<section id="d102473e100" identifier="/us/pl/116/277/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x508750da-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Missing Persons and Unidentified Remains Act of 2019</shortTitle>”.</content></section>
<section id="d102473e115" identifier="/us/pl/116/277/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>USE OF GRANT FUNDS.</heading><subsection class="firstIndent0 fontsize10" id="y5088624b-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Jennifer’s Law</inline>.—</heading><chapeau>Jennifer’s Law (<ref href="/us/usc/t34/s40501/etseq">34 U.S.C. 40501 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y5088624c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> section 202 (<ref href="/us/usc/t34/s40501">34 U.S.C. 40501</ref>) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><section class="centered fontsize12" id="y5088d77d-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="202">“SEC. 202. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5088d77e-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s40501">34 USC 40501</ref>.</p></sidenote><heading class="fontsize12">PROGRAM AUTHORIZED.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y5088d77f-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><paragraph class="fontsize10" id="y5088d780-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Grants authorized</inline>.—</heading><content>The Attorney General may award grants to eligible entities described in paragraph (2) to enable the eligible entities to improve the transportation, processing, identification, and reporting of missing persons and unidentified remains, including migrants.</content></paragraph>
<paragraph class="fontsize10" id="y5088d781-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Eligible entities</inline>.—</heading><chapeau>Eligible entities described in this paragraph are the following:</chapeau><subparagraph class="fontsize10" id="y5088d782-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>States and units of local government.</content></subparagraph>
<subparagraph class="fontsize10" id="y5088d783-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Accredited, publicly funded, Combined DNA Index System (commonly known as ‘CODIS’) forensic laboratories, which demonstrate the grant funds will be used for DNA typing and uploading biological family DNA reference samples, including samples from foreign nationals, into CODIS, subject to the protocols for inclusion of such forensic DNA profiles into CODIS, and the privacy protections required under section 203(c).</content></subparagraph>
<subparagraph class="fontsize10" id="y5088d784-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Medical examiners offices.</content></subparagraph>
<subparagraph class="fontsize10" id="y5088d785-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>Accredited, publicly funded toxicology laboratories.</content></subparagraph>
<subparagraph class="fontsize10" id="y5088d786-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>Accredited, publicly funded crime laboratories.</content></subparagraph>
<subparagraph class="fontsize10" id="y5088d787-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>Publicly funded university forensic anthropology laboratories.</content></subparagraph>
<subparagraph class="fontsize10" id="y5088d788-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>Nonprofit organizations that have working collaborative agreements with State and county forensic offices, including medical examiners, coroners, and justices of the peace, for entry of data into CODIS or the National Missing <page identifier="/us/stat/134/3369">134 STAT. 3369</page>
and Unidentified Persons System (commonly known as ‘NamUs’), or both.”</content></subparagraph>
</paragraph>
</subsection>
</section>

<paragraph class="fontsize10" id="y5088d789-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in section 203 (<ref href="/us/usc/t34/s40502">34 U.S.C. 40502</ref>)—</chapeau><subparagraph class="fontsize10" id="y5088d78a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>a State</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>an entity described in section 202</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y5088d78b-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>in subsection (b)—</chapeau><clause class="fontsize10" id="y5088d78c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in the matter preceding paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>State</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>applicant</quotedText>”;</content></clause>
<clause class="fontsize10" id="y5088d78d-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (1) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentDown2 fontsize10" id="y5088fe9e-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5088fe9f-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><content>report to the National Crime Information Center and, when possible, to law enforcement authorities throughout the applicant’s jurisdiction regarding every deceased unidentified person, regardless of age, found in the applicant’s jurisdiction;”</content></paragraph>

<clause class="fontsize10" id="y5088fea0-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/2/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></clause>

</subparagraph>
<subparagraph class="fontsize10" id="y5088fea5-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="y508925b6-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Privacy Protections for Biological Family Reference Samples</inline>.—</heading><paragraph class="fontsize10" id="y508925b7-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Any suspected biological family DNA reference samples received from citizens of the United States or foreign nationals and uploaded into the Combined DNA Index System (commonly referred to as ‘CODIS’) by an accredited, publicly funded CODIS forensic laboratory awarded a grant under this section may be used only for identifying missing persons and unidentified remains.</content></paragraph>
<paragraph class="fontsize10" id="y508925b8-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on use</inline>.—</heading><content>Any biological family DNA reference samples from citizens of the United States or foreign nationals entered into CODIS for purposes of identifying missing persons and unidentified remains may not be disclosed to a Federal or State law enforcement agency for law enforcement purposes.”</content></paragraph>
</subsection>

<paragraph class="fontsize10" id="y508925b9-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="delete">striking</amendingAction> section 204 (<ref href="/us/usc/t34/s40503">34 U.S.C. 40503</ref>) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><section class="centered fontsize12" id="y508973da-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="205">“SEC. 205. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x508973db-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s40503">34 USC 40503</ref>.</p></sidenote><heading class="fontsize12">USE OF FUNDS.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “An applicant receiving a grant award under this title may use such funds to—</chapeau><paragraph class="indentUp0 fontsize10" id="y508973dc-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>pay for the costs incurred during or after fiscal year 2017 for the transportation, processing, identification, and reporting of missing persons and unidentified remains, including migrants;</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y508973dd-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>establish and expand programs developed to improve the reporting of unidentified persons in accordance with the assurances provided in the application submitted pursuant to section 203(b);</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y508973de-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>hire and maintain additional DNA case analysts and technicians, fingerprint examiners, forensic odontologists, and forensic anthropologists, needed to support such identification programs; and<page identifier="/us/stat/134/3370">134 STAT. 3370</page></content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y508973df-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>procure and maintain state of the art multi-modal, multi-purpose forensic and DNA-typing and analytical equipment.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y508973e0-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Kristen’s Act</inline>.—</heading><content>Section 102 of Kristen’s Act (<ref href="/us/usc/t34/s40504">34 U.S.C. 40504 note</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="y508973e1-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="102">“SEC. 102. </num><heading class="fontsize12">AUTHORIZATION OF FUNDING.</heading><content class="indentUp0 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “To the extent provided in advance in appropriations Acts, the Attorney General is authorized to use funds appropriated for the operationalization, maintenance, and expansion of the National Missing and Unidentified Persons System (NamUs) for the purpose of carrying out this Act”</content></section>

<section id="d102473e446" identifier="/us/pl/116/277/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>RESCUE BEACONS.</heading><content class="firstIndent0 fontsize10" id="x50899af2-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 411(o) of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s211/o">6 U.S.C. 211(o)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="fontsize10" id="y50899af3-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Rescue beacons</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x50899af4-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote>—</heading><content>Beginning in fiscal year 2019, in carrying out subsection (c)(8), the Commissioner shall purchase, deploy, and maintain not more than 170 self-powering, 9–1–1 cellular relay rescue beacons along the southern border of the United States at locations determined appropriate by the Commissioner to mitigate migrant deaths.”</content></paragraph>

<section id="d102473e479" identifier="/us/pl/116/277/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x50899af5-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s40505">34 USC 40505</ref>.</p></sidenote><heading>REPORTING ON NATIONAL MISSING AND UNIDENTIFIED PERSONS SYSTEM (NAMUS) PROGRAM.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x508a1026-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not later than 18 months after the date of enactment of this act, and every year thereafter, the Attorney General shall submit a report to the appropriate committees of Congress regarding—</chapeau><paragraph class="fontsize10" id="y508a1027-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the number of unidentified person cases processed;</content></paragraph>
<paragraph class="fontsize10" id="y508a1028-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>CODIS associations and identifications;</content></paragraph>
<paragraph class="fontsize10" id="y508a1029-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s4/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the number of anthropology cases processed;</content></paragraph>
<paragraph class="fontsize10" id="y508a102a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s4/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the number of suspected border crossing cases and associations made;</content></paragraph>
<paragraph class="fontsize10" id="y508a102b-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s4/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the number of trials supported with expert testimony;</content></paragraph>
<paragraph class="fontsize10" id="y508a102c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s4/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>the number of students trained and professions of those students; and</content></paragraph>
<paragraph class="fontsize10" id="y508a102d-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s4/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>the turnaround time and backlog.</content></paragraph>

<section id="d102473e527" identifier="/us/pl/116/277/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x508a102e-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s224">6 USC 224</ref>.</p></sidenote><heading>OTHER REPORTING REQUIREMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y508be4ef-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Unidentified Remains</inline>.—</heading><paragraph class="fontsize10" id="y508be4f0-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Reporting requirement</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Commissioner of U.S. Customs and Border Protection shall submit a report to the appropriate committees of Congress regarding all unidentified remains discovered, during the reporting period, on or near the border between the United States and Mexico, including—</chapeau><subparagraph class="fontsize10" id="y508be4f1-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>for each deceased person—</chapeau><clause class="fontsize10" id="y508be4f2-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the cause and manner of death, if known;</content></clause>
<clause class="fontsize10" id="y508be4f3-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the sex, age (at time of death), and country of origin (if such information is determinable); and</content></clause>
<clause class="fontsize10" id="y508be4f4-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the location of each unidentified remain;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y508be4f5-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the total number of deceased people whose unidentified remains were discovered by U.S. Customs and Border Protection during the reporting period;</content></subparagraph>
<subparagraph class="fontsize10" id="y508be4f6-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>to the extent such information is available to U.S. Customs and Border Protection, the total number of <page identifier="/us/stat/134/3371">134 STAT. 3371</page>
deceased people whose unidentified remains were discovered by Federal, State, local or Tribal law enforcement officers, military personnel, or medical examiners offices;</content></subparagraph>
<subparagraph class="fontsize10" id="y508be4f7-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>the efforts of U.S. Customs and Border Protection to engage with nongovernmental organizations, institutions of higher education, medical examiners and coroners, and law enforcement agencies—</chapeau><clause class="fontsize10" id="y508be4f8-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>to identify and map the locations at which migrant deaths occur; and</content></clause>
<clause class="fontsize10" id="y508be4f9-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>to count the number of deaths that occur at such locations; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y508be4fa-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>a detailed description of U.S. Customs and Border Protection’s Missing Migrant Program, including how the program helps mitigate migrant deaths while maintaining border security.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y508be4fb-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x508be4fc-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Public disclosure</inline>.—</heading><content>Not later than 30 days after each report required under paragraph (1) is submitted, the Commissioner of U.S. Customs and Border Protection shall publish on the website of the agency the information described in subparagraphs (A), (B), and (C) of paragraph (1) during each reporting period.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y508be4fd-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x508be4fe-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Mexico.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rescue Beacons</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Commissioner of U.S. Customs and Border Protection shall submit a report to the appropriate committees of Congress regarding the use of rescue beacons along the border between the United States and Mexico, including, for the reporting period—</chapeau><paragraph class="fontsize10" id="y508be4ff-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the number of rescue beacons in each border patrol sector;</content></paragraph>
<paragraph class="fontsize10" id="y508be500-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the specific location of each rescue beacon;</content></paragraph>
<paragraph class="fontsize10" id="y508be501-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the frequency with which each rescue beacon was activated by a person in distress;</content></paragraph>
<paragraph class="fontsize10" id="y508be502-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>a description of the nature of the distress that resulted in each rescue beacon activation (if such information is determinable); and</content></paragraph>
<paragraph class="fontsize10" id="y508be503-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x508be504-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p><p class="leftAlign firstIndent0 fontsize8" id="x508be505-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>an assessment, in consultation with local stakeholders, including elected officials, nongovernmental organizations, and landowners, of necessary additional rescue beacons and recommendations for locations for deployment to reduce migrant deaths.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y508be506-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">GAO Report</inline>.—</heading><chapeau>Not later than 6 months after the report required under subsection (a) is submitted to the appropriate committees of Congress, the Comptroller General of the United States shall submit a report to the same committees that describes—</chapeau><paragraph class="fontsize10" id="y508be507-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>how U.S. Customs and Border Protection collects and records border-crossing death data;</content></paragraph>
<paragraph class="fontsize10" id="y508be508-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the differences (if any) in U.S. Customs and Border Protection border-crossing death data collection methodology across its sectors;</content></paragraph>
<paragraph class="fontsize10" id="y508be509-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>how U.S. Customs and Border Protection’s data and statistical analysis on trends in the numbers, locations, causes, and characteristics of border-crossing deaths compare to other sources of data on these deaths, including border county medical examiners and coroners and the Centers for Disease Control and Prevention;<page identifier="/us/stat/134/3372">134 STAT. 3372</page></content></paragraph>
<paragraph class="fontsize10" id="y508be50a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>how U.S. Customs and Border Protection measures the effectiveness of its programs to mitigate migrant deaths; and</content></paragraph>
<paragraph class="fontsize10" id="y508be50b-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>the extent to which U.S. Customs and Border Protection engages Federal, State, local, and Tribal governments, foreign diplomatic and consular posts, and nongovernmental organizations—</chapeau><subparagraph class="fontsize10" id="y508be50c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to accurately identify deceased individuals;</content></subparagraph>
<subparagraph class="fontsize10" id="y508be50d-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to resolve cases involving unidentified remains;</content></subparagraph>
<subparagraph class="fontsize10" id="y508be50e-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>to resolve cases involving unidentified persons; and</content></subparagraph>
<subparagraph class="fontsize10" id="y508be50f-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/277/s5/c/5/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>to share information on missing persons and unidentified remains, specifically with the National Missing and Unidentified Persons System (NamUs).</content></subparagraph>
