<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7d9599e7-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Due Process Protections Act.</p></sidenote>
<section id="d111133e88" identifier="/us/pl/116/182/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7d9599e8-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/app61">18 USC app. 61</ref> note.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Due Process Protections Act</shortTitle>”.</content></section>
<section id="d111133e103" identifier="/us/pl/116/182/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REMINDER OF PROSECUTORIAL OBLIGATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x7d95c0f9-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Rule 5 of the Federal Rules of Criminal Procedure<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7d95c0fa-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/app5">18 USC app. 5</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y7d95c0fb-e827-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/182/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (f) as subsection (g); and</content></paragraph>
<paragraph class="fontsize10" id="y7d95c0fc-e827-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/182/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (e) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y7d95c0fd-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Reminder of Prosecutorial Obligation</inline>.—</heading><paragraph class="fontsize10" id="y7d95c0fe-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In all criminal proceedings, on the first scheduled court date when both prosecutor and defense counsel are present, the judge shall issue an oral and written order to prosecution and defense counsel that confirms the disclosure obligation of the prosecutor under Brady v. Maryland, 373 U.S. 83 (1963) and its progeny, and the possible consequences of violating such order under applicable law.</content></paragraph>
<paragraph class="fontsize10" id="y7d95c0ff-e827-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Formation of order</inline>.—</heading><content>Each judicial council in which a district court is located shall promulgate a model order for the purpose of paragraph (1) that the court may use as it determines is appropriate.”</content></paragraph>
