<section id="d197264e92" identifier="/us/pl/116/272/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Federal Advance Contracts Enhancement Act</shortTitle>” or the “<shortTitle role="act">FACE Act</shortTitle>”.</content></section>
<section id="d197264e105" identifier="/us/pl/116/272/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x778c0617-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s791">6 USC 791 note</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x778c2d28-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Congress finds that—</chapeau><paragraph class="fontsize10" id="y778c2d29-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/272/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Post-Katrina Emergency Management and Reform Act of 2006 (<ref href="/us/pl/109/925">Public Law 109–925</ref>; <ref href="/us/stat/120/1394">120 Stat. 1394</ref>) required the Federal Emergency Management Agency to establish advance contracts, which are established prior to disasters and are typically needed to quickly provide life-sustaining goods and services in the immediate aftermath of a disaster;</content></paragraph>
<paragraph class="fontsize10" id="y778c2d2a-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/272/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the catastrophic hurricanes and wildfires in the United States in 2017 highlighted the importance of these advance contracts in disaster response;</content></paragraph>
<paragraph class="fontsize10" id="y778c2d2b-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/272/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in a report issued by the Government Accountability Office entitled “2017 Disaster Contracting: Action Needed to Better Ensure More Effective Use and Management of Advance Contracts”, the Government Accountability Office identified a number of challenges with advance contracts and recommended actions to improve management by the Federal Emergency Management Agency of these contracts for future disasters; and</content></paragraph>
<paragraph class="fontsize10" id="y778c2d2c-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/272/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>section 691 of the Post-Katrina Emergency Management Reform Act of 2006 (<ref href="/us/usc/t6/s791">6 U.S.C. 791</ref>) should be amended to incorporate the recommendations made by the report described in paragraph (3) to ensure more effective use and management of advance contracts.</content></paragraph>
</section>
<section id="d197264e148" identifier="/us/pl/116/272/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>FEDERAL EMERGENCY MANAGEMENT AGENCY ADVANCE CONTRACTS.</heading><subsection class="firstIndent0 fontsize10" id="y778c7b4d-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/272/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 691 of the Post-Katrina Emergency Management Reform Act of 2006 (<ref href="/us/usc/t6/s791">6 U.S.C. 791</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y778cf07e-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Updated Report</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this subsection, the Administrator shall submit to the appropriate committees of Congress an updated report that contains—<page identifier="/us/stat/134/3350">134 STAT. 3350</page></chapeau><paragraph class="fontsize10" id="y778cf07f-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the information required in the initial report under subparagraphs (A) and (B) of subsection (a)(1); and</content></paragraph>
<paragraph class="fontsize10" id="y778cf080-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x778cf081-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Strategy.</p></sidenote><chapeau>an updated strategy described in subsection (a)(1)(C) that clearly defines—</chapeau><subparagraph class="fontsize10" id="y778cf082-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the objectives of advance contracts;</content></subparagraph>
<subparagraph class="fontsize10" id="y778cf083-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>how advance contracts contribute to disaster response operations of the Agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y778cf084-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>how to maximize the award of advance contracts to small business concerns, as defined in section 3 of the Small Business Act (<ref href="/us/usc/t15/s632">15 U.S.C. 632</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="y778cf085-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>whether and how advance contracts should be prioritized in relation to new post-disaster contract awards.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y778cf086-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x778cf087-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional Duties of the Administrator</inline>.—</heading><paragraph class="fontsize10" id="y778cf088-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Head of contracting</inline>.—</heading><chapeau>The Administrator shall ensure that the head of contracting activity of the Agency—</chapeau><subparagraph class="fontsize10" id="y778cf089-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>not later than 270 days after the date of enactment of this subsection, updates the Disaster Contracting Desk Guide of the Agency to provide specific guidance—</chapeau><clause class="fontsize10" id="y778cf08a-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>on whether and under what circumstances contracting officers should consider using existing advance contracts entered into in accordance with this section prior to making new post-disaster contract awards, and include this guidance in existing semi-annual training given to contracting officers; and</content></clause>
<clause class="fontsize10" id="y778cf08b-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>for contracting officers to perform outreach to State and local governments on the potential benefits of establishing their own pre-negotiated advance contracts;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y778cf08c-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x778cf08d-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Records.</p></sidenote><content>adheres to hard copy contract file management requirements in effect to ensure that the files relating to advance contracts entered into in accordance with this section are complete and up to date, whether the files will be transferred into the Electronic Contract Filing System of the Agency or remain in hard copy format;</content></subparagraph>
<subparagraph class="fontsize10" id="y778cf08e-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x778cf08f-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p><p class="leftAlign firstIndent0 fontsize8" id="x778cf090-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>notifies contracting officers of the 3-day time frame requirement for entering completed award documentation into the contract writing system of the Agency when executing notice to proceed documentation;</content></subparagraph>
<subparagraph class="fontsize10" id="y778cf091-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>not later than 180 days after the date of enactment of this subsection, revises the reporting methodology of the Agency to ensure that all disaster contracts are included in each quarterly report submitted to the appropriate congressional committees under this section on disaster contract actions;</content></subparagraph>
<subparagraph class="fontsize10" id="y778cf092-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>identifies a single centralized resource listing advance contracts entered into under this section and ensures that source is current and up to date and includes all available advance contracts; and</content></subparagraph>
<subparagraph class="fontsize10" id="y778cf093-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>communicates complete and up-to-date information on available advance contracts to State and local governments to inform their advance contracting efforts.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y778cf094-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Master acquisition planning schedule</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this subsection, the Administrator shall update and implement guidance for program office and acquisition personnel of the Agency to—<page identifier="/us/stat/134/3351">134 STAT. 3351</page></chapeau><subparagraph class="fontsize10" id="y778cf095-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>identify acquisition planning time frames and considerations across the entire acquisition planning process of the Agency; and</content></subparagraph>
<subparagraph class="fontsize10" id="y778cf096-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>clearly communicate the purpose and use of a master acquisition planning schedule.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y778cf097-e823-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/272/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x778cf098-e823-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s791">6 USC 791 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>The Administrator of the Federal Emergency Management Agency shall regularly update the appropriate committees of Congress (as defined in section 602 of the Post-Katrina Emergency Management Reform Act of 2006 (<ref href="/us/usc/t6/s701">6 U.S.C. 701</ref>)) on the progress of the Federal Emergency Management Agency in implementing the recommendations of the Government Accountability Office in the report entitled “2017 Disaster Contracting: Action Needed to Better Ensure More Effective Use and Management of Advance Contracts”, as required under section 691 of the Post-Katrina Emergency Management Reform Act of 2006 (<ref href="/us/usc/t6/s791">6 U.S.C. 791</ref>), as amended by subsection (a).</content></subsection>
