<section id="d103191e92" identifier="/us/pl/116/270/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">HBCU Propelling Agency Relationships Towards a New Era of Results for Students Act</shortTitle>” or the “<shortTitle role="act">HBCU PARTNERS Act</shortTitle>”.</content></section>
<section id="d103191e105" identifier="/us/pl/116/270/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86cfa5ed-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t20/s1063d">20 USC 1063d note</ref>.</p></sidenote><heading>FINDINGS AND PURPOSES.</heading><subsection class="firstIndent0 fontsize10" id="y86d0422e-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds the following:</chapeau><paragraph class="fontsize10" id="y86d0422f-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>As many colleges and universities across the country kept their doors closed to African American applicants, historically Black colleges and universities (referred to in this section as “HBCUs”) played a central role in ensuring that African Americans could attain an excellent education.</content></paragraph>
<paragraph class="fontsize10" id="y86d04230-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Today, HBCUs continue to play a critical role in ensuring that African Americans, and those of all races, can access high-quality educational opportunities.</content></paragraph>
<paragraph class="fontsize10" id="y86d04231-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>HBCUs enroll nearly 300,000 students, an estimated 70 percent of whom come from low-income backgrounds and 80 percent of whom are African American.</content></paragraph>
<paragraph class="fontsize10" id="y86d04232-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>According to the National Association For Equal Opportunity In Higher Education (referred to in this section as “NAFEO”), HBCUs make up just 3 percent of American institutions of higher education but serve more than a fifth of African American college students.</content></paragraph>
<paragraph class="fontsize10" id="y86d04233-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>According to the Thurgood Marshall College Fund (referred to in this section as “TMCF”), approximately 9 percent of all African American college students attend HBCUs.</content></paragraph>
<paragraph class="fontsize10" id="y86d04234-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>A March 2017 report from the Education Trust concluded that HBCUs have higher completion rates for African American students than other institutions serving similar student populations.</content></paragraph>
<paragraph class="fontsize10" id="y86d04235-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>According to TMCF, 40 percent of African American Members of Congress, 50 percent of African American lawyers, and 80 percent of African American judges are graduates of HBCUs.</content></paragraph>
<paragraph class="fontsize10" id="y86d04236-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>According to NAFEO, HBCUs graduate approximately 50 percent of African American public school teaching professionals.<page identifier="/us/stat/134/3326">134 STAT. 3326</page></content></paragraph>
<paragraph class="fontsize10" id="y86d04237-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>According to the United Negro College Fund (referred to in this section as “UNCF”), African American graduates of HBCUs are almost twice as likely as African Americans who graduated from other institutions to report that their university prepared them well for life.</content></paragraph>
<paragraph class="fontsize10" id="y86d04238-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>According to a study commissioned by UNCF, in 2014, HBCUs generated a total direct economic impact of $14,800,000,000 and created more than 134,000 jobs.</content></paragraph>
<paragraph class="fontsize10" id="y86d04239-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/a/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>According to a 2019 report produced by the American Council on Education and UNCF, despite efforts to counter a historical legacy of inequitable funding and notable investments by the Federal Government and many State governments, resource inequities continue to plague HBCUs.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y86d0423a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Purposes</inline>.—</heading><chapeau>The purposes of this Act are—</chapeau><paragraph class="fontsize10" id="y86d0423b-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to strengthen the capacity and competitiveness of HBCUs to fulfill their principal mission of equalizing educational opportunity, as described in section 301(b) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1051/b">20 U.S.C. 1051(b)</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y86d0423c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to align HBCUs with the educational and economic competitiveness priorities of the United States;</content></paragraph>
<paragraph class="fontsize10" id="y86d0423d-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to provide students enrolled at HBCUs with the highest quality educational and economic opportunities;</content></paragraph>
<paragraph class="fontsize10" id="y86d0423e-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to bolster and facilitate productive interactions between HBCUs and Federal agencies; and</content></paragraph>
<paragraph class="fontsize10" id="y86d0423f-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s2/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>to encourage HBCU participation in and benefit from Federal programs, grants, contracts, and cooperative agreements.</content></paragraph>

<section id="d103191e223" identifier="/us/pl/116/270/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d06950-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t20/s1063d">20 USC 1063d note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x86d12ca1-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y86d12ca2-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Applicable agency</inline>.—</heading><chapeau>The term “<term>applicable agency</term>” means—</chapeau><subparagraph class="fontsize10" id="y86d12ca3-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Department of Agriculture;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12ca4-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Department of Commerce;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12ca5-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the Department of Defense;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12ca6-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the Department of Education;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12ca7-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>the Department of Energy;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12ca8-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>the Department of Health and Human Services;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12ca9-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>the Department of Homeland Security;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12caa-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>the Department of Housing and Urban Development;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cab-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the Department of the Interior;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cac-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/J" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">(J) </num><content>the Department of Justice;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cad-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/K" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="K">(K) </num><content>the Department of Labor;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cae-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/L" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="L">(L) </num><content>the Department of State;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12caf-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/M" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="M">(M) </num><content>the Department of Transportation;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cb0-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/N" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="N">(N) </num><content>the Department of Treasury;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cb1-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/O" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="O">(O) </num><content>the Department of Veterans Affairs;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cb2-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/P" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="P">(P) </num><content>the National Aeronautics and Space Administration;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cb3-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/Q" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="Q">(Q) </num><content>the National Oceanic and Atmospheric Administration;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cb4-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/R" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="R">(R) </num><content>the National Science Foundation;</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cb5-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/S" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="S">(S) </num><content>the Small Business Administration; and</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cb6-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/1/T" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="T">(T) </num><content>any other Federal agency designated as an applicable agency under section 4.<page identifier="/us/stat/134/3327">134 STAT. 3327</page></content></subparagraph>

<paragraph class="fontsize10" id="y86d12cb7-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Executive director</inline>.—</heading><chapeau>The term “<term>Executive Director</term>” means—</chapeau><subparagraph class="fontsize10" id="y86d12cb8-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Executive Director of the White House Initiative on Historically Black Colleges and Universities, as designated by the President; or</content></subparagraph>
<subparagraph class="fontsize10" id="y86d12cb9-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>if no such Executive Director is designated, such person as the President may designate to lead the White House Initiative on Historically Black Colleges and Universities.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y86d12cba-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">HBCU</inline>.—</heading><content>The term “<term>HBCU</term>” means a historically Black college or university.</content></paragraph>
<paragraph class="fontsize10" id="y86d12cbb-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Historically black college or university</inline>.—</heading><content>The term “<term>historically Black college or university</term>” has the meaning given the term “<term>part B institution</term>” under section 322 of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1061">20 U.S.C. 1061</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y86d12cbc-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">President’s board of advisors</inline>.—</heading><content>The term “<term>President’s Board of Advisors</term>” means the President’s Board of Advisors on historically Black colleges and universities.</content></paragraph>
<paragraph class="fontsize10" id="y86d12cbd-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>Except as otherwise provided, the term “<term>Secretary</term>” means the Secretary of Education.</content></paragraph>
<paragraph class="fontsize10" id="y86d12cbe-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s3/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">White house initiative</inline>.—</heading><content>The term “<term>White House Initiative</term>” means the White House Initiative on historically Black colleges and universities.</content></paragraph>

<section id="d103191e420" identifier="/us/pl/116/270/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d12cbf-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t20/s1063d">20 USC 1063d</ref>.</p></sidenote><heading>STRENGTHENING HBCUS THROUGH FEDERAL AGENCY PLANS.</heading><subsection class="firstIndent0 fontsize10" id="y86d1f010-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d1f011-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Designating Applicable Agencies</inline>.—</heading><chapeau>The Secretary, in consultation with the Executive Director, shall—</chapeau><paragraph class="fontsize10" id="y86d1f012-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>identify each Federal agency with which an HBCU—</chapeau><subparagraph class="fontsize10" id="y86d1f013-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>has entered into a grant, contract, or cooperative agreement; or</content></subparagraph>
<subparagraph class="fontsize10" id="y86d1f014-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is eligible to participate in the programs and initiatives under the jurisdiction of such Federal agency; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y86d1f015-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>designate each Federal agency so identified as an applicable agency.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y86d1f016-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d1f017-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Submitting Agency Plans</inline>.—</heading><content>Not later than February 1 of each year, the head of each applicable agency shall submit to the Secretary, the Executive Director, the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Education and Labor of the House of Representatives, and the President’s Board of Advisors an annual Agency Plan describing efforts to strengthen the capacity of HBCUs to participate or be eligible to participate in the programs and initiatives under the jurisdiction of such applicable agency as described in subsection (a)(1)(B).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y86d1f018-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Further Requirements for Submission and Accessibility</inline>.—</heading><content>The Executive Director shall make all annual Agency Plan submissions publicly available online in a user-friendly format.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y86d1f019-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Agency Plan Content</inline>.—</heading><chapeau>Where appropriate, each Agency Plan shall include—<sidenote><p>Public information.</p></sidenote><sidenote><p>Web posting.</p></sidenote></chapeau><paragraph class="fontsize10" id="y86d1f01a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a description of how the applicable agency intends to increase the capacity of HBCUs to compete effectively for grants, contracts, or cooperative agreements;</content></paragraph>
<paragraph class="fontsize10" id="y86d1f01b-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>an identification of Federal programs and initiatives under the jurisdiction of the applicable agency in which HBCUs are underrepresented;</content></paragraph>
<paragraph class="fontsize10" id="y86d1f01c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>an outline of proposed efforts to improve HBCUs’ participation in such programs and initiatives;<page identifier="/us/stat/134/3328">134 STAT. 3328</page></content></paragraph>
<paragraph class="fontsize10" id="y86d1f01d-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>a description of any progress made towards advancing or achieving goals and efforts from previous Agency Plans submitted under this section by such applicable agency;</content></paragraph>
<paragraph class="fontsize10" id="y86d1f01e-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>a description of how the applicable agency plans to encourage public-sector, private-sector, and community involvement to improve the capacity of HBCUs to compete effectively for grants, contracts, or cooperative agreements, and to participate in programs and initiatives under the jurisdiction of such agency;</content></paragraph>
<paragraph class="fontsize10" id="y86d1f01f-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>an identification of programs and initiatives not listed in a previous Agency Plan in which an HBCU may participate;</content></paragraph>
<paragraph class="fontsize10" id="y86d1f020-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>any other information the applicable agency determines is relevant to promoting opportunities to fund, partner, contract, or otherwise interact with HBCUs; and</content></paragraph>
<paragraph class="fontsize10" id="y86d1f021-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/d/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d1f022-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Criteria.</p></sidenote><content>any additional criteria established by the Secretary or the White House Initiative.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y86d1f023-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Agency Engagement</inline>.—</heading><chapeau>To help fulfill the objectives of the Agency Plans, the head of each applicable agency—</chapeau><paragraph class="fontsize10" id="y86d1f024-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>shall provide, as appropriate, technical assistance and information to the Executive Director to enhance communication with HBCUs concerning the applicable agency’s—</chapeau><subparagraph class="fontsize10" id="y86d1f025-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/e/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>programs and initiatives described in subsection (d)(2); and</content></subparagraph>
<subparagraph class="fontsize10" id="y86d1f026-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/e/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the preparation of applications or proposals for grants, contracts, or cooperative agreements; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y86d1f027-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s4/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>shall appoint a senior official to report directly to the agency head on the applicable agency’s progress under this section.</content></paragraph>

<section id="d103191e574" identifier="/us/pl/116/270/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d1f028-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t20/s1063e">20 USC 1063e</ref>.</p></sidenote><heading>PRESIDENT’S BOARD OF ADVISORS ON HBCUS.</heading><subsection class="firstIndent0 fontsize10" id="y86d2b379-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><paragraph class="fontsize10" id="y86d2b37a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d2b37b-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Establishment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>There is established the President’s Board of Advisors on historically Black colleges and universities in the Department of Education or, if the President so elects, within the Executive Office of the President.</content></paragraph>
<paragraph class="fontsize10" id="y86d2b37c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Funding from ed</inline>.—</heading><content>Except as provided in paragraph (3), the Secretary shall provide funding and administrative support for the President’s Board of Advisors, subject to the availability of appropriations.</content></paragraph>
<paragraph class="fontsize10" id="y86d2b37d-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Funding from the executive office of the president</inline>.—</heading><content>If the President elects to locate the President’s Board of Advisors within the Executive Office of the President, the Executive Office of the President shall provide funding and administrative support for the President’s Board of Advisors, subject to the availability of appropriations.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y86d2b37e-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><paragraph class="fontsize10" id="y86d2b37f-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The President shall appoint not more than 23 members to the President’s Board of Advisors, and the Secretary and Executive Director or their designees shall serve as ex officio members.</content></paragraph>
<paragraph class="fontsize10" id="y86d2b380-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Chair</inline>.—</heading><subparagraph class="fontsize10" id="y86d2b381-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Designation</inline>.—</heading><content>The President shall designate one member of the President’s Board of Advisors to serve as its Chair, who shall help direct the Board’s work in coordination with the Secretary and in consultation with the Executive Director.<page identifier="/us/stat/134/3329">134 STAT. 3329</page></content></subparagraph>
<subparagraph class="fontsize10" id="y86d2b382-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d2b383-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>The Chair shall also consult with the Executive Director regarding the time and location of meetings of the President’s Board of Advisors, which shall take place not less frequently than once every 6 months.</content></subparagraph>
<subparagraph class="fontsize10" id="y86d2b384-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x86d2b385-e823-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Guidelines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Performance</inline>.—</heading><content>Insofar as the Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) may apply to the President’s Board of Advisors, any functions of the President under such Act, except for those of reporting to the Congress, shall be performed by the Chair, in accordance with guidelines issued by the Administrator of General Services.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y86d2b386-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Compensation</inline>.—</heading><content>Members of the President’s Board of Advisors shall serve without compensation, but shall be reimbursed for travel expenses, including per diem in lieu of subsistence, as authorized by law.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y86d2b387-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Mission and Functions</inline>.—</heading><chapeau>The President’s Board of Advisors shall advise the President, through the White House Initiative, on all matters pertaining to strengthening the educational capacity of HBCUs, which shall include the following:</chapeau><paragraph class="fontsize10" id="y86d2b388-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Improving the identity, visibility, distinctive capabilities, and overall competitiveness of HBCUs.</content></paragraph>
<paragraph class="fontsize10" id="y86d2b389-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Engaging the philanthropic, business, government, military, homeland-security, and education communities in a national dialogue regarding new HBCU programs and initiatives.</content></paragraph>
<paragraph class="fontsize10" id="y86d2b38a-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Improving the ability of HBCUs to remain fiscally secure institutions that can assist the Nation in achieving its educational goals and in advancing the interests of all Americans.</content></paragraph>
<paragraph class="fontsize10" id="y86d2b38b-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Elevating the public awareness of, and fostering appreciation of, HBCUs.</content></paragraph>
<paragraph class="fontsize10" id="y86d2b38c-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Encouraging public-private investments in HBCUs.</content></paragraph>
<paragraph class="fontsize10" id="y86d2b38d-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/c/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Improving government-wide strategic planning related to HBCU competitiveness to align Federal resources and provide the context for decisions about HBCU partnerships, investments, performance goals, priorities, human capital development, and budget planning.<page identifier="/us/stat/134/3330">134 STAT. 3330</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y86d2b38e-e823-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/270/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>The President’s Board of Advisors shall report annually to the President on the Board’s progress in carrying out its duties under this section.</content></subsection>
