<section id="d197096e92" identifier="/us/pl/116/274/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Great Lakes Environmental Sensitivity Index Act of 2020</shortTitle>”.</content></section>
<section id="d197096e102" identifier="/us/pl/116/274/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>UPDATE TO ENVIRONMENTAL SENSITIVITY INDEX PRODUCTS OF NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION FOR GREAT LAKES.</heading><subsection class="firstIndent0 fontsize10" id="y67b74a04-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Update Required for Environmental Sensitivity Index Products for Great Lakes</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Under Secretary for Oceans and Atmosphere shall commence updating the environmental sensitivity index products of the National Oceanic and Atmospheric Administration for each coastal area of the Great Lakes.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y67b74a05-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Periodic Updates for Environmental Sensitivity Index Products Generally</inline>.—</heading><chapeau>Subject to the availability of appropriations and the priorities set forth in subsection (c), the Under Secretary shall—</chapeau><paragraph class="fontsize10" id="y67b74a06-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>periodically update the environmental sensitivity index products of the Administration; and</content></paragraph>
<paragraph class="fontsize10" id="y67b74a07-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x67b74a08-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>endeavor to do so not less frequently than once every 7 years.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y67b74a09-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Priorities</inline>.—</heading><chapeau>When prioritizing geographic areas to update environmental sensitivity index products, the Under Secretary shall consider—</chapeau><paragraph class="fontsize10" id="y67b74a0a-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the age of existing environmental sensitivity index products for the areas;</content></paragraph>
<paragraph class="fontsize10" id="y67b74a0b-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the occurrence of extreme events, be it natural or man-made, which have significantly altered the shoreline or ecosystem since the last update;</content></paragraph>
<paragraph class="fontsize10" id="y67b74a0c-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the natural variability of shoreline and coastal environment; and</content></paragraph>
<paragraph class="fontsize10" id="y67b74a0d-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the volume of vessel traffic and general vulnerability to spilled pollutants.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y67b74a0e-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/d" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Environmental Sensitivity Index Product Defined</inline>.—</heading><content>In this section, the term “<term>environmental sensitivity index product</term>” means a map or similar tool that is utilized to identify sensitive shoreline, coastal or offshore, resources prior to an oil spill event <page identifier="/us/stat/134/3357">134 STAT. 3357</page>
in order to set baseline priorities for protection and plan cleanup strategies, typically including information relating to shoreline type, biological resources, and human use resources.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y67b74a0f-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/274/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Funding</inline>.—</heading><content>Funds to carry out the activities under this section shall be derived from amounts authorized to be appropriated for the Under Secretary that are enacted after the date of the enactment of this Act.</content></subsection>
