<section id="d122533e92" identifier="/us/pl/116/122/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Protecting America’s Food and Agriculture Act of 2019</shortTitle>”.</content></section>
<section id="d122533e102" identifier="/us/pl/116/122/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDING.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x223def30-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds that—</chapeau><paragraph class="fontsize10" id="y223def31-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>it is in the national security interest of the United States to ensure that the Nation’s food supply is sufficiently protected; and</content></paragraph>
<paragraph class="fontsize10" id="y223def32-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a vital part of such protection is the availability of adequate resources at the border to conduct inspections of incoming food and agricultural goods.</content></paragraph>
</section>
<section id="d122533e119" identifier="/us/pl/116/122/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x223e3d53-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y223e3d54-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y223e3d55-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="y223e3d56-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s3/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="y223e3d57-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s3/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the Committee on Homeland Security of the House of Representatives; and</content></subparagraph>
<subparagraph class="fontsize10" id="y223e3d58-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s3/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the Committee on Agriculture of the House of Representatives.</content></subparagraph>

<paragraph class="fontsize10" id="y223e3d59-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">CBP</inline>.—</heading><content>The term “<term>CBP</term>” means U.S. Customs and Border Protection.</content></paragraph>

<section id="d122533e165" identifier="/us/pl/116/122/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x223e3d5a-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading>ADDITIONAL U.S. CUSTOMS AND BORDER PROTECTION PERSONNEL.</heading><subsection class="firstIndent0 fontsize10" id="y223ed99b-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">CBP Agriculture Specialists</inline>.—</heading><content>The Commissioner of U.S. Customs and Border Protection may hire, train, and assign 240 new CBP Agriculture Specialists above the current attrition level during every fiscal year until the total number of CBP Agriculture Specialists equals and sustains the requirements identified each year in the Agriculture Resource Allocation Model.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y223ed99c-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Mission and Operational Support Staff</inline>.—</heading><page identifier="/us/stat/134/144">134 STAT. 144</page>
<paragraph class="fontsize10" id="y223ed99d-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Commissioner of U.S. Customs and Border Protection may hire, train, and assign support staff to support CBP Agriculture Specialists.</content></paragraph>
<paragraph class="fontsize10" id="y223ed99e-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">CBP agriculture technicians</inline>.—</heading><content>The Commissioner of U.S. Customs and Border Protection may hire, train, and assign 200 new CBP Agriculture Technicians during each fiscal year until the total number of CBP Agriculture Technicians equals and sustains the requirements identified each year in the Mission and Operational Support Resource Allocation Model.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y223ed99f-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x223ed9a0-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">CBP Agriculture Canine Teams</inline>.—</heading><content>The Commissioner of U.S. Customs and Border Protection may hire, train, and assign 20 new CBP agriculture canine teams during each of the first 3 fiscal years beginning after the date of the enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y223f00b1-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Traffic Forecasts</inline>.—</heading><chapeau>In calculating the number of CBP Agriculture Specialists needed at each port of entry through the Agriculture Resource Allocation Model, the Office of Field Operations shall—</chapeau><paragraph class="fontsize10" id="y223f00b2-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>rely on data collected regarding the inspections and other activities conducted at each such port of entry; and</content></paragraph>
<paragraph class="fontsize10" id="y223f00b3-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>consider volume from seasonal surges, other projected changes in commercial and passenger volumes, the most current commercial forecasts, and other relevant information.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y223f00b4-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><paragraph class="fontsize10" id="y223f00b5-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">CBP agriculture specialists</inline>.—</heading><chapeau>There is authorized to be appropriated to carry out subsection (a)—</chapeau><subparagraph class="fontsize10" id="y223f00b6-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>$29,900,000 for fiscal year 2020;</content></subparagraph>
<subparagraph class="fontsize10" id="y223f00b7-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>$36,100,000 for fiscal year 2021; and</content></subparagraph>
<subparagraph class="fontsize10" id="y223f00b8-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>$40,500,000 for fiscal year 2022.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y223f00b9-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">CBP agriculture technicians</inline>.—</heading><chapeau>There is authorized to be appropriated to carry out subsection (b)—</chapeau><subparagraph class="fontsize10" id="y223f00ba-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>$11,000,000 for fiscal year 2020;</content></subparagraph>
<subparagraph class="fontsize10" id="y223f00bb-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>$25,000,000 for fiscal year 2021; and</content></subparagraph>
<subparagraph class="fontsize10" id="y223f00bc-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>$38,000,000 for fiscal year 2022.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y223f00bd-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">CBP agriculture canine teams</inline>.—</heading><chapeau>There is authorized to be appropriated to carry out subsection (c)—</chapeau><subparagraph class="fontsize10" id="y223f00be-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>$3,500,000 for fiscal year 2020;</content></subparagraph>
<subparagraph class="fontsize10" id="y223f00bf-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>$7,400,000 for fiscal year 2021; and</content></subparagraph>
<subparagraph class="fontsize10" id="y223f00c0-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>$12,200,000 for fiscal year 2022.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y223f00c1-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s4/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Training</inline>.—</heading><content>There is authorized to be appropriated for training costs associated with the new CBP personnel and canine teams hired pursuant to subsections (a), (b), and (c) $6,000,000 for each of the fiscal years 2020, 2021, and 2022.</content></paragraph>

<section id="d122533e332" identifier="/us/pl/116/122/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>GAO STUDY, BRIEFING, AND REPORT.</heading><subsection class="firstIndent0 fontsize10" id="y223f27d2-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x223f27d3-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x223f27d4-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Study</inline>.—</heading><chapeau>The Comptroller General of the United States, after consultation with the appropriate congressional committees, shall conduct a review of the efforts of the Department of Homeland Security, the Department of Agriculture, and other Federal agencies to address risks to the agricultural supply that analyzes—</chapeau><paragraph class="fontsize10" id="y223f27d5-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>interagency coordination and the distribution of responsibilities among Federal agencies with respect to the inspection of agricultural commodities entering the United States;</content></paragraph>
<paragraph class="fontsize10" id="y223f27d6-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the effectiveness of such inspection responsibilities among Federal agencies; and<page identifier="/us/stat/134/145">134 STAT. 145</page></content></paragraph>
<paragraph class="fontsize10" id="y223f27d7-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the training provided to, and working conditions of, CBP Agriculture Specialists.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y223f27d8-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x223f27d9-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall brief the appropriate congressional committees regarding the results of the study conducted pursuant to subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y223f27da-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/122/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x223f27db-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 90 days after the briefing required under subsection (b), the Comptroller General shall complete the study required under subsection (a) and make the results of the study available to the public.</content></subsection>
