<section id="d227360e96" identifier="/us/pl/116/194/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Information Technology Modernization Centers of Excellence Program Act</shortTitle>”.</content></section>
<section id="d227360e106" identifier="/us/pl/116/194/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>GSA MODERNIZATION CENTERS OF EXCELLENCE PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="yfd970743-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yfd970744-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Cloud computing</inline>.—</heading><content>The term “<term>cloud computing</term>” has the meaning given the term in section 1076 of the National Defense Authorization Act for Fiscal Year 2018 (<ref href="/us/usc/t40/s11301">40 U.S.C. 11301 note</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yfd970745-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Executive agency</inline>.—</heading><content>The term “<term>executive agency</term>” has the meaning given the term “<term>Executive agency</term>” in <ref href="/us/usc/t5/s105">section 105 of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="yfd970746-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Program</inline>.—</heading><content>The term “<term>Program</term>” means the Information Technology Modernization Centers of Excellence Program established under subsection (b).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfd970747-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>The Administrator of General Services shall establish a program to be known as the Information Technology Modernization Centers of Excellence Program to facilitate the adoption of modern technology by executive agencies on a reimbursable basis.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfd970748-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Responsibilities</inline>.—</heading><chapeau>The Program shall have the following responsibilities:</chapeau><paragraph class="fontsize10" id="yfd970749-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>To encourage the modernization of information technology used by an executive agency and how a customer interacts with an executive agency.</content></paragraph>
<paragraph class="fontsize10" id="yfd97074a-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>To improve cooperation between commercial and executive agency information technology sectors.</content></paragraph>
<paragraph class="fontsize10" id="yfd97074b-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>To the extent practicable, encourage the adoption of commercial items in accordance with <ref href="/us/usc/t41/s3307">section 3307 of title 41, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="yfd97074c-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>Upon request by the executive agency, to assist executive agencies with planning and adoption of technology in focus areas designated by the Administrator, which may include the following:</chapeau><subparagraph class="fontsize10" id="yfd97074d-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>A commercial cloud computing system that includes—</chapeau><clause class="fontsize10" id="yfd97074e-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>end-to-end migration planning and an assessment of progress towards modernization; and<page identifier="/us/stat/134/982">134 STAT. 982</page></content></clause>
<clause class="fontsize10" id="yfd97074f-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>a cybersecurity and governance framework that promotes industry and government risk management best practice approaches, prioritizing efforts based on risk, impact, and consequences.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yfd970750-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Tools to help an individual receive support from and communicate with an executive agency.</content></subparagraph>
<subparagraph class="fontsize10" id="yfd970751-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Contact centers and other related customer supports.</content></subparagraph>
<subparagraph class="fontsize10" id="yfd970752-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Efficient use of data management, analysis, and reporting.</content></subparagraph>
<subparagraph class="fontsize10" id="yfd970753-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>The optimization of infrastructure, including for data centers, and the reduction of operating costs.</content></subparagraph>
<subparagraph class="fontsize10" id="yfd970754-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/4/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>Artificial intelligence.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfd970755-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>To share best practices and expertise with executive agencies.</content></paragraph>
<paragraph class="fontsize10" id="yfd970756-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/c/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Other responsibilities the Administrator may identify.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfd970757-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><content>The Administrator shall coordinate with the Secretary of Homeland Security in establishing the Program to ensure that the technology, tools, and frameworks facilitated for executive agencies by the Program provide sufficient cybersecurity and maintain the integrity, confidentiality, and availability of Federal information.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfd970758-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Program Reporting</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, and every year thereafter, the Administrator shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives a report on the Program, which shall include the following:</chapeau><paragraph class="fontsize10" id="yfd970759-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>A description of the reimbursable agreements, statements of work, and associated project schedules and deliverables for the Program.</content></paragraph>
<paragraph class="fontsize10" id="yfd97075a-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Details on the total amount of the reimbursable agreements.</content></paragraph>
<paragraph class="fontsize10" id="yfd97075b-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Any additional information the Administrator determines necessary.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfd97075c-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>This Act shall cease to have effect on the date that is 7 years after the date of enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfd97075d-e826-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/194/s2/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in this Act shall be construed to impair or otherwise affect the authority delegated by law to an executive agency or the head of an executive agency.</content></subsection>

<section id="d227360e304" identifier="/us/pl/116/194/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the <page identifier="/us/stat/134/983">134 STAT. 983</page>
Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
