<section id="d111024e92" identifier="/us/pl/116/184/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Intercountry Adoption Information Act of 2019</shortTitle>”.</content></section>
<section id="d111024e102" identifier="/us/pl/116/184/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ADDITIONAL INFORMATION TO BE INCLUDED IN ANNUAL REPORT ON INTERCOUNTRY ADOPTIONS.</heading><subsection class="firstIndent0 fontsize10" id="y6d87091e-e827-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/184/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Report Elements</inline>.—</heading><content>Section 104(b) of the Intercountry Adoption Act of 2000 (<ref href="/us/usc/t42/s14914/b">42 U.S.C. 14914(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new paragraphs:<quotedContent><paragraph class="fontsize10" id="y6d87302f-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6d873030-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote><content>A list of countries that established or maintained a significant law or regulation that prevented or prohibited adoptions involving immigration to the United States, regardless of whether such adoptions occurred under the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y6d873031-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><content>For each country listed under paragraph (9), the date on which the law or regulation was initially implemented.</content></paragraph>
<paragraph class="fontsize10" id="y6d873032-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><content>Information on efforts taken with respect to a country listed under paragraph (9) to encourage the resumption of halted or stalled adoption proceedings involving immigration to the United States, regardless of whether the adoptions would have occurred under the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y6d873033-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12) </num><content>Information on any action the Secretary carried out that prevented, prohibited, or halted any adoptions involving immigration to the United States, regardless of whether the adoptions occurred under the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y6d873034-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">“(13) </num><chapeau>For each country listed pursuant to paragraph (12), a description of—</chapeau><subparagraph class="fontsize10" id="y6d873035-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>what policies, procedures, resources, and safeguards the country lacks, or other shortcomings or circumstances, that caused the action to be carried out;</content></subparagraph>
<subparagraph class="fontsize10" id="y6d873036-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>what progress the country has made to alleviate those shortcomings; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6d873037-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>what steps the Department of State has taken in order to assist the country to reopen intercountry adoptions.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6d875748-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">“(14) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6d875749-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>An assessment of the impact of the fee schedule of the Intercountry Adoption Accreditation and Maintenance Entity on families seeking to adopt internationally, especially <page identifier="/us/stat/134/898">134 STAT. 898</page>
low-income families, families seeking to adopt sibling groups, or families seeking to adopt children with disabilities.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y6d87574a-e827-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/184/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Public Availability of Report</inline>.—</heading><content>Section 104 of the Intercountry Adoption Act of 2000 (<ref href="/us/usc/t42/s14914">42 U.S.C. 14914</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y6d87574b-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6d87574c-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Public Availability of Report</inline>.—</heading><content>The Secretary shall make the information contained in the report required under subsection (a) available to the public on the website of the Department of State.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y6d87574d-e827-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/184/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6d87574e-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Compliance.</p><p class="leftAlign firstIndent0 fontsize8" id="x6d87574f-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s14914">42 USC 14914 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Privacy Concerns</inline>.—</heading><content>In complying with the amendments made by subsections (a) and (b), the Secretary shall avoid, to the maximum extent practicable, disclosing any personally identifiable information relating to United States citizens or the adoptees of such citizens.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6d875750-e827-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/184/s2/d" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>Section 104(a) of the Intercountry Adoption Act of 2000 (<ref href="/us/usc/t42/s14914/a">42 U.S.C. 14914(a)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>International Relations</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Foreign Affairs</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6d875751-e827-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/184/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6d875752-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s14914">42 USC 14914 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Application Date</inline>.—</heading><content>The amendments made by this section shall apply with respect to reports required to be submitted under section 104 of the Intercountry Adoption Act of 2000 (<ref href="/us/usc/t42/s14914">42 U.S.C. 14914</ref>) beginning on the date that is 180 days after the date of enactment of this Act.</content></subsection>
