<section id="d106462e88" identifier="/us/pl/116/223/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x913922e8-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1451">16 USC 1451 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Digital Coast Act</shortTitle>”.</content></section>
<section id="d106462e103" identifier="/us/pl/116/223/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x913922e9-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1467">16 USC 1467 note</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x9139981a-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress makes the following findings:</chapeau><paragraph class="fontsize10" id="y9139981b-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The Digital Coast is a model approach for effective Federal partnerships with State and local government, nongovernmental organizations, and the private sector.</content></paragraph>
<paragraph class="fontsize10" id="y9139981c-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Access to current, accurate, uniform, and standards-based geospatial information, tools, and training to characterize the United States coastal region is critical for public safety and for the environment, infrastructure, and economy of the United States.</content></paragraph>
<paragraph class="fontsize10" id="y9139981d-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>More than half of all people of the United States (153,000,000) currently live on or near a coast and an additional 12,000,000 are expected in the next decade.</content></paragraph>
<paragraph class="fontsize10" id="y9139981e-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Coastal counties in the United States average 300 persons per square mile, compared with the national average of 98.</content></paragraph>
<paragraph class="fontsize10" id="y9139981f-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>On a typical day, more than 1,540 permits for construction of single-family homes are issued in coastal counties, combined with other commercial, retail, and institutional construction to support this population.</content></paragraph>
<paragraph class="fontsize10" id="y91399820-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Over half of the economic productivity of the United States is located within coastal regions.</content></paragraph>
<paragraph class="fontsize10" id="y91399821-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><chapeau>Highly accurate, high-resolution remote sensing and other geospatial data play an increasingly important role in decision making and management of the coastal zone and economy, including for—</chapeau><subparagraph class="fontsize10" id="y91399822-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>flood and coastal storm surge prediction;</content></subparagraph>
<subparagraph class="fontsize10" id="y91399823-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>hazard risk and vulnerability assessment;</content></subparagraph>
<subparagraph class="fontsize10" id="y91399824-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/7/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>emergency response and recovery planning;</content></subparagraph>
<subparagraph class="fontsize10" id="y91399825-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/7/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>community resilience to longer range coastal change;</content></subparagraph>
<subparagraph class="fontsize10" id="y91399826-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/7/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>local planning and permitting;<page identifier="/us/stat/134/1068">134 STAT. 1068</page></content></subparagraph>
<subparagraph class="fontsize10" id="y91399827-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/7/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>habitat and ecosystem health assessments; and</content></subparagraph>
<subparagraph class="fontsize10" id="y91399828-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s2/7/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>landscape change detection.</content></subparagraph>

<section id="d106462e190" identifier="/us/pl/116/223/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9139bf39-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1467">16 USC 1467 note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x9139e64a-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y9139e64b-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Coastal region</inline>.—</heading><content>The term “<term>coastal region</term>” means the area of United States waters extending inland from the shoreline to include coastal watersheds and seaward to the territorial sea.</content></paragraph>
<paragraph class="fontsize10" id="y9139e64c-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Coastal state</inline>.—</heading><content>The term “<term>coastal State</term>” has the meaning given the term “<term>coastal state</term>” in section 304 of the Coastal Zone Management Act of 1972 (<ref href="/us/usc/t16/s1453">16 U.S.C. 1453</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y9139e64d-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Federal geographic data committee</inline>.—</heading><content>The term “<term>Federal Geographic Data Committee</term>” means the interagency committee that promotes the coordinated development, use, sharing, and dissemination of geospatial data on a national basis.</content></paragraph>
<paragraph class="fontsize10" id="y9139e64e-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s3/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Remote sensing and other geospatial</inline>.—</heading><content>The term “<term>remote sensing and other geospatial</term>” means collecting, storing, retrieving, or disseminating graphical or digital data depicting natural or manmade physical features, phenomena, or boundaries of the Earth and any information related thereto, including surveys, maps, charts, satellite and airborne remote sensing data, images, LiDAR, and services performed by professionals such as surveyors, photogrammetrists, hydrographers, geodesists, cartographers, and other such services.</content></paragraph>
<paragraph class="fontsize10" id="y9139e64f-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s3/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration.</content></paragraph>

<section id="d106462e253" identifier="/us/pl/116/223/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x913a0d60-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1467">16 USC 1467</ref>.</p></sidenote><heading>ESTABLISHMENT OF THE DIGITAL COAST.</heading><subsection class="firstIndent0 fontsize10" id="y913bbb11-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><paragraph class="fontsize10" id="y913bbb12-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall establish a program for the provision of an enabling platform that integrates geospatial data, decision-support tools, training, and best practices to address coastal management issues and needs. Under the program, the Secretary shall strive to enhance resilient communities, ecosystem values, and coastal economic growth and development by helping communities address their issues, needs, and challenges through cost-effective and participatory solutions.</content></paragraph>
<paragraph class="fontsize10" id="y913bbb13-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Designation</inline>.—</heading><content>The program established under paragraph (1) shall be known as the “Digital Coast” (in this section referred to as the “program”).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y913bbb14-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Program Requirements</inline>.—</heading><chapeau>In carrying out the program, the Secretary shall ensure that the program provides data integration, tool development, training, documentation, dissemination, and archive by—</chapeau><paragraph class="fontsize10" id="y913bbb15-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x913bbb16-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><content>making data and resulting integrated products developed under this section readily accessible via the Digital Coast internet website of the National Oceanic and Atmospheric Administration, the GeoPlatform.gov and data.gov internet websites, and such other information distribution technologies as the Secretary considers appropriate;</content></paragraph>
<paragraph class="fontsize10" id="y913bbb17-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>developing decision-support tools that use and display resulting integrated data and provide training on use of such tools;<page identifier="/us/stat/134/1069">134 STAT. 1069</page></content></paragraph>
<paragraph class="fontsize10" id="y913bbb18-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>documenting such data to Federal Geographic Data Committee standards; and</content></paragraph>
<paragraph class="fontsize10" id="y913be229-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>archiving all raw data acquired under this Act at the appropriate National Oceanic and Atmospheric Administration data center or such other Federal data center as the Secretary considers appropriate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y913be22a-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x913be22b-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><chapeau>The Secretary shall coordinate the activities carried out under the program to optimize data collection, sharing, and integration, and to minimize duplication by—</chapeau><paragraph class="fontsize10" id="y913be22c-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>consulting with coastal managers and decision makers concerning coastal issues, and sharing information and best practices, as the Secretary considers appropriate, with—</chapeau><subparagraph class="fontsize10" id="y913be22d-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>coastal States;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be22e-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>local governments; and</content></subparagraph>
<subparagraph class="fontsize10" id="y913be22f-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>representatives of academia, the private sector, and nongovernmental organizations;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y913be230-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>consulting with other Federal agencies, including interagency committees, on relevant Federal activities, including activities carried out under the Ocean and Coastal Mapping Integration Act (<ref href="/us/usc/t33/s3501/etseq">33 U.S.C. 3501 et seq.</ref>), the Coastal Zone Management Act of 1972 (<ref href="/us/usc/t16/s1451/etseq">16 U.S.C. 1451 et seq.</ref>), the Integrated Coastal and Ocean Observation System Act of 2009 (<ref href="/us/usc/t33/s3601/etseq">33 U.S.C. 3601 et seq.</ref>), and the Hydrographic Services Improvement Act of 1998 (<ref href="/us/usc/t33/s892/etseq">33 U.S.C. 892 et seq.</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y913be231-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>participating, pursuant to section 216 of the E-Government Act of 2002 (<ref href="/us/pl/107/347">Public Law 107–347</ref>; <ref href="/us/usc/t44/s3501">44 U.S.C. 3501 note</ref>), in the establishment of such standards and common protocols as the Secretary considers necessary to assure the interoperability of remote sensing and other geospatial data with all users of such information within—</chapeau><subparagraph class="fontsize10" id="y913be232-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the National Oceanic and Atmospheric Administration;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be233-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>other Federal agencies;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be234-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>State and local government; and</content></subparagraph>
<subparagraph class="fontsize10" id="y913be235-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the private sector;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y913be236-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>coordinating with, seeking assistance and cooperation of, and providing liaison to the Federal Geographic Data Committee pursuant to Office of Management and Budget Circular A–16 and Executive Order 12906 of April 11, 1994 (<ref href="/us/fr/59/17671">59 Fed. Reg. 17671</ref>), as amended by Executive Order 13286 of February 28, 2003 (<ref href="/us/fr/68/10619">68 Fed. Reg. 10619</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="y913be237-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>developing and maintaining a best practices document that sets out the best practices used by the Secretary in carrying out the program and providing such document to the United States Geological Survey, the Corps of Engineers, and other relevant Federal agencies.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y913be238-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Filling Needs and Gaps</inline>.—</heading><chapeau>In carrying out the program, the Secretary shall—</chapeau><paragraph class="fontsize10" id="y913be239-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>maximize the use of remote sensing and other geospatial data collection activities conducted for other purposes and under other authorities;</content></paragraph>
<paragraph class="fontsize10" id="y913be23a-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>focus on filling data needs and gaps for coastal management issues, including with respect to areas that, as of the date of the enactment of this Act, were underserved by coastal data and the areas of the Arctic that are under the jurisdiction of the United States;<page identifier="/us/stat/134/1070">134 STAT. 1070</page></content></paragraph>
<paragraph class="fontsize10" id="y913be23b-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>pursuant to the Ocean and Coastal Mapping Integration Act (<ref href="/us/usc/t33/s3501/etseq">33 U.S.C. 3501 et seq.</ref>), support continue improvement in existing efforts to coordinate the acquisition and integration of key data sets needed for coastal management and other purposes, including—</chapeau><subparagraph class="fontsize10" id="y913be23c-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>coastal elevation data;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be23d-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>land use and land cover data;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be23e-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>socioeconomic and human use data;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be23f-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>critical infrastructure data;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be240-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>structures data;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be241-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>living resources and habitat data;</content></subparagraph>
<subparagraph class="fontsize10" id="y913be242-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>cadastral data; and</content></subparagraph>
<subparagraph class="fontsize10" id="y913be243-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/3/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>aerial imagery; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y913be244-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>integrate the priority supporting data set forth under paragraph (3) with other available data for the benefit of the broadest measure of coastal resource management constituents and applications.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y913be245-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Financial Agreements and Contracts</inline>.—</heading><paragraph class="fontsize10" id="y913be246-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In carrying out the program, the Secretary—</chapeau><subparagraph class="fontsize10" id="y913be247-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>may enter into financial agreements to carry out the program, including—</chapeau><clause class="fontsize10" id="y913be248-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>support to non-Federal entities that participate in implementing the program; and</content></clause>
<clause class="fontsize10" id="y913be249-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>grants, cooperative agreements, interagency agreements, contracts, or any other agreement on a reimbursable or non-reimbursable basis, with other Federal, tribal, State, and local governmental and nongovernmental entities; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y913be24a-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x913be24b-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>may, to the maximum extent practicable, enter into such contracts with private sector entities for such products and services as the Secretary determines may be necessary to collect, process, and provide remote sensing and other geospatial data and products for purposes of the program.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y913be24c-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Fees</inline>.—</heading><subparagraph class="fontsize10" id="y913be24d-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Assessment and collection</inline>.—</heading><content>The Secretary may, to the extent provided in advance in appropriations Acts, assess and collect fees for the conduct of any training, workshop, or conference that advances the purposes of the program.</content></subparagraph>
<subparagraph class="fontsize10" id="y913be24e-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Amounts</inline>.—</heading><content>The amount of a fee under this paragraph may not exceed the sum of costs incurred, or expected to be incurred, by the Secretary as a direct result of the conduct of the training, workshop, or conference, including for subsistence expenses incidental to the training, workshop, or conference, as applicable.</content></subparagraph>
<subparagraph class="fontsize10" id="y913be24f-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Use of fees</inline>.—</heading><chapeau>Amounts collected by the Secretary in the form of fees under this paragraph shall be available to the extent and in such amounts as are provided in advance in appropriations Acts for—</chapeau><clause class="fontsize10" id="y913be250-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the costs incurred for conducting an activity described in subparagraph (A); or</content></clause>
<clause class="fontsize10" id="y913be251-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the expenses described in subparagraph (B).</content></clause>

<paragraph class="fontsize10" id="y913be252-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Survey and mapping</inline>.—</heading><content>Contracts entered into under paragraph (1)(B) shall be considered “surveying and mapping” services as such term is used in and as such contracts are <page identifier="/us/stat/134/1071">134 STAT. 1071</page>
awarded by the Secretary in accordance with the selection procedures in <ref href="/us/usc/t40/ch11">chapter 11 of title 40, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y913be253-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Ocean Economy</inline>.—</heading><content>The Secretary may establish publically available tools that track ocean and Great Lakes economy data for each coastal State.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y913be254-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/223/s4/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>There is authorized to be appropriated to the Secretary $4,000,000 for each fiscal year 2021 through 2025 to carry out the program.</content></subsection>
