<section id="d196873e88" identifier="/us/pl/116/278/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4eb57754-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s101">38 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Transparency and Effective Accountability Measures for Veteran Caregivers Act</shortTitle>” or the “<shortTitle role="act">TEAM Veteran Caregivers Act</shortTitle>”.</content></section>
<section id="d196873e106" identifier="/us/pl/116/278/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>MODIFICATION OF ADMINISTRATION OF CAREGIVER PROGRAMS OF DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="y4eb61395-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4eb61396-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s1720G">38 USC 1720G note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Formal Recognition of Caregivers</inline>.—</heading><paragraph class="fontsize10" id="y4eb61397-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><subparagraph class="fontsize10" id="y4eb61398-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 60 days after the date of the enactment of this Act, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report regarding the feasibility and advisability of formally recognizing all caregivers of veterans by identifying any caregiver of a veteran in the electronic health record of the veteran.</content></subparagraph>
<subparagraph class="fontsize10" id="y4eb61399-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Caregivers recognized</inline>.—</heading><chapeau>The recognition of caregivers described in subparagraph (A) shall include recognition of —</chapeau><clause class="fontsize10" id="y4eb6139a-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/a/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>any family caregiver who is approved as a provider of personal care services for an eligible veteran under the program of comprehensive assistance for family caregivers under subsection (a) of <ref href="/us/usc/t38/s1720G">section 1720G of title 38, United States Code</ref>; and</content></clause>
<clause class="fontsize10" id="y4eb6139b-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/a/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any caregiver of a covered veteran participating in the program of general caregiver support services under subsection (b) of such section.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y4eb6139c-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Timeline</inline>.—</heading><content>If the Secretary determines that formally recognizing all caregivers of veterans as described in subparagraph (A) is feasible and advisable, the report required by such subparagraph shall include a timeline for implementing such recognition.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y4eb6139d-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><content>If the Secretary determines that formally recognizing all caregivers of veterans as described in paragraph (1)(A) is feasible and advisable, the Secretary shall <page identifier="/us/stat/134/3374">134 STAT. 3374</page>
implement such recognition in accordance with the timeline included in the report required by such paragraph.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y4eb6139e-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/278/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Notifications, Extension of Benefits, and Discharge From Family Caregiver Program</inline>.—</heading><content><ref href="/us/usc/t38/s1720G/a">Section 1720G(a) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new paragraphs:<quotedContent><paragraph class="indentUp0 firstIndent0 fontsize10" id="y4eb661bf-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12)</num><subparagraph class="inline" id="y4eb661c0-e823-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><content>The Secretary shall notify the individuals described in subparagraph (C) regarding decisions affecting the furnishing of assistance under this subsection using standardized letters, as the Secretary determines such notifications and letters to be appropriate.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y4eb661c1-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4eb661c2-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><content>A notification provided under subparagraph (A) shall include the elements required for notices of decisions under section 5104(b) of this title to the extent that those elements apply to such notification, unless, not later than 60 days after the date of the enactment of the Transparency and Effective Accountability Measures for Veteran Caregivers Act, the Secretary determines that it would not be feasible to include such elements in such notifications and submits to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report setting forth the reasons for such determination.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y4eb661c3-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>The individuals described in this subparagraph shall include—</chapeau><clause class="fontsize10" id="y4eb661c4-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>an individual who submits an application for the program established under paragraph (1);</content></clause>
<clause class="fontsize10" id="y4eb661c5-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an individual determined by the Secretary to be an eligible veteran pursuant to such an application; and</content></clause>
<clause class="fontsize10" id="y4eb661c6-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>a family caregiver of an eligible veteran who is—</chapeau><subclause class="fontsize10" id="y4eb661c7-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>approved as a provider of personal care services under paragraph (6)(B); or</content></subclause>
<subclause class="fontsize10" id="y4eb661c8-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>designated as a primary provider of personal care services under paragraph (7)(A).</content></subclause>

</subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y4eb661c9-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">“(13)</num><subparagraph class="inline" id="y4eb661ca-e823-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><chapeau>If the Secretary determines that a veteran receiving services under the program established under paragraph (1) is no longer eligible for such program solely because of improvement in the condition of the veteran—</chapeau><clause class="fontsize10" id="y4eb688db-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4eb688dc-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><content>the effective date of discharge of the veteran from the program shall be not earlier than the date that is 60 days after the date on which the Secretary provides notice of such lack of eligibility under paragraph (12)(A) to the relevant individuals described in paragraph (12)(C); and</content></clause>
<clause class="fontsize10" id="y4eb688dd-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4eb688de-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>the Secretary shall extend benefits under the program established under paragraph (1) for a family caregiver of the veteran described in paragraph (12)(C)(iii), including stipends under paragraph (3)(A)(ii)(V), if such an extension is determined appropriate by the Secretary, for a 90-day period following discharge of the veteran from the program.</content></clause>
</subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y4eb688df-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>This paragraph shall not be construed to limit the authority of the Secretary—</chapeau><clause class="fontsize10" id="y4eb688e0-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>to prescribe regulations addressing other bases for—</chapeau><subclause class="fontsize10" id="y4eb688e1-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the discharge of a veteran from the program established under paragraph (1); or</content></subclause>
<subclause class="fontsize10" id="y4eb688e2-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the revocation of the designation of a family caregiver of a veteran as a primary provider of personal care services under paragraph (7)(A); or<page identifier="/us/stat/134/3375">134 STAT. 3375</page></content></subclause>
</clause>
<clause class="fontsize10" id="y4eb688e3-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to provide advance notice and extended benefits under the program, as appropriate, if another basis for discharge of a veteran described in subclause (I) of clause (i) or revocation of a designation described in subclause (II) of such clause applies.”</content></clause>
