<section id="d108752e85" identifier="/us/pl/116/21/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>TECHNICAL CORRECTIONS TO COMPUTATION OF AVERAGE PAY UNDER <ref href="/us/pl/110/279">PUBLIC LAW 110–279</ref>.</heading><subsection class="firstIndent0 fontsize10" id="y38781342-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 1(c)(2)(A) of <ref href="/us/pl/110/279">Public Law 110–279</ref> (<ref href="/us/usc/t2/s2051/c/2/A">2 U.S.C. 2051(c)(2)(A)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y38781343-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>For purposes of</quotedText>” and all that follows through “<quotedText>(i) any period</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><clause class="indentUp2 fontsize10" id="y38781344-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Treatment of service</inline>.—</heading><content>For purposes of chapters 83, 84, and 87 of <ref href="/us/usc/t5">title 5, United States Code</ref>, any period”</content></clause>
</quotedContent>;</content></paragraph>
<paragraph class="fontsize10" id="y38781345-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in clause (i), by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a period; and</content></paragraph>
<paragraph class="fontsize10" id="y38781346-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>in clause (ii)—</chapeau><subparagraph class="fontsize10" id="y38781347-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">Treatment of pay</headingText>.—For purposes of <ref href="/us/usc/t5/ch87">chapter 87 of title 5, United States Code</ref>,</quotedText>” before “<quotedText>the rate of basic pay</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y38781348-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>the covered</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>a covered</quotedText>”.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y38781349-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3878134a-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s2051">2 USC 2051 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><paragraph class="fontsize10" id="y3878134b-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Director of the Office of Personnel Management shall promulgate regulations to carry out this section.</content></paragraph>
<paragraph class="fontsize10" id="y3878134c-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3878134d-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective date</inline>.—</heading><content>The regulations promulgated under paragraph (1) shall take effect not later than 180 days after the date of enactment of this Act.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y3878134e-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3878134f-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s2051">2 USC 2051 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability of Amendments</inline>.—</heading><paragraph class="fontsize10" id="y38781350-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><content>In this subsection, the terms “contractor”, “covered individual”, and “food services contract” have the meanings given those terms in <ref href="/us/pl/110/279/s1/a">section 1(a) of Public Law 110–279</ref> (<ref href="/us/usc/t2/s2051/a">2 U.S.C. 2051(a)</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y38781351-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><chapeau>The amendments made by this section shall apply with respect to—</chapeau><subparagraph class="fontsize10" id="y38781352-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a covered individual who separates from service as an employee of a contractor performing services under the food services contract before, on, or after the date of enactment of this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="y38781353-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/21/s1/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>each payment to a covered individual under chapter 83 or 84 of <ref href="/us/usc/t5">title 5, United States Code</ref>, made on or after <page identifier="/us/stat/133/904">133 STAT. 904</page>
the effective date of the regulations promulgated under subsection (b).</content></subparagraph>
