<section id="d231014e113" identifier="/us/pl/116/152/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>NATIONAL PARKS AND PUBLIC LAND LEGACY RESTORATION FUND.</heading><subsection class="firstIndent0 fontsize10" id="ya53a913d-e828-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/152/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t54/stII">Subtitle II of title 54, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after chapter 2003 the following:<quotedContent><chapter id="ya53bf0ce-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658174"><num class="fontsize10 bold" value="2004">“CHAPTER 2004—</num><heading class="fontsize10 smallCaps"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa53bf0cf-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t54/s200401">54 USC 200401</ref> prec.</p></sidenote>NATIONAL PARKS AND PUBLIC LAND LEGACY RESTORATION FUND</heading><toc>

<section class="centered fontsize12" id="ya53bf0d0-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658166"><num class="fontsize12" value="200401">“§ 200401.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa53bf0d1-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t54/s200401">54 USC 200401</ref>.</p></sidenote>Definitions</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa53bf0d2-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  “In this chapter:</chapeau><paragraph class="fontsize10" id="ya53bf0d3-e828-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Asset</inline>.—</heading><chapeau>The term ‘<term>asset</term>’ means any real property, including any physical structure or grouping of structures, landscape, trail, or other tangible property, that—</chapeau><subparagraph class="fontsize10" id="ya53bf0d4-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>has a specific service or function; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0d5-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is tracked and managed as a distinct, identifiable entity by the applicable covered agency.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya53bf0d6-e828-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Covered agency</inline>.—</heading><chapeau>The term ‘<term>covered agency</term>’ means—</chapeau><subparagraph class="fontsize10" id="ya53bf0d7-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Service;</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0d8-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the United States Fish and Wildlife Service;</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0d9-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the Forest Service;</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0da-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>the Bureau of Land Management; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0db-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>the Bureau of Indian Education.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya53bf0dc-e828-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Fund</inline>.—</heading><content>The term ‘<term>Fund</term>’ means the National Parks and Public Land Legacy Restoration Fund established by section 200402(a).</content></paragraph>
<paragraph class="fontsize10" id="ya53bf0dd-e828-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Project</inline>.—</heading><content>The term ‘<term>project</term>’ means any activity to reduce or eliminate deferred maintenance of an asset, which <page identifier="/us/stat/134/683">134 STAT. 683</page>
may include resolving directly related infrastructure deficiencies of the asset that would not by itself be classified as deferred maintenance.</content></paragraph>
</section>
<section class="centered fontsize12" id="ya53bf0de-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658166"><num class="fontsize12" value="200402">“§ 200402.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa53bf0df-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t54/s200402">54 USC 200402</ref>.</p></sidenote> National Parks and Public Land Legacy Restoration Fund</heading><subsection class="firstIndent0 fontsize10" id="ya53bf0e0-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established in the Treasury of the United States a fund to be known as the ‘National Parks and Public Land Legacy Restoration Fund’.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf0e1-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Deposits</inline>.—</heading><paragraph class="fontsize10" id="ya53bf0e2-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in paragraph (2), for each of fiscal years 2021 through 2025, there shall be deposited in the Fund an amount equal to 50 percent of all energy development revenues due and payable to the United States from oil, gas, coal, or alternative or renewable energy development on Federal land and water credited, covered, or deposited as miscellaneous receipts under Federal law in the preceding fiscal year.</content></paragraph>
<paragraph class="fontsize10" id="ya53bf0e3-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Maximum amount</inline>.—</heading><content>The amount deposited in the Fund under paragraph (1) shall not exceed $1,900,000,000 for any fiscal year.</content></paragraph>
<paragraph class="fontsize10" id="ya53bf0e4-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Effect on other revenues</inline>.—</heading><chapeau>Nothing in this section affects the disposition of revenues that—</chapeau><subparagraph class="fontsize10" id="ya53bf0e5-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>are due to the United States, special funds, trust funds, or States from mineral and energy development on Federal land and water; or</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0e6-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>have been otherwise appropriated—</chapeau><clause class="fontsize10" id="ya53bf0e7-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>under Federal law, including—</chapeau><subclause class="fontsize10" id="ya53bf0e8-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the Gulf of Mexico Energy Security Act of 2006 (<ref href="/us/usc/t43/s1331">43 U.S.C. 1331 note</ref>; <ref href="/us/pl/109/432">Public Law 109–432</ref>); and</content></subclause>
<subclause class="fontsize10" id="ya53bf0e9-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the Mineral Leasing Act (<ref href="/us/usc/t30/s181/etseq">30 U.S.C. 181 et seq.</ref>); or</content></subclause>
</clause>
<clause class="fontsize10" id="ya53bf0ea-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>from—</chapeau><subclause class="fontsize10" id="ya53bf0eb-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the Land and Water Conservation Fund established under chapter 2003; or</content></subclause>
<subclause class="fontsize10" id="ya53bf0ec-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the Historic Preservation Fund established under chapter 3031.</content></subclause>

</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf0ed-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Availability of Funds</inline>.—</heading><content>Amounts deposited in the Fund shall be available to the Secretary and the Secretary of Agriculture, as provided in subsection (e), without further appropriation or fiscal year limitation.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf0ee-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa53bf0ef-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Investment of Amounts</inline>.—</heading><paragraph class="fontsize10" id="ya53bf0f0-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa53bf0f1-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary may request the Secretary of the Treasury to invest any portion of the Fund that is not, as determined by the Secretary, in consultation with the Secretary of Agriculture, required to meet the current needs of the Fund.</content></paragraph>
<paragraph class="fontsize10" id="ya53bf0f2-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><chapeau>An investment requested under paragraph (1) shall be made by the Secretary of the Treasury in a public debt security—</chapeau><subparagraph class="fontsize10" id="ya53bf0f3-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>with a maturity suitable to the needs of the Fund, as determined by the Secretary; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0f4-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>bearing interest at a rate determined by the Secretary of the Treasury, taking into consideration current market yields on outstanding marketable obligations of the United States of comparable maturity.<page identifier="/us/stat/134/684">134 STAT. 684</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya53bf0f5-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Credits to fund</inline>.—</heading><content>The income on investments of the Fund under this subsection shall be credited to, and form a part of, the Fund.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf0f6-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Use of Funds</inline>.—</heading><paragraph class="fontsize10" id="ya53bf0f7-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Amounts deposited in the Fund for each fiscal year shall be used for priority deferred maintenance projects in the System, in the National Wildlife Refuge System, on public land administered by the Bureau of Land Management, for the Bureau of Indian Education schools, and in the National Forest System, as follows:</chapeau><subparagraph class="fontsize10" id="ya53bf0f8-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>70 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the Service.</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0f9-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>15 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the Forest Service.</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0fa-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>5 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the United States Fish and Wildlife Service.</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0fb-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>5 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the Bureau of Land Management.</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0fc-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>5 percent of the amounts deposited in the Fund for each fiscal year shall be allocated to the Bureau of Indian Education.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya53bf0fd-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><subparagraph class="fontsize10" id="ya53bf0fe-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Non-transportation projects</inline>.—</heading><content>Over the term of the Fund, within each covered agency, not less than 65 percent of amounts from the Fund shall be allocated for non-transportation projects.</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf0ff-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Transportation projects</inline>.—</heading><content>The amounts remaining in the Fund after the allocations required under subparagraph (A) may be allocated for transportation projects of the covered agencies, including paved and unpaved roads, bridges, tunnels, and paved parking areas.</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf100-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Plan</inline>.—</heading><content>Any priority deferred maintenance project funded under this section shall be consistent with an applicable transportation, deferred maintenance, or capital improvement plan developed by the applicable covered agency.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf101-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Prohibited Use of Funds</inline>.—</heading><chapeau>No amounts in the Fund shall be used—</chapeau><paragraph class="fontsize10" id="ya53bf102-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>for land acquisition;</content></paragraph>
<paragraph class="fontsize10" id="ya53bf103-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>to supplant discretionary funding made available for annually recurring facility operations, maintenance, and construction needs; or</content></paragraph>
<paragraph class="fontsize10" id="ya53bf104-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>for bonuses for employees of the Federal Government that are carrying out this section.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf105-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa53bf106-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Submission of Priority List of Projects to Congress</inline>.—</heading><chapeau>Not later than 90 days after the date of enactment of this section, the Secretary and the Secretary of Agriculture shall submit to the Committees on Energy and Natural Resources and Appropriations of the Senate and the Committees on Natural Resources and Appropriations of the House of Representatives a list of projects to be funded for fiscal year 2021 that—</chapeau><paragraph class="fontsize10" id="ya53bf107-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>are identified by the Secretary and the Secretary of Agriculture as priority deferred maintenance projects; and</content></paragraph>
<paragraph class="fontsize10" id="ya53bf108-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>as of the date of the submission of the list, are ready to be implemented.<page identifier="/us/stat/134/685">134 STAT. 685</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf109-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa53bf10a-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Submission of Annual List of Projects to Congress</inline>.—</heading><content>Until the date on which all of the amounts in the Fund are expended, the President shall annually submit to Congress, together with the annual budget of the United States, a list of projects to be funded from the Fund that includes a detailed description of each project, including the estimated expenditures from the Fund for the project for the applicable fiscal year.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf10b-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Alternate Allocation</inline>.—</heading><paragraph class="fontsize10" id="ya53bf10c-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Appropriations Acts may provide for alternate allocation of amounts made available under this section, consistent with the allocations to covered agencies under subsection (e)(1).</content></paragraph>
<paragraph class="fontsize10" id="ya53bf10d-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Allocation by president</inline>.—</heading><subparagraph class="fontsize10" id="ya53bf10e-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">No alternate allocations</inline>.—</heading><content>If Congress has not enacted legislation establishing alternate allocations by the date on which the Act making full-year appropriations for the Department of the Interior, Environment, and Related Agencies for the applicable fiscal year is enacted into law, amounts made available under subsection (c) shall be allocated by the President.</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf10f-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Insufficient alternate allocation</inline>.—</heading><content>If Congress enacts legislation establishing alternate allocations for amounts made available under subsection (c) that are less than the full amount appropriated under that subsection, the difference between the amount appropriated and the alternate allocation shall be allocated by the President.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya53bf110-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="j">“(j) </num><heading class="fontsize10"><inline class="smallCaps">Public Donations</inline>.—</heading><paragraph class="fontsize10" id="ya53bf111-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary and the Secretary of Agriculture may accept public cash or in-kind donations that advance efforts—</chapeau><subparagraph class="fontsize10" id="ya53bf112-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to reduce the deferred maintenance backlog; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf113-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>to encourage relevant public-private partnerships.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya53bf114-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Credits to fund</inline>.—</heading><chapeau>Any cash donations accepted under paragraph (1) shall be—</chapeau><subparagraph class="fontsize10" id="ya53bf115-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>credited to, and form a part of, the Fund; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya53bf116-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>allocated to the covered agency for which the donation was made.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya53bf117-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Other allocations</inline>.—</heading><content>Any donations allocated to a covered agency under paragraph (2)(B) shall be allocated to the applicable covered agency independently of the allocations under subsection (e)(1).</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ya53bf118-e828-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="k">“(k) </num><heading class="fontsize10"><inline class="smallCaps">Required Consideration for Accessibility</inline>.—</heading><content>In expending amounts from the Fund, the Secretary and the Secretary of Agriculture shall incorporate measures to improve the accessibility of assets and accommodate visitors and employees with disabilities in accordance with applicable law.”</content></subsection>
