<section id="d231398e85" identifier="/us/pl/116/146/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>MODIFICATION OF PAY LIMITATION FOR CERTAIN HIGH-LEVEL EMPLOYEES AND OFFICERS OF THE DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="y1732be52-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/146/s1/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Modification</inline>.—</heading><content><ref href="/us/usc/t38/s7404/d">Section 7404(d) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and except for individuals appointed under sections 7401(4) and 7306 of this title,</quotedText>” after “<quotedText>section 7457 of this title,</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1732be53-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/146/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1732be54-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7404">38 USC 7404 note</ref>.</p><p class="leftAlign firstIndent0 fontsize8" id="x1732be55-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Waivers</inline>.—</heading><paragraph class="fontsize10" id="y1732be56-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/146/s1/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary of Veterans Affairs may waive the limitation described in section 7404(d) of such title, as in effect on the day before the date of the enactment of this Act, on the amount of basic pay payable to individuals appointed under section 7401(4) or 7306 of such title for basic pay payable during the period—</chapeau><subparagraph class="fontsize10" id="y1732be57-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/146/s1/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>beginning on November 1, 2010; and</content></subparagraph>
<subparagraph class="fontsize10" id="y1732be58-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/146/s1/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>ending on the day before the date of the enactment of this Act.</content></subparagraph>

<paragraph class="fontsize10" id="y1732be59-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/146/s1/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The Secretary shall prescribe the form for requesting a waiver under paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="y1732be5a-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/146/s1/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Treatment of waiver</inline>.—</heading><content>A decision not to grant a waiver under paragraph (1) shall not be treated as an adverse <page identifier="/us/stat/134/659">134 STAT. 659</page>
action and is not subject to further appeal, third-party review, or judicial review.</content></paragraph>
