<section id="d232068e100" identifier="/us/pl/116/135/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Taiwan Allies International Protection and Enhancement Initiative (TAIPEI) Act of 2019</shortTitle>”.</content></section>
<section id="d232068e110" identifier="/us/pl/116/135/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DIPLOMATIC RELATIONS WITH TAIWAN.</heading><subsection class="firstIndent0 fontsize10" id="y90dc5f73-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress makes the following findings:</chapeau><paragraph class="fontsize10" id="y90dc5f74-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The Taiwan Relations Act of 1979 (<ref href="/us/pl/96/8">Public Law 96–8</ref>) states that it is the policy of the United States “to preserve and promote extensive, close, and friendly commercial, cultural, and other relations between the people of the United States and the people on Taiwan”.</content></paragraph>
<paragraph class="fontsize10" id="y90dc5f75-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The Taiwan Relations Act of 1979 states that it is the policy of the United States “to maintain the capacity of the United States to resist any resort to force or other forms of coercion that would jeopardize the security, or the social or economic system, of the people on Taiwan”.</content></paragraph>
<paragraph class="fontsize10" id="y90dc5f76-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Taiwan is a free, democratic, and prosperous nation of 23,000,000 people and an important contributor to peace and stability around the world.</content></paragraph>
<paragraph class="fontsize10" id="y90dc5f77-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Since the election of President Tsai Ing-wen as President of Taiwan in 2016, the Government of the People’s Republic of China has intensified its efforts to pressure Taiwan.</content></paragraph>
<paragraph class="fontsize10" id="y90dc5f78-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Since 2016, the Gambia, Sao Tome and Principe, Panama, the Dominican Republic, Burkina Faso, El Salvador, the Solomon Islands, and Kiribati have severed diplomatic relations with Taiwan in favor of diplomatic relations with China.</content></paragraph>
<paragraph class="fontsize10" id="y90dc5f79-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Taiwan currently maintains full diplomatic relations with 15 nations around the world.</content></paragraph>
<paragraph class="fontsize10" id="y90dc5f7a-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>Taiwan’s unique relationship with the United States, Australia, India, Japan, and other countries are of significant benefit in strengthening Taiwan’s economy and preserving its international space.</content></paragraph>
<paragraph class="fontsize10" id="y90dc5f7b-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>According to President Tsai Ing-wen, the severance of diplomatic ties with Taiwan in favor of diplomatic relations with China is “part of a series of diplomatic and military acts of coercion” by China.</content></paragraph>
<paragraph class="fontsize10" id="y90dc5f7c-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><chapeau>The Asia Reassurance Initiative Act of 2018 (<ref href="/us/pl/115/409">Public Law 115–409</ref>) states that—<page identifier="/us/stat/134/279">134 STAT. 279</page></chapeau><subparagraph class="fontsize10" id="y90dc5f7d-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/9/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>it is United States policy “to support the close economic, political, and security relationship between Taiwan and the United States”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y90dc5f7e-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/9/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>the President should—</chapeau><clause class="fontsize10" id="y90dc5f7f-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/9/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>“conduct regular transfers of defense articles to Taiwan that are tailored to meet the existing and likely future threats from the People’s Republic of China, including supporting the efforts of Taiwan to develop and integrate asymmetric capabilities, as appropriate, including mobile, survivable, and cost-effective capabilities, into its military forces”; and</content></clause>
<clause class="fontsize10" id="y90dc5f80-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s2/a/9/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>“encourage the travel of high-level United States officials to Taiwan, in accordance with the Taiwan Travel Act”.</content></clause>

</section>
<section id="d232068e200" identifier="/us/pl/116/135/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>SENSE OF CONGRESS ON TRADE AND ECONOMIC RELATIONS WITH TAIWAN.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x90dc8691-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y90dc8692-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the United States and Taiwan have built a strong economic partnership, with the United States now Taiwan’s second largest trading partner and with Taiwan the 11th largest trading partner of the United States and a key destination for United States agricultural exports;</content></paragraph>
<paragraph class="fontsize10" id="y90dc8693-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>strong United States-Taiwan economic relations have been a positive factor in stimulating economic growth and job creation for the people of both the United States and Taiwan; and</content></paragraph>
<paragraph class="fontsize10" id="y90dc8694-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the United States Trade Representative should consult with Congress on opportunities for further strengthening bilateral trade and economic relations between the United States and Taiwan.</content></paragraph>

<section id="d232068e223" identifier="/us/pl/116/135/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>POLICY OF THE UNITED STATES WITH REGARD TO TAIWAN’S PARTICIPATION IN INTERNATIONAL ORGANIZATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x90dcada5-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It should be the policy of the United States—</chapeau><paragraph class="fontsize10" id="y90dcada6-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>to advocate, as appropriate—</chapeau><subparagraph class="fontsize10" id="y90dcada7-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s4/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>for Taiwan’s membership in all international organizations in which statehood is not a requirement and in which the United States is also a participant; and</content></subparagraph>
<subparagraph class="fontsize10" id="y90dcada8-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s4/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>for Taiwan to be granted observer status in other appropriate international organizations;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y90dcada9-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to instruct, as appropriate, representatives of the United States Government in all organizations described in paragraph (1) to use the voice, vote, and influence of the United States to advocate for Taiwan’s membership or observer status in such organizations; and</content></paragraph>
<paragraph class="fontsize10" id="y90dcadaa-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s4/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>for the President or the President’s designees to advocate, as appropriate, for Taiwan’s membership or observer status in all organizations described in paragraph (1) as part of any relevant bilateral engagements between the United States and the People’s Republic of China, including leader summits and the U.S.-China Comprehensive Economic Dialogue.</content></paragraph>

<section id="d232068e255" identifier="/us/pl/116/135/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>STRENGTHENING OF TIES WITH TAIWAN.</heading><subsection class="firstIndent0 fontsize10" id="y90dcfbcb-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><chapeau>It is the sense of Congress that the United States Government should—<page identifier="/us/stat/134/280">134 STAT. 280</page></chapeau><paragraph class="fontsize10" id="y90dcfbcc-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>support Taiwan in strengthening its official diplomatic relationships as well as other partnerships with countries in the Indo-Pacific region and around the world;</content></paragraph>
<paragraph class="fontsize10" id="y90dcfbcd-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>consider, in certain cases as appropriate and in alignment with United States interests, increasing its economic, security, and diplomatic engagement with nations that have demonstrably strengthened, enhanced, or upgraded relations with Taiwan; and</content></paragraph>
<paragraph class="fontsize10" id="y90dcfbce-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>consider, in certain cases as appropriate, in alignment with United States foreign policy interests and in consultation with Congress, altering its economic, security, and diplomatic engagement with nations that take serious or significant actions to undermine the security or prosperity of Taiwan.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y90dcfbcf-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x90dcfbd0-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, and annually thereafter for five years, the Secretary of State shall report to the appropriate congressional committees on the steps taken in accordance with subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y90dcfbd1-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s5/c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate Congressional Committees Defined</inline>.—</heading><chapeau>In this section, the term “<term>appropriate congressional committees</term>” means—</chapeau><paragraph class="fontsize10" id="y90dcfbd2-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Foreign Relations, the Committee on Appropriations, and the Committee on Finance of the Senate; and</content></paragraph>
<paragraph class="fontsize10" id="y90dcfbd3-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/135/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Foreign Affairs, the Committee on Appropriations, and the Committee on Ways and Means of the House of Representatives.</content></paragraph>
