<section id="d234581e102" identifier="/us/pl/116/121/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Presidential Transition Enhancement Act of 2019</shortTitle>”.</content></section>
<section id="d234581e112" identifier="/us/pl/116/121/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PRESIDENTIAL TRANSITION ENHANCEMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y35e92f2a-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 3 of the Presidential Transition Act of 1963 (<ref href="/us/usc/t3/s102">3 U.S.C. 102 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y35e92f2b-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y35e92f2c-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35e92f2d-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>in the matter preceding paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>upon request,</quotedText>” and all that follows through “<quotedText>including</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>upon request, to each President-elect, each Vice-President-elect, and, for up to 60 days after the date of the inauguration of the President-elect and Vice-President-elect, each President and Vice President, for use in connection with the preparations for the assumption of official duties as President or Vice President necessary services and facilities, including</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y35e92f2e-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>in paragraph (2)—</chapeau><clause class="fontsize10" id="y35e92f2f-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, or an employee of a committee of either House of Congress, a joint committee of the Congress, or an individual Member of Congress,</quotedText>” after “<quotedText>any branch of the Government</quotedText>”; and</content></clause>
<clause class="fontsize10" id="y35e92f30-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, or in the case of an employee in a position in the legislative branch, with the consent of the supervising Member of Congress</quotedText>” after “<quotedText>with the consent of the head of the agency</quotedText>”;</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y35e92f31-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (b) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y35e95542-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><chapeau>The Administrator shall expend funds for the provision of services and facilities under this section—</chapeau><paragraph class="fontsize10" id="y35e95543-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35e95544-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><chapeau>in connection with any obligation incurred by the President-elect or Vice-President-elect, or after the inauguration of the President-elect as President and the inauguration of the Vice-President-elect as Vice President incurred by the President or Vice President, during the period—</chapeau><subparagraph class="fontsize10" id="y35e95545-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>beginning on the day after the date of the general elections held to determine the electors of the President and Vice President under section 1 or 2 of <ref href="/us/usc/t3">title 3, United States Code</ref>; and<page identifier="/us/stat/134/139">134 STAT. 139</page></content></subparagraph>
<subparagraph class="fontsize10" id="y35e95546-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>ending on the date that is 60 days after the date of such inauguration; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y35e95547-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>without regard to whether the President-elect, Vice-President-elect, President, or Vice President submits to the Administrator a request for payment regarding services or facilities before the end of such period.”</content></paragraph>
</subsection>
</quotedContent>;</content></paragraph>
<paragraph class="fontsize10" id="y35e95548-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in subsection (h)(2)(B)(ii), by <amendingAction type="delete">striking</amendingAction> “<quotedText>computers</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>information technology</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y35e95549-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>By <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y35e9a36a-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Memorandums of Understanding</inline>.—</heading><paragraph class="fontsize10" id="y35e9a36b-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35e9a36c-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than September 1 of a year during which a Presidential election occurs, the Administrator shall, to the maximum extent practicable, enter into a memorandum of understanding with each eligible candidate, which shall include, at a minimum, the conditions for the administrative support services and facilities described in subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y35e9a36d-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Existing resources</inline>.—</heading><content>To the maximum extent practicable, a memorandum of understanding entered into under paragraph (1) shall be based on memorandums of understanding relating to previous Presidential transitions.</content></paragraph>
<paragraph class="fontsize10" id="y35e9a36e-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Transition representative</inline>.—</heading><subparagraph class="fontsize10" id="y35e9a36f-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Designation of representative for inquiries</inline>.—</heading><content>Each memorandum of understanding entered into under this subsection shall designate a representative of the eligible candidate to whom the Administrator shall direct any inquiries or legal instruments regarding the records of the eligible candidate that are in the custody of the Administrator.</content></subparagraph>
<subparagraph class="fontsize10" id="y35e9a370-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Change in transition representative</inline>.—</heading><content>The designation of a new individual as the transition representative of an eligible candidate shall not require the execution of a new memorandum of understanding under this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="y35e9a371-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Termination of designation</inline>.—</heading><chapeau>The designation of a transition representative under a memorandum of understanding shall terminate—</chapeau><clause class="fontsize10" id="y35e9a372-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>not later than September 30 of the year during which the inauguration of the President-elect as President and the inauguration of the Vice-President-elect as Vice President occurs; or</content></clause>
<clause class="fontsize10" id="y35e9a373-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>before the date described in clause (i), upon request of the President-elect or the Vice-President-elect or, after such inauguration, upon request of the President or the Vice President.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y35e9a374-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Amendments</inline>.—</heading><content>Any amendment to a memorandum of understanding entered into under this subsection shall be agreed to in writing.</content></paragraph>
<paragraph class="fontsize10" id="y35e9a375-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35e9a376-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Prior notification of deviation</inline>.—</heading><content>Each party to a memorandum of understanding entered into under this subsection shall provide written notice, except to the extent prohibited under another provision of law, not later than 3 days before taking any action that deviates from the terms and conditions agreed to in the memorandum of understanding.</content></paragraph>
<paragraph class="fontsize10" id="y35e9a377-e82a-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>In this subsection, the term ‘<term>eligible candidate</term>’ has the meaning given that term in subsection (h)(4).”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y35e9a378-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Agency Transitions</inline>.—</heading><chapeau>Section 4 of the Presidential Transition Act of 1963 (<ref href="/us/usc/t3/s102">3 U.S.C. 102 note</ref>) <amendingAction type="amend">is amended</amendingAction>—<page identifier="/us/stat/134/140">134 STAT. 140</page></chapeau><paragraph class="fontsize10" id="y35e9a379-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y35e9a37a-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></subparagraph>
<subparagraph class="fontsize10" id="y35e9a37b-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraph (4) as paragraph (5); and</content></subparagraph>
<subparagraph class="fontsize10" id="y35e9a37c-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (3) the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="y35e9ca8d-e82a-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>the term ‘<term>nonpublic information</term>’—</chapeau><subparagraph class="fontsize10" id="y35e9ca8e-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>means information from the Federal Government that a member of a transition team obtains as part of the employment of the member that such member knows or reasonably should know has not been made available to the general public; and</content></subparagraph>
<subparagraph class="fontsize10" id="y35e9ca8f-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>includes information that a member of the transition team knows or reasonably should know—</chapeau><clause class="fontsize10" id="y35e9ca90-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is exempt from disclosure under <ref href="/us/usc/t5/s552">section 552 of title 5, United States Code</ref>, or otherwise protected from disclosure by law; and</content></clause>
<clause class="fontsize10" id="y35e9ca91-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>is not authorized by the appropriate government agency or officials to be released to the public; and”</content></clause>
</subparagraph>
</paragraph>

</paragraph>
<paragraph class="fontsize10" id="y35e9ca92-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraphs (C) and (D) of subsection (e)(3), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>serving in a career position</quotedText>” after “<quotedText>senior representative</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y35e9ca93-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (f)(2) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y35e9ca94-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35e9ca95-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x35e9ca96-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Succession plan.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Acting officers</inline>.—</heading><content>Not later than September 15 of a year during which a Presidential election occurs, and in accordance with <ref href="/us/usc/t5/ch33/schIII">subchapter III of chapter 33 of title 5, United States Code</ref>, the head of each agency shall ensure that a succession plan is in place for each senior noncareer position in the agency.”</content></paragraph>

<paragraph class="fontsize10" id="y35e9ca97-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>in subsection (g)—</chapeau><subparagraph class="fontsize10" id="y35e9ca98-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>November 1</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>October 1</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y35e9ca99-e82a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/121/s2/b/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="y35ea66da-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Ethics plan</inline>.—</heading><subparagraph class="fontsize10" id="y35ea66db-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35ea66dc-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Each memorandum of understanding under paragraph (1) shall include an agreement that the eligible candidate will implement and enforce an ethics plan to guide the conduct of the transition beginning on the date on which the eligible candidate becomes the President-elect.</content></subparagraph>
<subparagraph class="fontsize10" id="y35ea66dd-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The ethics plan shall include, at a minimum—</chapeau><clause class="fontsize10" id="y35ea66de-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35ea66df-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>a description of the ethics requirements that will apply to all members of the transition team, including any specific requirement for transition team members who will have access to nonpublic or classified information;</content></clause>
<clause class="fontsize10" id="y35ea66e0-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>a description of how the transition team will—</chapeau><subclause class="fontsize10" id="y35ea66e1-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><chapeau>address the role on the transition team of—</chapeau><item class="fontsize10" id="y35ea66e2-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>lobbyists registered under the Lobbying Disclosure Act of 1995 (<ref href="/us/usc/t2/s1601/etseq">2 U.S.C. 1601 et seq.</ref>) and individuals who were former lobbyists registered under that Act; and</content></item>
<item class="fontsize10" id="y35ea66e3-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>persons registered under the Foreign Agents Registration Act of 1938 (<ref href="/us/usc/t22">22 U.S.C. </ref><page identifier="/us/stat/134/141">134 STAT. 141</page>
611 et seq.), foreign nationals, and other foreign agents;</content></item>
</subclause>
<subclause class="fontsize10" id="y35ea66e4-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>prohibit a transition team member with conflicts of interest similar to those applicable to Federal employees under <ref href="/us/cfr/t5/s2635.402/a) and section 2635.502(a">section 2635.402(a) and section 2635.502(a) of title 5, Code of Federal Regulations</ref>, related to current or former employment, affiliations, clients, or investments, from working on particular matters involving specific parties that affect the interests of such member; and</content></subclause>
<subclause class="fontsize10" id="y35ea66e5-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>address how the covered eligible candidate will address his or her own conflicts of interest during a Presidential term if the covered eligible candidate becomes the President-elect;</content></subclause>
</clause>
<clause class="fontsize10" id="y35ea66e6-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>a Code of Ethical Conduct, which each member of the transition team will sign and be subject to, that reflects the content of the ethics plans under this paragraph and at a minimum requires transition team members to—</chapeau><subclause class="fontsize10" id="y35ea66e7-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>seek authorization from transition team leaders or their designees before seeking, on behalf of the transition, access to any nonpublic information;</content></subclause>
<subclause class="fontsize10" id="y35ea66e8-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>keep confidential any nonpublic information provided in the course of the duties of the member with the transition and exclusively use such information for the purposes of the transition; and</content></subclause>
<subclause class="fontsize10" id="y35ea66e9-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>not use any nonpublic information provided in the course of transition duties, in any manner, for personal or private gain for the member or any other party at any time during or after the transition; and</content></subclause>
</clause>
<clause class="fontsize10" id="y35ea66ea-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>a description of how the transition team will enforce the Code of Ethical Conduct, including the names of the members of the transition team responsible for enforcement, oversight, and compliance.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y35ea66eb-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35ea66ec-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Publicly available</inline>.—</heading><chapeau>The transition team shall make the ethics plan described in this paragraph publicly available on the internet website of the General Services- <page identifier="/us/stat/134/142">134 STAT. 142</page>
Administration the earlier of—</chapeau><clause class="fontsize10" id="y35ea66ed-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the day on which the memorandum of understanding is completed; or</content></clause>
<clause class="fontsize10" id="y35ea66ee-e82a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>October 1.”</content></clause>
