<section id="d114675e92" identifier="/us/pl/116/157/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Safeguarding America’s First Responders Act of 2020</shortTitle>”.</content></section>
<section id="d114675e102" identifier="/us/pl/116/157/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SENSE OF CONGRESS; PURPOSE.</heading><subsection class="firstIndent0 fontsize10" id="y7d1c2e52-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><chapeau>It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y7d1c2e53-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>an infectious disease pandemic known as COVID–19 exists;</content></paragraph>
<paragraph class="fontsize10" id="y7d1c2e54-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to date, there is much still unknown about COVID–19, but it is known that COVID–19 and related complications may be fatal;</content></paragraph>
<paragraph class="fontsize10" id="y7d1c2e55-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>services provided by public safety officers are nonetheless essential during this pandemic;</content></paragraph>
<paragraph class="fontsize10" id="y7d1c2e56-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>due to the COVID–19 pandemic and what is currently known about how the disease is spread, public safety officers are uncharacteristically at risk of contracting the disease; and</content></paragraph>
<paragraph class="fontsize10" id="y7d1c2e57-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>although the Public Safety Officers’ Benefits program currently covers deaths and permanent and total disabilities resulting from infectious disease sustained by public safety officers in carrying out their duties, the determination of claims involving personal injuries believed to have resulted from COVID–19 or its complications may be uniquely challenging or delayed given the lack of—</chapeau><subparagraph class="fontsize10" id="y7d1c2e58-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/a/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>definitive testing and medical records at this time; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7d1c2e59-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/a/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a definitive uniform body of medical information about how the disease is spread or its effects.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7d1c2e5a-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Purpose</inline>.—</heading><content>The purpose of this Act is to establish a carefully drawn framework wherein claims under the Public Safety Officers’ Benefits program, arising under the unique circumstances described in subsection (a), can be processed expeditiously and under fair and clear standards.</content></subsection>

<section id="d114675e161" identifier="/us/pl/116/157/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7d1c2e5b-e828-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading>PUBLIC SAFETY OFFICER BENEFITS.</heading><subsection class="firstIndent0 fontsize10" id="y7d1c7c7c-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7d1c7c7d-e828-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Death Benefits</inline>.—</heading><chapeau>As determined by the Bureau of Justice Assistance, unless competent medical evidence establishes that the death of a public safety officer (as defined in section 1204 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 <page identifier="/us/stat/134/705">134 STAT. 705</page>
(<ref href="/us/usc/t34/s10284">34 U.S.C. 10284</ref>)) was directly and proximately caused by something other than COVID–19, COVID–19 (or complications therefrom) suffered by the public safety officer shall be presumed to constitute a personal injury within the meaning of section 1201(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281/a">34 U.S.C. 10281(a)</ref>), sustained in the line of duty by the officer and directly and proximately resulting in death, if—</chapeau><paragraph class="fontsize10" id="y7d1c7c7e-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the officer engaged in a line of duty action or activity between January 1, 2020, and December 31, 2021;</content></paragraph>
<paragraph class="fontsize10" id="y7d1c7c7f-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the officer was diagnosed with COVID–19 (or evidence indicates that the officer had COVID–19) during the 45-day period beginning on the last day of duty of the officer; and</content></paragraph>
<paragraph class="fontsize10" id="y7d1c7c80-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>evidence indicates that the officer had COVID–19 (or complications therefrom) at the time of the officer’s death.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7d1c7c81-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Disability Benefits</inline>.—</heading><chapeau>As determined by the Bureau of Justice Assistance, COVID–19 (or complications therefrom) suffered by a public safety officer shall be presumed to constitute a personal injury within the meaning of section 1201(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281/b">34 U.S.C. 10281(b)</ref>), sustained in the line of duty by the officer, if—</chapeau><paragraph class="fontsize10" id="y7d1c7c82-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the officer engaged in a line of duty action or activity between January 1, 2020, and December 31, 2021; and</content></paragraph>
<paragraph class="fontsize10" id="y7d1c7c83-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/157/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the officer was diagnosed with COVID–19 (or evidence indicates that the officer had COVID–19) during the 45-day period beginning on the last day of duty of the officer.</content></paragraph>
