<section id="d233268e92" identifier="/us/pl/116/129/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Secure 5G and Beyond Act of 2020</shortTitle>”.</content></section>
<section id="d233268e102" identifier="/us/pl/116/129/s2" role="definitions" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>APPROPRIATE COMMITTEES OF CONGRESS DEFINED.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe570e6f3-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act, the term “<term>appropriate committees of Congress</term>” means—</chapeau><paragraph class="fontsize10" id="ye570e6f4-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Select Committee on Intelligence, the Committee on Commerce, Science, and Transportation, the Committee on Foreign Relations, the Committee on Armed Services, and the Committee on Homeland Security and Governmental Affairs of the Senate; and</content></paragraph>
<paragraph class="fontsize10" id="ye570e6f5-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Permanent Select Committee on Intelligence, the Committee on Energy and Commerce, the Committee on Foreign Affairs, the Committee on Armed Services, and the Committee on Homeland Security of the House of Representatives.</content></paragraph>
</section>
<section id="d233268e119" identifier="/us/pl/116/129/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>STRATEGY TO ENSURE SECURITY OF NEXT GENERATION WIRELESS COMMUNICATIONS SYSTEMS AND INFRASTRUCTURE.</heading><subsection class="firstIndent0 fontsize10" id="ye5715c26-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Strategy Required</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe5715c27-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xe5715c28-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote>—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, the President, in consultation with the Chairman of the Federal Communications Commission, the Secretary of Commerce, the Assistant Secretary of Commerce for Communications and Information, the Secretary of Homeland Security, the Director of National Intelligence, the Attorney General, the Secretary of State, the Secretary of Energy, and the Secretary of Defense, and consistent with the protection of national security information, shall develop and submit to the appropriate committees of Congress a strategy—</chapeau><paragraph class="fontsize10" id="ye5715c29-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to ensure the security of 5th and future generations wireless communications systems and infrastructure within the United States;</content></paragraph>
<paragraph class="fontsize10" id="ye5715c2a-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to provide technical assistance to mutual defense treaty allies of the United States, strategic partners of the United States, and other countries, when in the security and strategic interests of the United States, to maximize the security of <page identifier="/us/stat/134/224">134 STAT. 224</page>
5th and future generations wireless communications systems and infrastructure inside their countries; and</content></paragraph>
<paragraph class="fontsize10" id="ye5715c2b-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to protect the competitiveness of United States companies, privacy of United States consumers, and integrity and impartiality of standards-setting bodies and processes related to 5th and future generations wireless communications systems and infrastructure.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye5715c2c-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Designation</inline>.—</heading><content>The strategy developed under subsection (a) shall be known as the “National Strategy to Secure 5G and Next Generation Wireless Communications” (referred to in this Act as the “Strategy”).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye5715c2d-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The Strategy shall represent a whole-of-government approach and shall include the following:</chapeau><paragraph class="fontsize10" id="ye5715c2e-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>A description of efforts to facilitate domestic 5th and future generations wireless communications rollout.</content></paragraph>
<paragraph class="fontsize10" id="ye5715c2f-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>A description of efforts to assess the risks to and identify core security principles of 5th and future generations wireless communications infrastructure.</content></paragraph>
<paragraph class="fontsize10" id="ye5715c30-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>A description of efforts to address risks to the national security of the United States during development and deployment of 5th and future generations wireless communications infrastructure worldwide.</content></paragraph>
<paragraph class="fontsize10" id="ye5715c31-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>A description of efforts to promote responsible global development and deployment of 5th and future generations wireless communications, including through robust international engagement, leadership in the development of international standards, and incentivizing market competitiveness of secure 5th and future generation wireless communications infrastructure options.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye5715c32-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Public Consultation</inline>.—</heading><content>In developing the Strategy, the President shall consult with relevant groups that represent consumers or the public interest, private sector communications providers, and communications infrastructure and systems equipment developers.</content></subsection>
</section>
<section id="d233268e206" identifier="/us/pl/116/129/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>STRATEGY IMPLEMENTATION PLAN.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe5724693-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe5724694-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 180 days after the date of enactment of this Act, the President shall develop and submit to the appropriate committees of Congress an implementation plan for the Strategy (referred to in this Act as the “Implementation Plan”), which shall include, at a minimum, the following:</chapeau><paragraph class="fontsize10" id="ye5724695-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>A description of United States national and economic security interests pertaining to the deployment of 5th and future generations wireless communications systems and infrastructure.</content></paragraph>
<paragraph class="fontsize10" id="ye5724696-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe5724697-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p><p class="leftAlign firstIndent0 fontsize8" id="xe5724698-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>An identification and assessment of potential security threats and vulnerabilities to the infrastructure, equipment, systems, software, and virtualized networks that support 5th and future generations wireless communications systems, infrastructure, and enabling technologies, which shall, as practicable, include a comprehensive evaluation of the full range of threats to, and unique security challenges posed by, 5th and future generations wireless communications systems and infrastructure, as well as steps that public and private sector entities can take to mitigate those threats.</content></paragraph>
<paragraph class="fontsize10" id="ye5724699-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe572469a-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>An identification and assessment of the global competitiveness and vulnerabilities of United States manufacturers <page identifier="/us/stat/134/225">134 STAT. 225</page>
and suppliers of 5th and future generations wireless communications equipment.</content></paragraph>
<paragraph class="fontsize10" id="ye572469b-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe572469c-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p><p class="leftAlign firstIndent0 fontsize8" id="xe572469d-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>An evaluation of available domestic suppliers of 5th and future generations wireless communications equipment and other suppliers in countries that are mutual defense allies or strategic partners of the United States and a strategy to assess their ability to produce and supply 5th generation and future generations wireless communications systems and infrastructure.</content></paragraph>
<paragraph class="fontsize10" id="ye572469e-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Identification of where security gaps exist in the United States domestic or mutual defense treaty allies and strategic partners communications equipment supply chain for 5th and future generations wireless communications systems and infrastructure.</content></paragraph>
<paragraph class="fontsize10" id="ye572469f-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Identification of incentives and policy options to help close or narrow any security gaps identified under paragraph (5) in, and ensure the economic viability of, the United States domestic industrial base, including research and development in critical technologies and workforce development in 5th and future generations wireless communications systems and infrastructure.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a0-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>Identification of incentives and policy options for leveraging the communications equipment suppliers from mutual defense treaty allies, strategic partners, and other countries to ensure that private industry in the United States has adequate sources for secure, effective, and reliable 5th and future generations wireless communications systems and infrastructure equipment.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a1-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>A plan for diplomatic engagement with mutual defense treaty allies, strategic partners, and other countries to share security risk information and findings pertaining to 5th and future generations wireless communications systems and infrastructure equipment and cooperation on mitigating those risks.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a2-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>A plan for engagement with private sector communications infrastructure and systems equipment developers and critical infrastructure owners and operators who have a critical dependency on communications infrastructure to share information and findings on 5th and future generations wireless communications systems and infrastructure equipment standards to secure platforms.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a3-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>A plan for engagement with private sector communications infrastructure and systems equipment developers to encourage the maximum participation possible on standards-setting bodies related to such systems and infrastructure equipment standards by public and private sector entities from the United States.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a4-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>A plan for diplomatic engagement with mutual defense treaty allies, strategic partners, and other countries to share information and findings on 5th and future generations wireless communications systems and infrastructure equipment standards to promote maximum interoperability, competitiveness, openness, and secure platforms.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a5-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><content>A plan for diplomatic engagement with mutual defense treaty allies, strategic partners, and other countries to share information and findings on 5th and future generations wireless communications infrastructure and systems equipment concerning the standards-setting bodies related to such systems <page identifier="/us/stat/134/226">134 STAT. 226</page>
and infrastructure equipment to promote maximum transparency, openness, impartiality, integrity, and neutrality.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a6-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/13" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">(13) </num><content>A plan for joint testing environments with mutual defense treaty allies, strategic partners, and other countries to ensure a trusted marketplace for 5th and future generations wireless communications systems and infrastructure equipment.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a7-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/14" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">(14) </num><content>A plan for research and development by the Federal Government, in close partnership with trusted supplier entities, mutual defense treaty allies, strategic partners, and other countries to reach and maintain United States leadership in 5th and future generations wireless communications systems and infrastructure security, including the development of an ongoing capability to identify security vulnerabilities in 5th and future generations wireless communications systems.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a8-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/15" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">(15) </num><content>Options for identifying and helping to mitigate the security risks of 5th and future generations wireless communications systems and infrastructure that have security flaws or vulnerabilities, or are utilizing equipment sourced from countries of concern, and that have already been put in place within the systems and infrastructure of mutual defense treaty allies, strategic partners, and other countries, when in the security interests of the United States.</content></paragraph>
<paragraph class="fontsize10" id="ye57246a9-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/16" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">(16) </num><content>A description of the roles and responsibilities of the appropriate executive branch agencies and interagency mechanisms to coordinate implementation of the Strategy, as provided in section 5(d).</content></paragraph>
<paragraph class="fontsize10" id="ye57246aa-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/17" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="17">(17) </num><content>An identification of the key diplomatic, development, intelligence, military, and economic resources necessary to implement the Strategy, including specific budgetary requests.</content></paragraph>
<paragraph class="fontsize10" id="ye57246ab-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s4/18" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="18">(18) </num><content>As necessary, a description of such legislative or administrative action needed to carry out the Strategy.</content></paragraph>

<section id="d233268e331" identifier="/us/pl/116/129/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>LIMITATIONS AND BRIEFINGS.</heading><subsection class="firstIndent0 fontsize10" id="ye572bbdc-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><paragraph class="fontsize10" id="ye572bbdd-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Strategy and the Implementation Plan shall not include a recommendation or a proposal to nationalize 5th or future generations wireless communications systems or infrastructure.</content></paragraph>
<paragraph class="fontsize10" id="ye572bbde-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Federal agency authority</inline>.—</heading><content>Nothing in this Act shall be construed to limit any authority or ability of any Federal agency.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ye572bbdf-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Public Comment</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe572bbe0-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 60 days after the date of enactment of this Act, the President shall seek public comment regarding the development and implementation of the Implementation Plan.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye572bbe1-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><paragraph class="fontsize10" id="ye572bbe2-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe572bbe3-e829-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 21 days after the date on which the Implementation Plan is completed, the President shall direct appropriate representatives from the departments and agencies involved in the formulation of the Strategy to provide the appropriate committees of Congress a briefing on the implementation of the Strategy.</content></paragraph>
<paragraph class="fontsize10" id="ye572bbe4-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Unclassified setting</inline>.—</heading><content>The briefing under paragraph (1) shall be held in an unclassified setting to the maximum extent possible.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ye572bbe5-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><page identifier="/us/stat/134/227">134 STAT. 227</page>
<paragraph class="fontsize10" id="ye572bbe6-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The President and the National Telecommunications and Information Administration, in conjunction, shall—</chapeau><subparagraph class="fontsize10" id="ye572bbe7-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>implement the Strategy;</content></subparagraph>
<subparagraph class="fontsize10" id="ye572bbe8-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>keep congressional committees apprised of progress on implementation; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye572bbe9-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/d/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>not implement any proposal or recommendation involving non-Federal spectrum administered by the Federal Communications Commission unless the implementation of such proposal or recommendation is first approved by the Commission.</content></subparagraph>

<paragraph class="fontsize10" id="ye572bbea-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Nothing in this subsection shall be construed to affect the authority or jurisdiction of the Federal Communications Commission or confer upon the President or any other executive branch agency the power to direct the actions of the Commission, whether directly or indirectly.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye572bbeb-e829-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/129/s5/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The Strategy and Implementation Plan shall be submitted to the appropriate committees of Congress in unclassified form, but may include a classified annex.</content></subsection>
