<section id="d104920e88" identifier="/us/pl/116/249/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a27df5e-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1">18 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Combat Online Predators Act</shortTitle>”.</content></section>
<section id="d104920e103" identifier="/us/pl/116/249/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ENHANCED PENALTY FOR STALKERS OF CHILDREN.</heading><subsection class="firstIndent0 fontsize10" id="y6a282d7f-e824-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/249/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Chapter 110A of <ref href="/us/usc/t18">title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 2261A the following:<quotedContent><section class="centered fontsize12" id="y6a282d80-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658165"><num class="fontsize12" value="2261B">“§ 2261B.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a282d81-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s2261B">18 USC 2261B</ref>.</p></sidenote> Enhanced penalty for stalkers of children</heading><subsection class="firstIndent0 fontsize10" id="y6a282d82-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Except as provided in subsection (b), if the victim of an offense under section 2261A is under the age of 18 years, the maximum imprisonment for the offense is 5 years greater than the maximum term of imprisonment otherwise provided for that offense in section 2261.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6a282d83-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><chapeau>Subsection (a) shall not apply to a person who violates section 2261A if—</chapeau><paragraph class="fontsize10" id="y6a282d84-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the person is subject to a sentence under section 2261(b)(5); and</content></paragraph>
<paragraph class="fontsize10" id="y6a282d85-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2)</num><subparagraph class="inline" id="y6a282d86-e824-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><content>the person is under the age of 18 at the time the offense occurred; or</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y6a282d87-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the victim of the offense is not less than 15 nor more than 17 years of age and not more than 3 years younger than the person who committed the offense at the time the offense occurred.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y6a282d88-e824-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/249/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Clerical Amendment</inline>.—</heading><content>The table of sections at the beginning of chapter 110A of <ref href="/us/usc/t18">title 18, United States Code</ref>, <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a282d89-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2261">22 USC 2261</ref> prec.<?GPOvSpace 04?></p></sidenote><amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after the item relating to section 2261A the following new item:<quotedContent><toc>

<subsection class="firstIndent0 fontsize10" id="y6a28549a-e824-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/249/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content><ref href="/us/usc/t18/s2261A">Section 2261A of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>section 2261(b) of this title</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>section 2261(b) or section 2261B, as the case may be</quotedText>”.</content></subsection>

<section id="d104920e234" identifier="/us/pl/116/249/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REPORT ON BEST PRACTICES REGARDING ENFORCEMENT OF ANTI-STALKING LAWS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6a28549b-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not later than 1 year after the date of the enactment of this Act, the Attorney General shall submit a report to Congress, which shall—<page identifier="/us/stat/134/1127">134 STAT. 1127</page></chapeau><paragraph class="fontsize10" id="y6a28549c-e824-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/249/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a28549d-e824-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>include an evaluation of Federal, Tribal, State, and local efforts to enforce laws relating to stalking; and</content></paragraph>
<paragraph class="fontsize10" id="y6a28549e-e824-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/249/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>identify and describe those elements of such efforts that constitute the best practices for the enforcement of such laws.</content></paragraph>
