<section id="d115043e92" identifier="/us/pl/116/151/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Protecting Nonprofits from Catastrophic Cash Flow Strain Act of 2020</shortTitle>”.</content></section>
<section id="d115043e102" identifier="/us/pl/116/151/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>IMPROVING EMERGENCY UNEMPLOYMENT RELIEF FOR GOVERNMENTAL ENTITIES AND NONPROFIT ORGANIZATIONS.</heading><subsection class="firstIndent0 fontsize10" id="yb8f22cdb-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 903(i)(1) of the Social Security Act (<ref href="/us/usc/t42/s1103/i/1">42 U.S.C. 1103(i)(1)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yb8f22cdc-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>during</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>with respect to</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="yb8f22cdd-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraph (B), by <amendingAction type="delete">striking</amendingAction> “<quotedText>3309(a)(1)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>3309(a)</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yb8f22cde-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="delete">striking</amendingAction> subparagraph (C) and <amendingAction type="insert">inserting</amendingAction> the following new subparagraph:<quotedContent><subparagraph class="indentDown1 firstIndent0 fontsize10" id="yb8f22cdf-e828-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Notwithstanding any other provision of law, funds transferred to the account of a State under subparagraph (A) shall be used exclusively to reduce the amounts required to be paid in lieu of contributions into the State unemployment fund pursuant to such section by governmental entities and other organizations described in section 3309(a) of such Code.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yb8f22ce0-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb8f22ce1-e828-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1103">42 USC 1103 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><paragraph class="fontsize10" id="yb8f22ce2-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to paragraph (2), the amendments made by subsection (a) shall take effect as if included in the enactment of section 2103 of the Relief for Workers Affected by Coronavirus Act (contained in subtitle A of title II of division A of the CARES Act (<ref href="/us/pl/116/136">Public Law 116–136</ref>)).</content></paragraph>
<paragraph class="fontsize10" id="yb8f22ce3-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Application to weeks prior to enactment</inline>.—</heading><chapeau>For weeks of unemployment that occurred after March 12, 2020, and prior to the date of enactment of this section, States may—</chapeau><subparagraph class="fontsize10" id="yb8f22ce4-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>issue reimbursements in accordance with section 903(i)(1)(C) of the Social Security Act, as in effect prior to the date of enactment of this section; or<page identifier="/us/stat/134/681">134 STAT. 681</page></content></subparagraph>
<subparagraph class="fontsize10" id="yb8f22ce5-e828-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/151/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>reduce the amounts required to be paid in accordance with such section 903(i)(1)(C), as amended by subsection (a).</content></subparagraph>
