<section id="d116140e94" identifier="/us/pl/116/140/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Student Veteran Coronavirus Response Act of 2020</shortTitle>”.</content></section>
<section id="d116140e104" identifier="/us/pl/116/140/s2" role="definitions" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fc6569-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3031">38 USC 3031 note</ref>.</p></sidenote><heading>COVERED PERIOD DEFINED.</heading><content style="-uslm-lc:I658120">  For purposes of this Act, the term “<term>covered period</term>” means the period beginning on March 1, 2020, and ending on December 21, 2020.</content></section>
<section id="d116140e116" identifier="/us/pl/116/140/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fc656a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3485">38 USC 3485 note</ref>.</p></sidenote><heading>PAYMENT OF WORK-STUDY ALLOWANCES DURING EMERGENCY SITUATIONS.</heading><content class="firstIndent0 fontsize10" id="x56fc8c7b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  During<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fc8c7c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote> the covered period, the Secretary of Veterans Affairs shall apply <ref href="/us/usc/t38/s3485">section 3485 of title 38, United States Code</ref>, as if it were amended by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y56fcb38d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f)</num><paragraph class="inline" id="y56fcb38e-e829-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><chapeau>In case of an individual who is in receipt of work-study allowance pursuant to an agreement described in subsection (a)(3) as of the date on which an emergency situation occurs and who is unable to continue to perform qualifying work-study activities described in subsection (a)(4) by reason of the emergency situation—</chapeau><subparagraph class="fontsize10" id="y56fcb38f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Secretary may continue to pay work-study allowance under this section or make deductions described in subsection (e)(1) during the period of such emergency situation, notwithstanding the inability of the individual to perform such work-study activities by reason of such emergency situation; and</content></subparagraph>
<subparagraph class="fontsize10" id="y56fcb390-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>at the option of the individual, the Secretary shall extend the agreement described in subsection (a)(3) with the individual for any subsequent period of enrollment initiated during the emergency situation, notwithstanding the inability of the individual to perform work-study activities described in subsection (a)(4) by reason of such emergency situation.</content></subparagraph>

<paragraph class="indentUp0 firstIndent0 fontsize10" id="y56fcb391-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fcb392-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>The amount of work-study allowance payable to an individual under paragraph (1)(A) during the period of an emergency situation shall be an amount determined by the Secretary but may not exceed the amount that would be payable under subsection (a)(2) if the individual worked 25 hours per week paid during such period.”</content></paragraph>

<section id="d116140e171" identifier="/us/pl/116/140/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fcb393-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3680">38 USC 3680 note</ref>.</p></sidenote><heading>PAYMENT OF ALLOWANCES TO VETERANS ENROLLED IN EDUCATIONAL INSTITUTIONS CLOSED FOR EMERGENCY SITUATIONS.</heading><subsection class="firstIndent0 fontsize10" id="y56fcdaa4-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>During the covered period, the Secretary may pay allowances to an eligible veteran or eligible person under <ref href="/us/usc/t38/s3680/a/2/A">section 3680(a)(2)(A) of title 38, United States Code</ref>, if the veteran or person is enrolled in a program or course of education that—</chapeau><paragraph class="fontsize10" id="y56fcdaa5-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>is provided by an educational institution that is closed by reason of an emergency situation; or</content></paragraph>
<paragraph class="fontsize10" id="y56fcdaa6-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>is suspended by reason of an emergency situation.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y56fcdaa7-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fcdaa8-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Amount of Allowance</inline>.—</heading><content>The total number of weeks for which allowances may be paid under this section may not exceed four weeks.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y56fcdaa9-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Not Counted for Purposes of Limitation</inline>.—</heading><content>Any amount paid under this section shall not be counted for purposes of the limitation on allowanced under <ref href="/us/usc/t38/s3680/a/2/A">section 3680(a)(2)(A) of title 38, United States Code</ref>.</content></subsection>

<section id="d116140e229" identifier="/us/pl/116/140/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fcdaaa-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3699">38 USC 3699 note</ref>.</p></sidenote><heading>PROHIBITION OF CHARGE TO ENTITLEMENT OF STUDENTS UNABLE TO PURSUE A PROGRAM OF EDUCATION DUE TO AN EMERGENCY SITUATION.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x56fd01bb-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  During<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fd01bc-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote> the covered period, the Secretary of Veterans Affairs shall apply <ref href="/us/usc/t38/s3699/b/1">section 3699(b)(1) of title 38, United States Code</ref>, as if it were amended—</chapeau><paragraph class="fontsize10" id="y56fd01bd-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s5/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>or</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="y56fd01be-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s5/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraph (B)(ii), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>or</quotedText>” ; and</content></paragraph>
<paragraph class="fontsize10" id="y56fd01bf-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s5/3" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="fontsize10" id="y56fd28d0-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the temporary closure of an educational institution or the temporary closure or termination of a course or program of education by reason of an emergency situation; and”</content></subparagraph>

<section id="d116140e285" identifier="/us/pl/116/140/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fd28d1-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><heading>EXTENSION OF TIME LIMITATIONS FOR USE OF ENTITLEMENT.</heading><subsection class="firstIndent0 fontsize10" id="y56fdc512-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fdc513-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3031">38 USC 3031 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Montgomery GI Bill</inline>.—</heading><content>During the covered period, the Secretary of Veterans Affairs shall apply <ref href="/us/usc/t38/s3031">section 3031 of title 38, United States Code</ref>, as if it were amended by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y56fdec24-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>In the case of an individual eligible for educational assistance under this chapter who is prevented from pursuing the individual’s chosen program of education before the expiration of the 10-year period for the use of entitlement under this chapter otherwise applicable under this section because the educational institution closed (temporarily or permanently) under an established policy based on an Executive order of the President or due to an emergency situation, such 10-year period—</chapeau><paragraph class="fontsize10" id="y56fdec25-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>shall not run during the period the individual is so prevented from pursuing such program; and</content></paragraph>
<paragraph class="fontsize10" id="y56fdec26-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>shall again begin running on the first day after the individual is able to resume pursuit of a program of education with educational assistance under this chapter.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y56fdec27-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fdec28-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3321">38 USC 3321 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Post-9/11 Educational Assistance</inline>.—</heading><paragraph class="fontsize10" id="y56fdec29-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>During the covered period, the Secretary of Veterans Affairs shall apply section 3321(b)(1) of such title as if it were amended—</chapeau><subparagraph class="fontsize10" id="y56fdec2a-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/b/1/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(A)</quotedText>” before “<quotedText>Subsections</quotedText>”;<page identifier="/us/stat/134/633">134 STAT. 633</page></content></subparagraph>
<subparagraph class="fontsize10" id="y56fdec2b-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/b/1/B" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>and (d)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(d), and (i)</quotedText>”; and by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="indentDown1 fontsize10" id="y56fdec2c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Subsection (i) of section 3031 (as described in section 6 of the Student Veteran Coronavirus Response Act of 2020) shall apply with respect to the running of the 15-year period described in paragraphs (4)(A) and (5)(A) of this subsection in the same manner as such subsection applies under section 3031 with respect to the running of the 10-year period described in section 3031(a).”</content></subparagraph>

<paragraph class="fontsize10" id="y56fdec2d-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fdec2e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3319">38 USC 3319 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Transfer period</inline>.—</heading><chapeau>During the covered period, the Secretary of Veterans Affairs shall apply section 3319(h)(5) of such title as if it were amended—</chapeau><subparagraph class="fontsize10" id="y56fdec2f-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/b/2/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (A) by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or (C)</quotedText>” after “<quotedText>subparagraph (B)</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y56fdec30-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/b/2/B" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y56fe1341-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe1342-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Emergency situations</inline>.—</heading><content>In any case in which the Secretary determines that an individual to whom entitlement is transferred under this section has been prevented from pursuing the individual’s chosen program of education before the individual attains the age of 26 years because the educational institution closed (temporarily or permanently) under an established policy based on an Executive order of the President or due to an emergency situation, the Secretary shall extend the period during which the individual may use such entitlement for a period equal to the number of months that the individual was so prevented from pursuing the program of education, as determined by the Secretary.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y56fe1343-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe1344-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Vocational Rehabilitation and Training</inline>.—</heading><paragraph class="fontsize10" id="y56fe1345-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe1346-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3103">38 USC 3103 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Period for use</inline>.—</heading><chapeau>During the covered period, the Secretary of Veterans affairs shall apply section 3103 of such title as if it were amended—</chapeau><subparagraph class="fontsize10" id="y56fe1347-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/c/1/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>or (e)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(e), or (g)</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y56fe1348-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/c/1/B" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="y56fe1349-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><chapeau>In any case in which the Secretary determines that a veteran has been prevented from participating in a vocational rehabilitation program under this chapter within the twelve-year period of eligibility prescribed in subsection (a) by reason of an Executive order of the President or due to an emergency situation, such twelve-year period—</chapeau><paragraph class="fontsize10" id="y56fe134a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>shall not run during the period the individual is so prevented from participating such program; and</content></paragraph>
<paragraph class="fontsize10" id="y56fe134b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>shall again begin running on the first day after the individual is able to resume participation in such program.”</content></paragraph>

<paragraph class="fontsize10" id="y56fe134c-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe134d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3105">38 USC 3105 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Duration of program</inline>.—</heading><chapeau>During the covered period, the Secretary of Veterans Affairs shall apply section 3105(b) of such title as if it were amended—</chapeau><subparagraph class="fontsize10" id="y56fe134e-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/c/2/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>paragraph (2)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>paragraphs (2) and (3)</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y56fe134f-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/c/2/B" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentDown2 firstIndent0 fontsize10" id="y56fe3a60-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3)</num><subparagraph class="inline" id="y56fe3a61-e829-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><content>In any case in which the Secretary determines that a veteran has been prevented from participating in counseling and placement and postplacement services described in section 3104(a)(2) and (5) of this title by reason of an Executive order of the President or due to an emergency situation, the Secretary <page identifier="/us/stat/134/634">134 STAT. 634</page>
shall extend the period during which the Secretary may provide such counseling and placement and postplacement services for the veteran for a period equal to the number of months that the veteran was so prevented from participating in such counseling and services, as determined by the Secretary.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y56fe3a62-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>In any case in which the Secretary determines that a veteran has been prevented from participating in a vocational rehabilitation program under this chapter by reason of an Executive order of the President or due to an emergency situation, the Secretary shall extend the period of the veteran’s vocational rehabilitation program for a period equal to the number of months that the veteran was so prevented from participating in the vocational rehabilitation program, as determined by the Secretary.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y56fe3a63-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s6/d" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe3a64-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s16133">38 USC 16133 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Educational Assistance for Members of the Selected Reserve</inline>.—</heading><content>During the covered period, the Secretary concerned shall apply <ref href="/us/usc/t10/s16133/b">section 16133(b) of title 10, United States Code</ref>, as if it were amended by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentUp0 firstIndent0 fontsize10" id="y56fe3a65-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>In any case in which the Secretary concerned determines that a person entitled to educational assistance under this chapter has been prevented from using such person’s entitlement by reason of an Executive order of the President or due to an emergency situation, the Secretary concerned shall extend the period of entitlement prescribed in subsection (a) for a period equal to the number of months that the person was so prevented from using such entitlement, as determined by the Secretary.”</content></paragraph>

<section id="d116140e578" identifier="/us/pl/116/140/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe3a66-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><heading>RESTORATION OF ENTITLEMENT TO REHABILITATION PROGRAMS FOR VETERANS AFFECTED BY SCHOOL CLOSURE OR DISAPPROVAL.</heading><subsection class="firstIndent0 fontsize10" id="y56fe6177-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s7/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe8888-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3699">38 USC 3699 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Entitlement</inline>.—</heading><content>During the covered period, the Secretary of Veterans Affairs shall apply <ref href="/us/usc/t38/s3699">section 3699 of title 38, United States Code</ref>, as if it were amended by <amendingAction type="delete">striking</amendingAction> “<quotedText>chapter 30,</quotedText>” each time it appears and <amendingAction type="insert">inserting</amendingAction> “<quotedText>chapter 30, 31,</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y56fe8889-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe888a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3680">38 USC 3680 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Payment of Subsistence Allowances</inline>.—</heading><chapeau>During the covered period, the Secretary of Veterans Affairs shall apply <ref href="/us/usc/t38/s3680/a/2/B">section 3680(a)(2)(B) of title 38, United States Code</ref>, as if it were amended—</chapeau><paragraph class="fontsize10" id="y56fe888b-e829-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/140/s7/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or a subsistence allowance described in section 3108</quotedText>” before “<quotedText>, during</quotedText>”; and</content></paragraph>

<section id="d116140e646" identifier="/us/pl/116/140/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe888d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3108">38 USC 3108 note</ref>.</p></sidenote><heading>EXTENSION OF PAYMENT OF VOCATIONAL REHABILITATION SUBSISTENCE ALLOWANCES.</heading><content style="-uslm-lc:I658120">  In<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x56fe888e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x56fe888f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote> the case of any veteran whom the Secretary of Veterans Affairs determines is satisfactorily following a program of employment services provided under <ref href="/us/usc/t38/s3104/a/5">section 3104(a)(5) of title 38, United States Code</ref>, during the covered period, the Secretary may pay the veteran a subsistence allowance, as prescribed in section 3108 of such title for full-time training for the type of program that the veteran was pursuing, for two additional months.</content></section>
