, in accordance with that section;</content></subparagraph>
<subparagraph class="fontsize10" id="y3ad6a465-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><chapeau>identification of any fees (and entities responsible for paying any such fees) associated with the interstate requests in each State to meet requirements, in accordance with section 658H of the Child Care and Development Block Grant Act of 1990 (<ref href="/us/usc/t42/s9858f">42 U.S.C. 9858f</ref>), including identification of—</chapeau><clause class="fontsize10" id="y3ad6a466-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/F/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the extent to which such fees are consistent with subsection (f) of that section; and</content></clause>
<clause class="fontsize10" id="y3ad6a467-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/F/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>information regarding factors that impact such fees;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y3ad6a468-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a469-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote><content>a list of States that are participating in the National Fingerprint File program, as administered by the Federal Bureau of Investigation, and an analysis of reasons States have or have not chosen to participate in the program, including barriers to participation such as barriers related to State regulatory requirements and statutes; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3ad6a46a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/e/2/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a46b-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote><content>a list of States that have closed record laws or systems that prevent the States from sharing complete criminal records data or information with State agencies in another State.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a46c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a46d-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><content>Not later than 3 months after the date of enactment of this Act, the Task Force shall hold its first meeting.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a46e-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Final Report</inline>.—</heading><content>Not later than 1 year after the first meeting of the Task Force, the Task Force shall submit to the Secretary of Health and Human Services, the Committee on Health, Education, Labor, and Pensions of the Senate, and the Committee on Education and Labor of the House of Representatives a final <page identifier="/us/stat/134/3378">134 STAT. 3378</page>
report containing all of the recommendations required by paragraphs (1) and (2) of subsection (e). <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3ad6a46f-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote>The report shall also include a list of the members of the Task Force, the agencies such members represent, and the individuals and entities with whom the Task Force consulted under subsection (d).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a470-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">No Compensation for Members</inline>.—</heading><content>A member of the Task Force shall serve without compensation in addition to any compensation received for the service of the member as an officer or employee of the United States.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a471-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/i" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">Exemption From FACA</inline>.—</heading><content>The Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) shall not apply to the Task Force.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3ad6a472-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/279/s2/j" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="j">(j) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>The Task Force shall terminate 1 year after submitting its final report under subsection (g).</content></subsection>
