<section id="d102715e98" identifier="/us/pl/116/273/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f8f3236-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s201">42 USC 201 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Scarlett’s Sunshine on Sudden Unexpected Death Act</shortTitle>”.</content></section>
<section id="d102715e113" identifier="/us/pl/116/273/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AMENDMENT TO THE PUBLIC HEALTH SERVICE ACT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6f8fa767-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Part B of title XI of the Public Health Service Act (<ref href="/us/usc/t42/s241/etseq">42 U.S.C. 241 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y6f8fa768-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the part heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText>sudden infant death syndrome</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>sudden unexpected infant death, sudden infant death syndrome, and sudden unexpected death in childhood</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y6f8fa769-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> before section 1122 the following:<quotedContent><section class="indentUp1 firstIndent-2" id="y6f9043aa-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="1121">“SEC. 1121. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f9043ab-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s300c–11">42 USC 300c–11</ref>.</p></sidenote><heading class="bold">ADDRESSING SUDDEN UNEXPECTED INFANT DEATH AND SUDDEN UNEXPECTED DEATH IN CHILDHOOD.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y6f9043ac-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Secretary may develop, support, or maintain programs or activities to address sudden unexpected infant death and sudden unexpected death in childhood, including by—</chapeau><paragraph class="fontsize10" id="y6f9043ad-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>continuing to support the Sudden Unexpected Infant Death and Sudden Death in the Young Case Registry of the Centers for Disease Control and Prevention and other fatality case reporting systems that include data pertaining to sudden unexpected infant death and sudden unexpected death in childhood, as appropriate, including such systems supported by the Health Resources and Services Administration, in order to—</chapeau><subparagraph class="fontsize10" id="y6f9043ae-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>increase the number of States and jurisdictions participating in such registries or systems; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6f9043af-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>improve the utility of such registries or systems, which may include—</chapeau><clause class="fontsize10" id="y6f9043b0-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>making summary data available to the public in a timely manner on the internet website of the Department of Health and Human Services, in a manner that, at a minimum, protects personal privacy to the extent required by applicable Federal and State law; and</content></clause>
<clause class="fontsize10" id="y6f9043b1-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>making the data submitted to such registries or systems available to researchers, in a manner that, <page identifier="/us/stat/134/3353">134 STAT. 3353</page>
at a minimum, protects personal privacy to the extent required by applicable Federal and State law; and</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6f9043b2-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f9043b3-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Grants.</p></sidenote><chapeau>awarding grants or cooperative agreements to States, Indian Tribes, and Tribal organizations for purposes of—</chapeau><subparagraph class="fontsize10" id="y6f9043b4-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>supporting fetal and infant mortality and child death review programs for sudden unexpected infant death and sudden unexpected death in childhood, including by establishing such programs at the local level;</content></subparagraph>
<subparagraph class="fontsize10" id="y6f9043b5-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>improving data collection related to sudden unexpected infant death and sudden unexpected death in childhood, including by—</chapeau><clause class="fontsize10" id="y6f9043b6-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>improving the completion of death scene investigations and comprehensive autopsies that include a review of clinical history and circumstances of death with appropriate ancillary testing; and</content></clause>
<clause class="fontsize10" id="y6f9043b7-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>training medical examiners, coroners, death scene investigators, law enforcement personnel, emergency medical technicians, paramedics, emergency department personnel, and others who perform death scene investigations with respect to the deaths of infants and children, as appropriate;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y6f9043b8-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>identifying, developing, and implementing best practices to reduce or prevent sudden unexpected infant death and sudden unexpected death in childhood, including practices to reduce sleep-related infant deaths;</content></subparagraph>
<subparagraph class="fontsize10" id="y6f9043b9-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>increasing the voluntary inclusion, in registries established for the purpose of conducting research on sudden unexpected infant death and sudden unexpected death in childhood, of samples of tissues or genetic materials from autopsies that have been collected pursuant to Federal or State law and for which the parent or guardian has provided informed consent for inclusion in such registries;</content></subparagraph>
<subparagraph class="fontsize10" id="y6f9069ca-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>disseminating information and materials to health care professionals and the public on risk factors that contribute to sudden unexpected infant death and sudden unexpected death in childhood, which may include information on risk factors that contribute to sleep-related sudden unexpected infant death or sudden unexpected death in childhood; or</content></subparagraph>
<subparagraph class="fontsize10" id="y6f9069cb-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>providing information, referrals, or peer or follow-up support services to families who have experienced sudden unexpected infant death or sudden unexpected death in childhood.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y6f9069cc-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f9069cd-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Application</inline>.—</heading><content>To be eligible to receive a grant or cooperative agreement under subsection (a)(2), a State, Indian Tribe, or Tribal organization shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including information on how such State will ensure activities conducted under this section are coordinated with other federally-funded programs to reduce infant and child mortality, as appropriate.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y6f9069ce-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Technical Assistance</inline>.—</heading><content>The Secretary shall provide technical assistance to States, Tribes, and Tribal organizations receiving a grant or cooperative agreement under subsection (a)(2) for purposes of carrying out the program in accordance with this section.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y6f9069cf-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Reporting Forms</inline>.—</heading><page identifier="/us/stat/134/3354">134 STAT. 3354</page>
<paragraph class="fontsize10" id="y6f9069d0-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall, as appropriate, encourage the use of sudden unexpected infant death and sudden unexpected death in childhood reporting forms developed in collaboration with the Centers for Disease Control and Prevention to improve the quality of data submitted to the Sudden Unexpected Infant Death and Sudden Death in the Young Case Registry, and other fatality case reporting systems that include data pertaining to sudden unexpected infant death and sudden unexpected death in childhood.</content></paragraph>
<paragraph class="fontsize10" id="y6f9069d1-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f9069d2-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Update of forms</inline>.—</heading><content>The Secretary shall assess whether updates are needed to the sudden unexpected infant death investigation reporting form used by the Centers for Disease Control and Prevention in order to improve the use of such form with other fatality case reporting systems supported by the Department of Health and Human Services, and shall make such updates as appropriate.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y6f9069d3-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y6f9069d4-e823-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Sudden infant death syndrome</inline>.—</heading><content>The term ‘<term>sudden infant death syndrome</term>’ means a sudden unexpected infant death that remains unexplained after a thorough case investigation.</content></paragraph>
<paragraph class="fontsize10" id="y6f9069d5-e823-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Sudden unexpected infant death</inline>.—</heading><content>The term ‘<term>sudden unexpected infant death</term>’ means the sudden death of an infant under 1 year of age that when first discovered did not have an obvious cause. Such term includes such deaths that are explained, as well as deaths that remain unexplained (which are known as sudden infant death syndrome).</content></paragraph>
<paragraph class="fontsize10" id="y6f9069d6-e823-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Sudden unexpected death in childhood</inline>.—</heading><content>The term ‘<term>sudden unexpected death in childhood</term>’ means the sudden death of a child who is at least 1 year of age but not more than 17 years of age that, when first discovered, did not have an obvious cause. Such term includes such deaths that are explained, as well as deaths that remain unexplained (which are known as sudden unexplained death in childhood).</content></paragraph>
<paragraph class="fontsize10" id="y6f9069d7-e823-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Sudden unexplained death in childhood</inline>.—</heading><content>The term ‘<term>sudden unexplained death in childhood</term>’ means a sudden unexpected death in childhood that remains unexplained after a thorough case investigation.</content></paragraph>

<subsection class="indentDown2 firstIndent0 fontsize10" id="y6f9069d8-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>For the purpose of carrying out this section, there is authorized to be appropriated $12,000,000 for each of fiscal years 2022 through 2026.”</content></subsection>

<section id="d102715e355" identifier="/us/pl/116/273/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f9069d9-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s300c–14">42 USC 300c–14</ref>.</p></sidenote><heading>REPORT TO CONGRESS.</heading><subsection class="firstIndent0 fontsize10" id="y6f90b7fa-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than 2 years after the date of enactment of this Act and biennially thereafter, the Secretary of Health and Human Services shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that contains, with respect to the reporting period—</chapeau><paragraph class="fontsize10" id="y6f90b7fb-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>information regarding the incidence and number of sudden unexpected infant death and sudden unexpected death in childhood (including the number of such infant and child deaths that remain unexplained after investigation), including, to the extent practicable—</chapeau><subparagraph class="fontsize10" id="y6f90b7fc-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s3/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f90b7fd-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Summary.</p></sidenote><content>a summary of such information by racial and ethnic group, and by State;<page identifier="/us/stat/134/3355">134 STAT. 3355</page></content></subparagraph>
<subparagraph class="fontsize10" id="y6f90b7fe-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>aggregate information obtained from death scene investigations and autopsies; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6f90b7ff-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s3/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f90b800-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x6f90b801-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>recommendations for reducing the incidence of sudden unexpected infant death and sudden unexpected death in childhood;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6f90b802-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6f90b803-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>an assessment of the extent to which various approaches of reducing and preventing sudden unexpected infant death and sudden unexpected death in childhood have been effective; and</content></paragraph>
<paragraph class="fontsize10" id="y6f90b804-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>a description of the activities carried out under section 1121 of the Public Health Service Act (as added by section 2).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6f90b805-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/273/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><content>In this section, the terms “sudden unexpected infant death” and “sudden unexpected death in childhood” have the meanings given such terms in section 1121 of the Public Health Service Act (as added by section 2).</content></subsection>
