<section id="d108997e106" identifier="/us/pl/116/206/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Rodchenkov Anti-Doping Act of 2019</shortTitle>”.</content></section>
<section id="d108997e116" identifier="/us/pl/116/206/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a0af6ad-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s2401">21 USC 2401</ref>.</p></sidenote><heading>DEFINITIONS.</heading><paragraph class="fontsize10" id="y6a0b92ee-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Anti-doping organization</inline>.—</heading><content>The term “<term>anti-doping organization</term>” has the meaning given the term in Article 2 of the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92ef-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Athlete</inline>.—</heading><content>The term “<term>athlete</term>” has the meaning given the term in Article 2 of the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92f0-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Code</inline>.—</heading><content>The term “<term>Code</term>” means the World Anti-Doping Code most recently adopted by WADA on March 5, 2003.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92f1-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Convention</inline>.—</heading><content>The term “<term>Convention</term>” means the United Nations Educational, Scientific, and Cultural Organization International Convention Against Doping in Sport done at Paris October 19, 2005, and ratified by the United States in 2008.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92f2-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Major international sport competition</inline>.—</heading><chapeau>The term “<term>Major International Sport Competition</term>”—</chapeau><subparagraph class="fontsize10" id="y6a0b92f3-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>means a competition—</chapeau><clause class="fontsize10" id="y6a0b92f4-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/5/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in which one or more United States athletes and three or more athletes from other countries participate;</content></clause>
<clause class="fontsize10" id="y6a0b92f5-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/5/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>that is governed by the anti-doping rules and principles of the Code; and</content></clause>
<clause class="fontsize10" id="y6a0b92f6-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/5/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><chapeau>in which—</chapeau><subclause class="fontsize10" id="y6a0b92f7-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/5/A/iii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the competition organizer or sanctioning body receives sponsorship or other financial support from an organization doing business in the United States; or</content></subclause>
<subclause class="fontsize10" id="y6a0b92f8-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/5/A/iii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the competition organizer or sanctioning body receives compensation for the right to broadcast the competition in the United States; and</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y6a0b92f9-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>includes a competition that is a single event or a competition that consists of a series of events held at different times which, when combined, qualify an athlete or team for an award or other recognition.<page identifier="/us/stat/134/999">134 STAT. 999</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6a0b92fa-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Person</inline>.—</heading><content>The term “<term>person</term>” means any individual, partnership, corporation, association, or other entity.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92fb-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Prohibited method</inline>.—</heading><content>The term “<term>prohibited method</term>” has the meaning given the term in Article 2 of the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92fc-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Prohibited substance</inline>.—</heading><content>The term “<term>prohibited substance</term>” has the meaning given the term in Article 2 of the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92fd-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Scheme in commerce</inline>.—</heading><content>The term “<term>scheme in commerce</term>” means any scheme effectuated in whole or in part through the use in interstate or foreign commerce of any facility for transportation or communication.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92fe-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/10" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><heading class="fontsize10"><inline class="smallCaps">USADA</inline>.—</heading><content>The term “<term>USADA</term>” means the United States Anti-Doping Agency.</content></paragraph>
<paragraph class="fontsize10" id="y6a0b92ff-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s2/11" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><heading class="fontsize10"><inline class="smallCaps">WADA</inline>.—</heading><content>The term “<term>WADA</term>” means the World Anti-Doping Agency.</content></paragraph>

<section id="d108997e265" identifier="/us/pl/116/206/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a0b9300-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s2402">21 USC 2402</ref>.</p></sidenote><heading>MAJOR INTERNATIONAL DOPING FRAUD CONSPIRACIES.</heading><subsection class="firstIndent0 fontsize10" id="y6a0bba11-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>It shall be unlawful for any person, other than an athlete, to knowingly carry into effect, attempt to carry into effect, or conspire with any other person to carry into effect a scheme in commerce to influence by use of a prohibited substance or prohibited method any major international sports competition.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6a0bba12-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Extraterritorial Jurisdiction</inline>.—</heading><content>There is extraterritorial Federal jurisdiction over an offense under this section.</content></subsection>

<section id="d108997e294" identifier="/us/pl/116/206/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a0bba13-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s2403">21 USC 2403</ref>.</p></sidenote><heading>CRIMINAL PENALTIES AND STATUTE OF LIMITATIONS.</heading><subsection class="firstIndent0 fontsize10" id="y6a0c0834-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><paragraph class="fontsize10" id="y6a0c0835-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a0c0836-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Criminal penalty</inline>.—</heading><content>Whoever violates section 3 shall be sentenced to a term of imprisonment for not more than 10 years, fined $250,000 if the person is an individual or $1,000,000 if the defendant is other than an individual, or both.</content></paragraph>
<paragraph class="fontsize10" id="y6a0c0837-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Forfeiture</inline>.—</heading><chapeau>Any property real or personal, tangible or intangible, may be seized and criminally forfeited to the United States if that property—</chapeau><subparagraph class="fontsize10" id="y6a0c0838-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is used or intended to be used, in any manner, to commit or facilitate a violation of section 3; or</content></subparagraph>
<subparagraph class="fontsize10" id="y6a0c0839-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>constitutes or is traceable to the proceeds taken, obtained, or retained in connection with or as a result of a violation of section 3.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6a0c083a-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on Prosecution</inline>.—</heading><paragraph class="fontsize10" id="y6a0c083b-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a0c083c-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>No person shall be prosecuted, tried, or punished for violation of section 3 unless the indictment is returned or the information is filed within 10 years after the date on which the offense was completed.</content></paragraph>
<paragraph class="fontsize10" id="y6a0c083d-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a0c083e-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Courts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Tolling</inline>.—</heading><content>Upon application in the United States, filed before a return of an indictment, indicating that evidence of an offense under this chapter is in a foreign country, the district court before which a grand jury is impaneled to investigate the offense shall suspend the running of this statute of limitation for the offense if the court finds by a preponderance of the evidence that an official request has been made for such evidence and that it reasonably appears, or reasonably appeared at the time the request was made, that such evidence is, or was, in such foreign country.<page identifier="/us/stat/134/1000">134 STAT. 1000</page></content></paragraph>
</subsection>
</section>
<section id="d108997e378" identifier="/us/pl/116/206/s5" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>RESTITUTION.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6a0c2f4f-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t18/s3663A">Section 3663A of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> in subsection (c)—</chapeau><paragraph class="fontsize10" id="y6a0c2f50-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s5/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in paragraph (1)(A)—</chapeau><subparagraph class="fontsize10" id="y6a0c2f51-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s5/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> clauses (iii) and (iv) as clauses (iv) and (v), respectively; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6a0c2f52-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s5/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="insert">inserting</amendingAction> after clause (ii) the following:<quotedContent><subsection class="indentUp1 fontsize10" id="y6a0c2f53-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii)</num><content> an offense described in section 3 of the Rodchenkov Anti-Doping Act of 2019;”</content></subsection>
</quotedContent>; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6a0c2f54-e826-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/206/s5/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (3), in the matter preceding subparagraph (A), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or (iii)</quotedText>” after “<quotedText>paragraph (1)(A)(ii)</quotedText>”.</content></paragraph>

<section id="d108997e430" identifier="/us/pl/116/206/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6a0c2f55-e826-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s2404">21 USC 2404</ref>.</p></sidenote><heading>COORDINATION AND SHARING OF INFORMATION WITH USADA.</heading><content style="-uslm-lc:I658120">  Except as otherwise prohibited by law and except in cases in which the integrity of a criminal investigation would be affected, in furtherance of the obligation of the United States under Article 7 of the Convention, the Department of Justice, the Department of Homeland Security, and the Food and Drug Administration shall coordinate with USADA with regard to any investigation related to a potential violation of section 3 of this Act, to include sharing with USADA all information in the possession of the Department of Justice, the Department of Homeland Security, or the Food and Drug Administration which may be relevant to any such potential violation.</content></section>
<section id="d108997e442" identifier="/us/pl/116/206/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, and the amendments made by this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
