<section id="d108305e405" identifier="/us/pl/116/215/dB/tI/s1105" style="-uslm-lc:I658144"><num class="bold" value="1105">SEC. 1105. </num><heading>EXTENSION OF SPOUSAL IMPOVERISHMENT PROTECTIONS.</heading><subsection class="firstIndent0 fontsize10" id="yf085589b-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tI/s1105/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 2404 of the Patient Protection and Affordable Care Act (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5 note</ref>), as amended by <ref href="/us/pl/116/159">Public Law 116–159</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>December 11</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>December 18</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf085589c-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tI/s1105/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf085589d-e825-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1396a">42 USC 1396a note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><chapeau>Nothing in <ref href="/us/pl/111/148/s2404">section 2404 of Public Law 111–148</ref> (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5 note</ref>) or section 1902(a)(17) or 1924 of the Social Security Act (<ref href="/us/usc/t42/s1396a/a/17">42 U.S.C. 1396a(a)(17)</ref>, 1396r–5) shall be construed as prohibiting a State from—</chapeau><paragraph class="fontsize10" id="yf085589e-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tI/s1105/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>applying an income or resource disregard under a methodology authorized under section 1902(r)(2) of such Act (<ref href="/us/usc/t42/s1396a/r/2">42 U.S.C. 1396a(r)(2)</ref>)—</chapeau><subparagraph class="fontsize10" id="yf085589f-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tI/s1105/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to the income or resources of an individual described in section 1902(a)(10)(A)(ii)(VI) of such Act (<ref href="/us/usc/t42/s1396a/a/10/A/ii/VI">42 U.S.C. 1396a(a)(10)(A)(ii)(VI)</ref>) (including a disregard of the income or resources of such individual’s spouse); or</content></subparagraph>
<subparagraph class="fontsize10" id="yf08558a0-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tI/s1105/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>on the basis of an individual’s need for home and community-based services authorized under subsection (c), (d), (i), or (k) of section 1915 of such Act (<ref href="/us/usc/t42/s1396n">42 U.S.C. 1396n</ref>) or under section 1115 of such Act (<ref href="/us/usc/t42/s1315">42 U.S.C. 1315</ref>); or</content></subparagraph>

<paragraph class="fontsize10" id="yf08558a1-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tI/s1105/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>disregarding an individual’s spousal income and assets under a plan amendment to provide medical assistance for home and community-based services for individuals by reason of being determined eligible under section 1902(a)(10)(C) of such Act (<ref href="/us/usc/t42/s1396a/a/10/C">42 U.S.C. 1396a(a)(10)(C)</ref>) or by reason of section 1902(f) of such Act (<ref href="/us/usc/t42/s1396a/f">42 U.S.C. 1396a(f)</ref>) or otherwise on the basis of a reduction of income based on costs incurred for medical or other remedial care under which the State disregarded the income and assets of the individual’s spouse in determining the initial and ongoing financial eligibility of an individual for such services in place of the spousal impoverishment provisions applied under section 1924 of such Act (<ref href="/us/usc/t42/s1396r–5">42 U.S.C. 1396r–5</ref>).</content></paragraph>

<section id="d108305e504" identifier="/us/pl/116/215/dB/tI/s1106" role="instruction" style="-uslm-lc:I658144"><num class="bold" value="1106">SEC. 1106. </num><heading>EXTENSION OF DELAY OF DSH REDUCTIONS.</heading><content style="-uslm-lc:I658120">  Section 1923(f)(7) of the Social Security Act (<ref href="/us/usc/t42/s1396r–4/f/7/A">42 U.S.C. 1396r–4(f)(7)(A)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>December 12</quotedText>” each place such phrase appears and <amendingAction type="insert">inserting</amendingAction> “<quotedText>December 19</quotedText>” in each such place.</content></section>

<subsection class="firstIndent0 fontsize10" id="yf086df69-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tIV/s1401/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Classification of Budgetary Effects</inline>.—</heading><chapeau>Notwithstanding Rule 3 of the Budget Scorekeeping Guidelines set forth in the joint explanatory statement of the committee of conference accompanying Conference Report 105–217 and section 250(c)(8) of the Balanced Budget and Emergency Deficit Control Act of 1985, the budgetary effects of this division shall not be estimated—</chapeau><paragraph class="fontsize10" id="yf086df6a-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tIV/s1401/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>for purposes of section 251 of such Act; and<page identifier="/us/stat/134/1047">134 STAT. 1047</page></content></paragraph>
<paragraph class="fontsize10" id="yf086df6b-e825-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/215/dB/tIV/s1401/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>for purposes of paragraph (4)(C) of section 3 of the Statutory Pay-As-You-Go Act of 2010 as being included in an appropriation Act.</content></paragraph>
