<section id="d231948e102" identifier="/us/pl/116/137/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">VA Tele-Hearing Modernization Act</shortTitle>”.</content></section>
<section id="d231948e112" identifier="/us/pl/116/137/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>HEARINGS BEFORE THE BOARD OF VETERANS’ APPEALS BY MEANS OF TELECONFERENCE FROM LOCATIONS OTHER THAN FACILITIES OF THE DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="y87a55e09-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t38/s7107/c/2">Section 7107(c)(2) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y87a55e0a-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (A), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or subparagraph (C) of this paragraph</quotedText>” after “<quotedText>subparagraph (B) of such paragraph</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y87a55e0b-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraph (B), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or subparagraph (C) of this paragraph</quotedText>” after “<quotedText>subparagraph (A) of such paragraph</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y87a55e0c-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph (C):<quotedContent><subparagraph class="indentDown1 firstIndent0 fontsize10" id="y87a55e0d-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C)</num><clause class="inline" id="y87a55e0e-e829-11f0-bc57-ad3ac4b1618c"><num value="i">(i) </num><chapeau>Upon notification of a Board hearing under subparagraph (A) or (B) of paragraph (1), the appellant may alternatively request a hearing by picture and voice transmission—</chapeau><subclause class="fontsize10" id="y87a5851f-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>at a location selected by the appellant; and</content></subclause>
<subclause class="fontsize10" id="y87a58520-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>via a secure internet platform established and maintained by the Secretary that protects sensitive personal information from a data breach.</content></subclause>
</clause>
<clause class="indentUp0 firstIndent0 fontsize10" id="y87a58521-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>If an appellant makes a request under clause (i), the Board shall grant such request.”</content></clause>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y87a58522-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87a58523-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7107">38 USC 7107 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Deadline for Implementation</inline>.—</heading><content>The Secretary shall implement the amendments made by subsection (a) not later than 180 days after the date of the enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87a58524-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><paragraph class="fontsize10" id="y87a58525-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Annual reporting requirements</inline>.—</heading><chapeau>Section 7101(d)(2) of such title <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="y87a58526-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (E), by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></subparagraph>
<subparagraph class="fontsize10" id="y87a58527-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (F), by <amendingAction type="delete">striking</amendingAction> the period at the ending and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and<page identifier="/us/stat/134/617">134 STAT. 617</page></content></subparagraph>
<subparagraph class="fontsize10" id="y87a58528-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="indentDown1 fontsize10" id="y87a58529-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><chapeau>with respect to hearings scheduled under section 7107(c)(2)(C) of this title—</chapeau><clause class="fontsize10" id="y87a5852a-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the number of hearings scheduled under such section;</content></clause>
<clause class="fontsize10" id="y87a5852b-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the number of hearings under such section that were cancelled; and</content></clause>
<clause class="fontsize10" id="y87a5852c-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any statistical difference in outcomes between cases heard under such section and those held at the principal location of the Board or by picture and voice transmission at a facility of the Department.”</content></clause>

<paragraph class="fontsize10" id="y87a5852d-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87a5852e-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7101">38 USC 7101 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">One-time reporting requirements</inline>.—</heading><chapeau>The first report required to be submitted under <ref href="/us/usc/t38/s7101/d">section 7101(d) of title 38, United States Code</ref>, shall include the following information with respect to hearings scheduled under subparagraph (C) of paragraph (2) of subsection (c) of section 7101 of such title, as added by subsection (a):</chapeau><subparagraph class="fontsize10" id="y87a5852f-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>An outline of the outreach the Secretary of Veterans Affairs plans to conduct to inform veterans, families of veterans, survivors of veterans, veterans service organizations, military service organizations, congressional caseworkers, advocates for veterans, and such other stakeholders as the Secretary considers appropriate about hearings scheduled under such subparagraph, including—</chapeau><clause class="fontsize10" id="y87a58530-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>a description of the resources required to conduct such outreach;</content></clause>
<clause class="fontsize10" id="y87a58531-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87a58532-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Timeline.</p></sidenote><content>a timeline for conducting such outreach; and</content></clause>
<clause class="fontsize10" id="y87a58533-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>information related to the advantages and potential technological challenges of conducting hearings under such subparagraph.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y87a58534-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87a58535-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Cost estimates.</p><p class="leftAlign firstIndent0 fontsize8" id="x87a58536-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Timeline.</p></sidenote><content>A description of any modifications to the information technology systems of the Veterans Benefits Administration and the Board of Veterans’ Appeals required to carry out hearings under such subparagraph, including cost estimates and a timeline for making such modifications.</content></subparagraph>
<subparagraph class="fontsize10" id="y87a58537-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87a58538-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p><p class="leftAlign firstIndent0 fontsize8" id="x87a58539-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Plan.</p></sidenote><content>A detailed description of the intra-agency partnership between the Board of Veterans’ Appeals and the telehealth program of the Veterans Health Administration as the Board conducts hearings under such subparagraph, including best practices, a risk assessment overview, risk mitigation efforts, and a plan for ongoing collaboration and information sharing.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y87a5853a-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/137/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87a5853b-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p><p class="leftAlign firstIndent0 fontsize8" id="x87a5853c-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7101">38 USC 7101 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Collaboration</inline>.—</heading><content>In developing the capacity and procedures to conduct hearings under subparagraph (C) of paragraph (2) of subsection (c) of <ref href="/us/usc/t38/s7101">section 7101 of title 38, United States Code</ref>, as added by subsection (a), the Secretary of Veterans Affairs shall collaborate with, partner with, and give weight to the advice of <page identifier="/us/stat/134/618">134 STAT. 618</page>
veterans service organizations and such other stakeholders as the Secretary considers appropriate.</content></subsection>
