<section id="d121786e101" identifier="/us/pl/116/130/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc98cb4a5-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s609">47 USC 609 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Broadband Deployment Accuracy and Technological Availability Act</shortTitle>” or the “<shortTitle role="act">Broadband DATA Act</shortTitle>”.</content></section>
<section id="d121786e119" identifier="/us/pl/116/130/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>BROADBAND DATA.</heading><content class="firstIndent0 fontsize10" id="xc98e8966-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Communications Act of 1934 (<ref href="/us/usc/t47/s151/etseq">47 U.S.C. 151 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><title id="yc99259f7-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658178"><num class="fontsize14 bold" value="VIII">“TITLE VIII—</num><heading class="fontsize14 bold">BROADBAND DATA</heading><section class="centered fontsize12" id="yc9928108-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="801">“SEC. 801. </num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928109-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s641">47 USC 641</ref>.</p></sidenote>DEFINITIONS.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “In this title:</chapeau><paragraph class="fontsize10" id="yc992810a-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Broadband internet access service</inline>.—</heading><content>The term ‘<term>broadband internet access service</term>’ has the meaning given the term in <ref href="/us/cfr/t47/s8.1/b">section 8.1(b) of title 47, Code of Federal Regulations</ref>, or any successor regulation.</content></paragraph>
<paragraph class="fontsize10" id="yc992810b-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Broadband map</inline>.—</heading><content>The term ‘<term>Broadband Map</term>’ means the map created by the Commission under section 802(c)(1)(A).</content></paragraph>
<paragraph class="fontsize10" id="yc992810c-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Cell edge probability</inline>.—</heading><content>The term ‘<term>cell edge probability</term>’ means the likelihood that the minimum threshold download and upload speeds with respect to broadband internet access service will be met or exceeded at a distance from a base station that is intended to indicate the ultimate edge of the coverage area of a cell.</content></paragraph>
<paragraph class="fontsize10" id="yc992810d-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Cell loading</inline>.—</heading><content>The term ‘<term>cell loading</term>’ means the percentage of the available air interface resources of a base station that are used by consumers with respect to broadband internet access service.</content></paragraph>
<paragraph class="fontsize10" id="yc992810e-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Clutter</inline>.—</heading><content>The term ‘<term>clutter</term>’ means a natural or man-made surface feature that affects the propagation of a signal from a base station.</content></paragraph>
<paragraph class="fontsize10" id="yc992810f-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Fabric</inline>.—</heading><content>The term ‘<term>Fabric</term>’ means the Broadband Serviceable Location Fabric established under section 802(b)(1)(B).</content></paragraph>
<paragraph class="fontsize10" id="yc9928110-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Form 477</inline>.—</heading><content>The term ‘<term>Form 477</term>’ means Form 477 of the Commission relating to local telephone competition and broadband reporting.<page identifier="/us/stat/134/229">134 STAT. 229</page></content></paragraph>
<paragraph class="fontsize10" id="yc9928111-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Indian tribe</inline>.—</heading><content>The term ‘<term>Indian Tribe</term>’ has the meaning given the term ‘<term>Indian tribe</term>’ in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yc9928112-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Mobility fund phase ii</inline>.—</heading><content>The term ‘<term>Mobility Fund Phase II</term>’ means the second phase of the proceeding to provide universal service support from the Mobility Fund (WC Docket No. 10–90; WT Docket No. 10–208).</content></paragraph>
<paragraph class="fontsize10" id="yc9928113-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><heading class="fontsize10"><inline class="smallCaps">Propagation model</inline>.—</heading><content>The term ‘<term>propagation model</term>’ means a mathematical formulation for the characterization of radio wave propagation as a function of frequency, distance, and other conditions.</content></paragraph>
<paragraph class="fontsize10" id="yc9928114-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><heading class="fontsize10"><inline class="smallCaps">Provider</inline>.—</heading><content>The term ‘<term>provider</term>’ means a provider of fixed or mobile broadband internet access service.</content></paragraph>
<paragraph class="fontsize10" id="yc9928115-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12) </num><heading class="fontsize10"><inline class="smallCaps">Quality of service</inline>.—</heading><content>The term ‘<term>quality of service</term>’ means, with respect to broadband internet access service, the download and upload speeds (and, for relevant services, latency) with respect to that service, as determined by, and to the extent otherwise collected by, the Commission.</content></paragraph>
<paragraph class="fontsize10" id="yc9928116-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">“(13) </num><heading class="fontsize10"><inline class="smallCaps">Shapefile</inline>.—</heading><chapeau>The term ‘<term>shapefile</term>’ means a digital storage format containing geospatial or location-based data and attribute information—</chapeau><subparagraph class="fontsize10" id="yc9928117-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>regarding the availability of broadband internet access service; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc9928118-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>that can be viewed, edited, and mapped in geographic information system software.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc9928119-e829-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">“(14) </num><heading class="fontsize10"><inline class="smallCaps">Standard broadband installation</inline>.—</heading><chapeau>The term ‘<term>standard broadband installation</term>’—</chapeau><subparagraph class="fontsize10" id="yc992811a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>means the initiation by a provider of fixed broadband internet access service in an area in which the provider has not previously offered that service, with no charges or delays attributable to the extension of the network of the provider; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992811b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>includes the initiation of fixed broadband internet access service through routine installation that can be completed not later than 10 business days after the date on which the service request is submitted.</content></subparagraph>
</paragraph>
</section>
<section class="centered fontsize12" id="yc992811c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="802">“SEC. 802. </num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992811d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s642">47 USC 642</ref>.</p></sidenote>BROADBAND MAPS.</heading><subsection class="firstIndent0 fontsize10" id="yc992811e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Rules</inline>.—</heading><paragraph class="fontsize10" id="yc992811f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928120-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this title, the Commission shall issue final rules that shall—</chapeau><subparagraph class="fontsize10" id="yc9928121-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928122-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Requirements.</p><p class="leftAlign firstIndent0 fontsize8" id="xc9928123-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><chapeau>require the biannual collection and dissemination of granular data, as determined by the Commission—</chapeau><clause class="fontsize10" id="yc9928124-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>relating to the availability and quality of service with respect to terrestrial fixed, fixed wireless, satellite, and mobile broadband internet access service; and</content></clause>
<clause class="fontsize10" id="yc9928125-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928126-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><content>that the Commission shall use to compile the maps created under subsection (c)(1) (referred to in this section as ‘coverage maps’), which the Commission shall make publicly available; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc9928127-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>establish—</chapeau><clause class="fontsize10" id="yc9928128-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>processes through which the Commission can verify the accuracy of data submitted under subsection (b)(2);<page identifier="/us/stat/134/230">134 STAT. 230</page></content></clause>
<clause class="fontsize10" id="yc9928129-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992812a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p></sidenote><chapeau>processes and procedures through which the Commission, and, as necessary, other entities or individuals submitting non-public or competitively sensitive information under this title, can protect the security, privacy, and confidentiality of that non-public or competitively sensitive information, including—</chapeau><subclause class="fontsize10" id="yc992812b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>information contained in the Fabric;</content></subclause>
<subclause class="fontsize10" id="yc992812c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the dataset created under subsection (b)(1)(A) supporting the Fabric; and</content></subclause>
<subclause class="fontsize10" id="yc992812d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>the data submitted under subsection (b)(2);</content></subclause>
</clause>
<clause class="fontsize10" id="yc992812e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the challenge process described in subsection (b)(5); and</content></clause>
<clause class="fontsize10" id="yc992812f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>the process described in section 804(b).</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc9928130-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Other data</inline>.—</heading><chapeau>In issuing the rules under paragraph (1), the Commission shall develop a process through which the Commission can collect verified data for use in the coverage maps from—</chapeau><subparagraph class="fontsize10" id="yc9928131-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>State, local, and Tribal governmental entities that are primarily responsible for mapping or tracking broadband internet access service coverage for a State, unit of local government, or Indian Tribe, as applicable;</content></subparagraph>
<subparagraph class="fontsize10" id="yc9928132-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928133-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><chapeau>third parties, if the Commission determines that it is in the public interest to use such data in—</chapeau><clause class="fontsize10" id="yc9928134-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the development of the coverage maps; or</content></clause>
<clause class="fontsize10" id="yc9928135-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the verification of data submitted under subsection (b); and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc9928136-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>other Federal agencies.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc9928137-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Updates</inline>.—</heading><chapeau>The Commission shall revise the rules issued under paragraph (1) to—</chapeau><subparagraph class="fontsize10" id="yc9928138-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>reflect changes in technology;</content></subparagraph>
<subparagraph class="fontsize10" id="yc9928139-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>ensure the accuracy of propagation models, as further provided in subsection (b)(3); and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992813a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>improve the usefulness of the coverage maps.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc992813b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Content of Rules</inline>.—</heading><paragraph class="fontsize10" id="yc992813c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Establishment of a serviceable location fabric regarding fixed broadband</inline>.—</heading><subparagraph class="fontsize10" id="yc992813d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Dataset</inline>.—</heading><clause class="fontsize10" id="yc992813e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992813f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>The Commission shall create a common dataset of all locations in the United States where fixed broadband internet access service can be installed, as determined by the Commission.</content></clause>
<clause class="fontsize10" id="yc9928140-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Contracting</inline>.—</heading><subclause class="fontsize10" id="yc9928141-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to subclauses (II) and (III), the Commission may contract with an entity with expertise with respect to geographic information systems (referred to in this subsection as ‘GIS’) to create and maintain the dataset under clause (i).</content></subclause>
<subclause class="fontsize10" id="yc9928142-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Application of the federal acquisition regulation</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928143-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Compliance.</p></sidenote>A contract into which the Commission enters under subclause (I) shall in all respects comply with applicable provisions of the Federal Acquisition Regulation.</content></subclause>
<subclause class="fontsize10" id="yc9928144-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><chapeau>With respect to a contract into which the Commission enters under subclause (I)—</chapeau><page identifier="/us/stat/134/231">134 STAT. 231</page>
<item class="fontsize10" id="yc9928145-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the entity with which the Commission enters into the contract shall be selected through a competitive bid process that is transparent and open; and</content></item>
<item class="fontsize10" id="yc9928146-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928147-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote>the contract shall be for a term of not longer than 5 years, after which the Commission may enter into a new contract—</chapeau><subitem class="fontsize10" id="yc9928148-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="AA">“(AA) </num><content>with an entity, and for the purposes, described in clause (i); and</content></subitem>
<subitem class="fontsize10" id="yc9928149-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="BB">“(BB) </num><content>that complies with the requirements under subclause (II) and this subclause; and</content></subitem>
</item>
<item class="fontsize10" id="yc992814a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><chapeau>the contract shall—</chapeau><subitem class="fontsize10" id="yc992814b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="AA">“(AA) </num><content>prohibit the entity described in item (aa) from selling, leasing, or otherwise disclosing for monetary consideration any personally identifiable information to any other entity other than for purposes authorized under this title; and</content></subitem>
<subitem class="fontsize10" id="yc992814c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="BB">“(BB) </num><content>require the entity described in item (aa) to include in any contract with any other entity a provision that prohibits that other entity from engaging in an action that is prohibited under subitem (AA).</content></subitem>

</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc992814d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Fabric</inline>.—</heading><chapeau>The rules issued by the Commission under subsection (a)(1) shall establish the Broadband Serviceable Location Fabric, which shall—</chapeau><clause class="fontsize10" id="yc992814e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>contain geocoded information for each location identified under subparagraph (A)(i);</content></clause>
<clause class="fontsize10" id="yc992814f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928150-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><content>serve as the foundation upon which all data relating to the availability of fixed broadband internet access service collected under paragraph (2)(A) shall be reported and overlaid;</content></clause>
<clause class="fontsize10" id="yc9928151-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>be compatible with commonly used GIS software; and</content></clause>
<clause class="fontsize10" id="yc9928152-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928153-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Updates.</p><p class="leftAlign firstIndent0 fontsize8" id="xc9928154-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>at a minimum, be updated every 6 months by the Commission.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc9928155-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Implementation priority</inline>.—</heading><content>The Commission shall prioritize implementing the Fabric for rural and insular areas of the United States.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc9928156-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Collection of information</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9928157-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Standards.</p></sidenote>The rules issued by the Commission under subsection (a)(1) shall include uniform standards for the reporting of broadband internet access service data that the Commission shall collect—</chapeau><subparagraph class="fontsize10" id="yc9928158-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>from each provider of terrestrial fixed, fixed wireless, or satellite broadband internet access service, which shall include data that—</chapeau><clause class="fontsize10" id="yc9928159-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>documents the areas where the provider—</chapeau><subclause class="fontsize10" id="yc992815a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>has actually built out the broadband network infrastructure of the provider such that the provider is able to provide that service; and</content></subclause>
<subclause class="fontsize10" id="yc992815b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>could provide that service, as determined by identifying where the provider is capable of performing a standard broadband installation, if applicable;<page identifier="/us/stat/134/232">134 STAT. 232</page></content></subclause>
</clause>
<clause class="fontsize10" id="yc992815c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>includes information regarding download and upload speeds, at various thresholds established by the Commission, and, if applicable, latency with respect to broadband internet access service that the provider makes available;</content></clause>
<clause class="fontsize10" id="yc992815d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>can be georeferenced to the GIS data in the Fabric;</content></clause>
<clause class="fontsize10" id="yc992815e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992815f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><chapeau>the provider shall report as—</chapeau><subclause class="fontsize10" id="yc992a770-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><chapeau>with respect to providers of fixed wireless broadband internet access service—</chapeau><item class="fontsize10" id="yc992a771-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><chapeau>propagation maps and propagation model details that—</chapeau><subitem class="fontsize10" id="yc992a772-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="AA">“(AA) </num><content>satisfy standards that are similar to those applicable to providers of mobile broadband internet access service under subparagraph (B) with respect to propagation maps and propagation model details, taking into account material differences between fixed wireless and mobile broadband internet access service; and</content></subitem>
<subitem class="fontsize10" id="yc992a773-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="BB">“(BB) </num><content>reflect the speeds and latency of the service provided by the provider; or</content></subitem>
</item>
<item class="fontsize10" id="yc992a774-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a775-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Lists.</p></sidenote><chapeau>a list of addresses or locations that constitute the service area of the provider, except that the Commission—</chapeau><subitem class="fontsize10" id="yc992a776-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="AA">“(AA) </num><content>may only permit, and not require, a provider to report the data using that means of reporting; and</content></subitem>
<subitem class="fontsize10" id="yc992a777-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="BB">“(BB) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a778-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Methodologies.</p></sidenote><content>in the rules issued under subsection (a)(1), shall provide a method for using that means of reporting with respect to Tribal areas; and</content></subitem>
</item>
</subclause>
<subclause class="fontsize10" id="yc992a779-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><chapeau>with respect to providers of terrestrial fixed and satellite broadband internet access service—</chapeau><item class="fontsize10" id="yc992a77a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>polygon shapefiles; or</content></item>
<item class="fontsize10" id="yc992a77b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a77c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Lists.</p></sidenote><chapeau>a list of addresses or locations that constitute the service area of the provider, except that the Commission—</chapeau><subitem class="fontsize10" id="yc992a77d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="AA">“(AA) </num><content>may only permit, and not require, a provider to report the data using that means of reporting; and</content></subitem>
<subitem class="fontsize10" id="yc992a77e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="BB">“(BB) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a77f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Methodologies.</p></sidenote><content>in the rules issued under subsection (a)(1), shall provide a method for using that means of reporting with respect to Tribal areas; and</content></subitem>

</subclause>
</clause>
<clause class="fontsize10" id="yc992a780-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a781-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the Commission determines is appropriate with respect to certain technologies in order to ensure that the Broadband Map is granular and accurate; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc992a782-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>from each provider of mobile broadband internet access service, which shall include propagation maps and propagation model details that indicate the current (as of the date on which the information is collected) fourth generation Long-Term Evolution (commonly referred to as <page identifier="/us/stat/134/233">134 STAT. 233</page>
‘4G LTE’) mobile broadband internet access service coverage of the provider, which shall—</chapeau><clause class="fontsize10" id="yc992a783-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>take into consideration the effect of clutter; and</content></clause>
<clause class="fontsize10" id="yc992a784-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>satisfy—</chapeau><subclause class="fontsize10" id="yc992a785-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><chapeau>the requirements of having—</chapeau><item class="fontsize10" id="yc992a786-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>a download speed of not less than 5 megabits per second and an upload speed of not less than 1 megabit per second with a cell edge probability of not less than 90 percent; and</content></item>
<item class="fontsize10" id="yc992a787-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>cell loading of not less than 50 percent; and</content></item>
</subclause>
<subclause class="fontsize10" id="yc992a788-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>any other parameter that the Commission determines to be necessary to create a map under subsection (c)(1)(C) that is more precise than the map produced as a result of the submissions under the Mobility Fund Phase II information collection.</content></subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc992a789-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Update of reporting standards for mobile broadband internet access service</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a78a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>For the purposes of paragraph (2)(B), if the Commission determines that the reporting standards under that paragraph are insufficient to collect accurate propagation maps and propagation model details with respect to future generations of mobile broadband internet access service technologies, the Commission shall immediately commence a rule making to adopt new reporting standards with respect to those technologies that—</chapeau><subparagraph class="fontsize10" id="yc992a78b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>shall be the functional equivalent of the standards required under paragraph (2)(B); and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992a78c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>allow for the collection of propagation maps and propagation model details that are as accurate and granular as, or more accurate and granular than, the maps and model details collected by the Commission under paragraph (2)(B).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc992a78d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Certification and verification</inline>.—</heading><chapeau>With respect to a provider that submits information to the Commission under paragraph (2)—</chapeau><subparagraph class="fontsize10" id="yc992a78e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the provider shall include in each submission a certification from a corporate officer of the provider that the officer has examined the information contained in the submission and that, to the best of the officer’s actual knowledge, information, and belief, all statements of fact contained in the submission are true and correct; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992a78f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Commission shall verify the accuracy and reliability of the information in accordance with measures established by the Commission.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc992a790-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Challenge process</inline>.—</heading><subparagraph class="fontsize10" id="yc992a791-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In the rules issued under subsection (a), and subject to subparagraph (B), the Commission shall establish a user-friendly challenge process through which consumers, State, local, and Tribal governmental entities, and other entities or individuals may submit coverage data to the Commission to challenge the accuracy of—</chapeau><clause class="fontsize10" id="yc992a792-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the coverage maps;</content></clause>
<clause class="fontsize10" id="yc992a793-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any information submitted by a provider regarding the availability of broadband internet access service; or<page identifier="/us/stat/134/234">134 STAT. 234</page></content></clause>
<clause class="fontsize10" id="yc992a794-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the information included in the Fabric.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc992a795-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Considerations; verification; response to challenges</inline>.—</heading><chapeau>In establishing the challenge process required under subparagraph (A), the Commission shall—</chapeau><clause class="fontsize10" id="yc992a796-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>consider—</chapeau><subclause class="fontsize10" id="yc992a797-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the types of information that an entity or individual submitting a challenge should provide to the Commission in support of the challenge;</content></subclause>
<subclause class="fontsize10" id="yc992a798-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the appropriate level of granularity for the information described in subclause (I);</content></subclause>
<subclause class="fontsize10" id="yc992a799-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><chapeau>the need to mitigate the time and expense incurred by, and the administrative burdens placed on, entities or individuals in—</chapeau><item class="fontsize10" id="yc992a79a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>challenging the accuracy of a coverage map; and</content></item>
<item class="fontsize10" id="yc992a79b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>responding to challenges described in item (aa);</content></item>
</subclause>
<subclause class="fontsize10" id="yc992a79c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>the costs to consumers and providers resulting from a misallocation of funds because of a reliance on outdated or otherwise inaccurate information in the coverage maps;</content></subclause>
<subclause class="fontsize10" id="yc992a79d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>any lessons learned from the challenge process established under Mobility Fund Phase II, as determined from comments solicited by the Commission; and</content></subclause>
<subclause class="fontsize10" id="yc992a79e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">“(VI) </num><content>the need for user-friendly challenge submission formats that will promote participation in the challenge process;</content></subclause>
</clause>
<clause class="fontsize10" id="yc992a79f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>include a process for verifying the data submitted through the challenge process in order to ensure the reliability of that data;</content></clause>
<clause class="fontsize10" id="yc992a7a0-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>allow providers to respond to challenges submitted through the challenge process; and</content></clause>
<clause class="fontsize10" id="yc992a7a1-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><chapeau>develop an online mechanism, which—</chapeau><subclause class="fontsize10" id="yc992a7a2-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>shall be integrated into the coverage maps;</content></subclause>
<subclause class="fontsize10" id="yc992a7a3-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>allows for an entity described in subparagraph (A) to submit a challenge under the challenge process;</content></subclause>
<subclause class="fontsize10" id="yc992a7a4-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>makes challenge data available in both geographic information system and non-geographic information system formats; and</content></subclause>
<subclause class="fontsize10" id="yc992a7a5-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>clearly identifies the areas in which broadband internet access service is available, and the upload and download speeds at which that service is available, as reported to the Commission under this section.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc992a7a6-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Use of challenges</inline>.—</heading><chapeau>The rules issued to establish the challenge process under subparagraph (A) shall include—</chapeau><clause class="fontsize10" id="yc992a7a7-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a process for the speedy resolution of challenges; and</content></clause>
<clause class="fontsize10" id="yc992a7a8-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a process for the regular and expeditious updating of the coverage maps and granular data disseminated by the Commission as challenges are resolved.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc992a7a9-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Report to congress</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a7aa-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notice.</p><p class="leftAlign firstIndent0 fontsize8" id="xc992a7ab-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote>Not earlier than 1 year, and not later than 18 months, after the date on which <page identifier="/us/stat/134/235">134 STAT. 235</page>
the rules issued under subsection (a)(1) take effect, the Commission shall, after an opportunity for notice and comment, submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that—</chapeau><clause class="fontsize10" id="yc992a7ac-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a7ad-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>evaluates the challenge process described in subparagraph (A); and</content></clause>
<clause class="fontsize10" id="yc992a7ae-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>considers whether the Commission should commence an inquiry on the need for other tools to help—</chapeau><subclause class="fontsize10" id="yc992a7af-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>identify potential inaccuracies in the data relating to broadband internet access service that providers report; and</content></subclause>
<subclause class="fontsize10" id="yc992a7b0-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>improve the accuracy of the data described in subclause (I).</content></subclause>

</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc992a7b1-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Reform of form 477 process</inline>.—</heading><subparagraph class="fontsize10" id="yc992a7b2-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a7b3-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 180 days after the date on which the rules issued under subsection (a) take effect, the Commission shall—</chapeau><clause class="fontsize10" id="yc992a7b4-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>reform the Form 477 broadband deployment service availability collection process of the Commission—</chapeau><subclause class="fontsize10" id="yc992a7b5-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>to achieve the purposes of this title; and</content></subclause>
<subclause class="fontsize10" id="yc992a7b6-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><chapeau>in a manner that—</chapeau><item class="fontsize10" id="yc992a7b7-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>enables the comparison of data and maps produced before the implementation of this title with data and coverage maps produced after the implementation of this title; and</content></item>
<item class="fontsize10" id="yc992a7b8-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>maintains the public availability of data relating to the deployment of broadband internet access service; and</content></item>
</subclause>
</clause>
<clause class="fontsize10" id="yc992a7b9-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a7ba-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p></sidenote><content>harmonize reporting requirements and procedures regarding the deployment of broadband internet access service that are in effect on the day before the date on which the rules issued under subsection (a)(1) take effect with those requirements and procedures in those rules.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc992a7bb-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a7bc-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Continued collection and reporting</inline>.—</heading><content>On and after the date on which the Commission carries out subparagraph (A), the Commission shall continue to collect and publicly report subscription data that the Commission collected through the Form 477 broadband deployment service availability process, as in effect on July 1, 2019.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc992a7bd-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Sharing data with ntia</inline>.—</heading><content>The Commission shall establish a process to make the data collected under paragraph (2) available to the National Telecommunications and Information Administration.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc992a7be-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Maps</inline>.—</heading><chapeau>The Commission shall—</chapeau><paragraph class="fontsize10" id="yc992a7bf-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a7c0-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><chapeau>after consultation with the Federal Geographic Data Committee established under section 753(a) of the Geospatial Data Act of 2018, create—</chapeau><subparagraph class="fontsize10" id="yc992a7c1-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the Broadband Map, which shall depict—</chapeau><clause class="fontsize10" id="yc992a7c2-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the extent of the availability of broadband internet access service in the United States, without <page identifier="/us/stat/134/236">134 STAT. 236</page>
regard to whether that service is fixed broadband internet access service or mobile broadband internet access service, which shall be based on data collected by the Commission from all providers; and</content></clause>
<clause class="fontsize10" id="yc992a7c3-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the areas of the United States that remain unserved by providers;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc992a7c4-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a map that depicts the availability of fixed broadband internet access service, which shall be based on data collected by the Commission from providers under subsection (b)(2)(A); and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992a7c5-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a map that depicts the availability of mobile broadband internet access service, which shall be based on data collected by the Commission from providers under subsection (b)(2)(B);</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc992a7c6-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>after creating the maps under paragraph (1), use such maps—</chapeau><subparagraph class="fontsize10" id="yc992a7c7-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a7c8-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>to determine the areas in which terrestrial fixed, fixed wireless, mobile, and satellite broadband internet access service is and is not available; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992a7c9-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>when making any new award of funding with respect to the deployment of broadband internet access service intended for use by residential and mobile customers;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc992a7ca-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>update the maps created under paragraph (1) not less frequently than biannually using the most recent data collected from providers under subsection (b)(2);</content></paragraph>
<paragraph class="fontsize10" id="yc992a7cb-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992a7cc-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><chapeau>consult with—</chapeau><subparagraph class="fontsize10" id="yc992a7cd-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Secretary of Agriculture to enable the Secretary of Agriculture to consult the maps created under paragraph (1) when considering the awarding of funds for the deployment of broadband internet access service under any program administered by the Administrator of the Rural Utilities Service; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992a7ce-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the National Telecommunications and Information Administration to enable the Administration to consult the maps created under paragraph (1) when considering the awarding of funds for the deployment of broadband internet access service under any future program administered by the Administration;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc992cedf-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>make available to any Federal agency, upon request, the maps created under paragraph (1); and</content></paragraph>
<paragraph class="fontsize10" id="yc992cee0-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><chapeau>make public at an appropriate level of granularity—</chapeau><subparagraph class="fontsize10" id="yc992cee1-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the maps created under paragraph (1); and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992cee2-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the data collected by the Commission with respect to the availability of broadband internet access service and the quality of service with respect to broadband internet access service.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cee3-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Delayed Effective Date for Quality of Service Rules</inline>.—</heading><content>Any requirement of a rule issued under subsection (a)(1) that relates to quality of service shall take effect not earlier than the date that is 180 days after the date on which the Commission issues that rule.</content></subsection>
</section>
<section class="centered fontsize12" id="yc992cee4-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="803">“SEC. 803. </num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992cee5-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s643">47 USC 643</ref>.</p></sidenote>ENFORCEMENT.</heading><content class="indentUp0 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “It shall be unlawful for an entity or individual to willfully and knowingly, or recklessly, submit information or data under this title that is materially inaccurate or incomplete with respect <page identifier="/us/stat/134/237">134 STAT. 237</page>
to the availability of broadband internet access service or the quality of service with respect to broadband internet access service.</content></section>
<section class="centered fontsize12" id="yc992cee6-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="804">“SEC. 804. </num><heading class="fontsize12">IMPROVING DATA ACCURACY.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992cee7-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s644">47 USC 644</ref>.</p></sidenote></heading><subsection class="firstIndent0 fontsize10" id="yc992cee8-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Audits</inline>.—</heading><content>The Commission shall conduct regular audits of information submitted to the Commission by providers under section 802(b)(2) to ensure that the providers are complying with this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cee9-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Crowdsourcing</inline>.—</heading><paragraph class="fontsize10" id="yc992ceea-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Commission shall develop a process through which entities or individuals in the United States may submit specific information about the deployment and availability of broadband internet access service in the United States on an ongoing basis so that the information may be used to verify and supplement information provided by providers of broadband internet access service for inclusion in the maps created under section 802(c)(1).</content></paragraph>
<paragraph class="fontsize10" id="yc992ceeb-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992ceec-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p><p class="leftAlign firstIndent0 fontsize8" id="xc992ceed-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Collaboration</inline>.—</heading><chapeau>As part of the efforts of the Commission to facilitate the ability of entities and individuals to submit information under paragraph (1), the Commission shall—</chapeau><subparagraph class="fontsize10" id="yc992ceee-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>prioritize the consideration of data provided by data collection applications used by consumers that the Commission has determined—</chapeau><clause class="fontsize10" id="yc992ceef-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>are highly reliable; and</content></clause>
<clause class="fontsize10" id="yc992cef0-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>have proven methodologies for determining network coverage and network performance;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc992cef1-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>not later than 1 year after the date of enactment of this title, conclude a process that tests the feasibility of partnering with Federal agencies that operate delivery fleet vehicles, including the United States Postal Service, to facilitate the collection and submission of information described in that paragraph; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992cef2-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992cef3-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p><p class="leftAlign firstIndent0 fontsize8" id="xc992cef4-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><chapeau>not later than 14 months after the date of enactment of this title, publish on the website of the Commission, and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives, a report regarding the testing described in subparagraph (B), which shall include—</chapeau><clause class="fontsize10" id="yc992cef5-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a determination regarding whether the partnerships with Federal agencies described in that subparagraph are able to facilitate the collection and submission of information described in paragraph (1); and</content></clause>
<clause class="fontsize10" id="yc992cef6-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any steps that the Commission plans to take to facilitate the partnerships described in that subparagraph.</content></clause>

</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cef7-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Technical Assistance to Indian Tribes</inline>.—</heading><paragraph class="fontsize10" id="yc992cef8-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992cef9-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Workshops.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to paragraph (2), the Commission shall hold workshops for Tribal Governments in each of the 12 Bureau of Indian Affairs regions to provide technical assistance with the collection and submission of data under section 802(a)(2).</content></paragraph>
<paragraph class="fontsize10" id="yc992cefa-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Annual review</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992cefb-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>—</heading><content>Each year, the Commission, in consultation with Indian Tribes, shall review the need for continued workshops required under paragraph (1).<page identifier="/us/stat/134/238">134 STAT. 238</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cefc-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Technical Assistance to Small Service Providers</inline>.—</heading><content>The Commission shall establish a process through which a provider that has fewer than 100,000 active broadband internet access service connections may request and receive assistance from the Commission with respect to geographic information system data processing to ensure that the provider is able to comply with the requirements under section 802(b) in a timely and accurate manner.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cefd-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Technical Assistance to State, Local, and Tribal Governments and Consumers</inline>.—</heading><chapeau>The Commission shall provide technical assistance to consumers and State, local, and Tribal governmental entities with respect to the challenge process established under section 802(b)(5), which shall include—</chapeau><paragraph class="fontsize10" id="yc992cefe-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>detailed tutorials and webinars; and</content></paragraph>
<paragraph class="fontsize10" id="yc992ceff-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the provision of staff of the Commission to provide assistance, as needed, throughout the entirety of the challenge process.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cf00-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">GAO Assessment of Fabric Source Data</inline>.—</heading><paragraph class="fontsize10" id="yc992cf01-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992cf02-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xc992cf03-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Comptroller General of the United States shall conduct an assessment of key data sources that are used for purposes of the Fabric to identify and geocode locations where fixed broadband internet access service can be installed in order for the Comptroller General to develop recommendations for how the quality and completeness of those data sources can be improved as data sources for the Fabric.</content></paragraph>
<paragraph class="fontsize10" id="yc992cf04-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Sources included</inline>.—</heading><chapeau>For the purposes of the assessment conducted under paragraph (1), the key data sources described in that paragraph shall include—</chapeau><subparagraph class="fontsize10" id="yc992cf05-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>any relevant sources of Federal data, including the National Address Database administered by the Department of Transportation;</content></subparagraph>
<subparagraph class="fontsize10" id="yc992cf06-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>State- and county-level digitized parcel data; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc992cf07-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>property tax attribute recording.</content></subparagraph>

<paragraph class="fontsize10" id="yc992cf08-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 1 year after the date of enactment of this title, the Comptroller General of the United States shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that contains the recommendations developed under paragraph (1).</content></paragraph>

<section class="centered fontsize12" id="yc992cf09-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="805">“SEC. 805. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992cf0a-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s645">47 USC 645</ref>.</p></sidenote><heading class="fontsize12">COST.</heading><subsection class="firstIndent0 fontsize10" id="yc992cf0b-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">USF</inline>.—</heading><content>The Commission may not use funds from the universal service programs of the Commission established under section 254, and the regulations issued under that section, to pay for any costs associated with this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cf0c-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Other Funds</inline>.—</heading><content>The Commission may recover costs associated with this title under section 9 to the extent provided for in an appropriation Act, as required under subsection (a) of that section.</content></subsection>

<section class="centered fontsize12" id="yc992cf0d-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="806">“SEC. 806. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc992cf0e-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s646">47 USC 646</ref>.</p></sidenote><heading class="fontsize12">OTHER PROVISIONS.</heading><subsection class="firstIndent0 fontsize10" id="yc992cf0f-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">OMB</inline>.—</heading><content>Notwithstanding any other provision of law, the initial rule making required under section 802(a)(1) shall be exempt from review by the Office of Management and Budget.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cf10-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">PRA</inline>.—</heading><content><ref href="/us/usc/t44/ch35/schI">Subchapter I of chapter 35 of title 44, United States Code</ref> (commonly known as the ‘Paperwork Reduction Act’) shall not apply to the initial rule making required under section 802(a)(1).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cf11-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Execution of Responsibilities</inline>.—</heading><chapeau>Except, with respect to an entity that is not the Universal Service Administrative Company, <page identifier="/us/stat/134/239">134 STAT. 239</page>
as provided in section 802(a)(2)(B), section 802(b)(1)(A)(ii), and subsections (c), (d), and (e) of section 804, the Commission—</chapeau><paragraph class="fontsize10" id="yc992cf12-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>including the offices of the Commission, shall carry out the responsibilities assigned to the Commission under this title; and</content></paragraph>
<paragraph class="fontsize10" id="yc992cf13-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>may not delegate any of the responsibilities assigned to the Commission under this title to any third party, including the Universal Service Administrative Company.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cf14-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><content>Each fiscal year, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that summarizes the implementation of this title and associated enforcement activities conducted during the previous fiscal year.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc992cf15-e829-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>If the Commission, before the date of enactment of this title, has taken an action that, in whole or in part, implements this title, the Commission shall not be required to revisit such action to the extent that such action is consistent with this title.”</content></subsection>
