<section id="d123702e94" identifier="/us/pl/116/108/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Securing American Nonprofit Organizations Against Terrorism Act of 2019</shortTitle>”.</content></section>
<section id="d123702e104" identifier="/us/pl/116/108/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>NONPROFIT SECURITY GRANT PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="ye957059b-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/108/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subtitle A of title XX of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s601/etseq">6 U.S.C. 601 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<quotedContent><section class="indentUp2 firstIndent-2" id="ye95753bc-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="2009">“SEC. 2009. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe95753bd-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s609a">6 USC 609a</ref>.</p></sidenote><heading class="bold">NONPROFIT SECURITY GRANT PROGRAM.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="ye95753be-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established in the Department a program to be known as the ‘Nonprofit Security Grant Program’ (in this section referred to as the ‘Program’). Under the Program, the Secretary, acting through the Administrator, shall make grants to eligible nonprofit organizations described in subsection (b), through the State in which such organizations are located, for target hardening and other security enhancements to protect against terrorist attacks.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye95753bf-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Eligible Recipients</inline>.—</heading><chapeau>Eligible nonprofit organizations described in this subsection (a) are organizations that are—</chapeau><paragraph class="fontsize10" id="ye95753c0-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code; and</content></paragraph>
<paragraph class="fontsize10" id="ye95753c1-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>determined to be at risk of a terrorist attack by the Administrator.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye95753c2-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Permitted Uses</inline>.—</heading><chapeau>The recipient of a grant under this section may use such grant for any of the following uses:</chapeau><paragraph class="fontsize10" id="ye95753c3-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Target hardening activities, including physical security enhancement equipment and inspection and screening systems.</content></paragraph>
<paragraph class="fontsize10" id="ye95753c4-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Fees for security training relating to physical security and cybersecurity, target hardening, terrorism awareness, and employee awareness.</content></paragraph>
<paragraph class="fontsize10" id="ye95753c5-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Any other appropriate activity, including cybersecurity resilience activities, as determined by the Administrator.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye95753c6-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Period of Performance</inline>.—</heading><content>The Administrator shall make funds provided under this section available for use by a recipient of a grant for a period of not less than 36 months.<page identifier="/us/stat/133/3295">133 STAT. 3295</page></content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye95753c7-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>The Administrator shall annually for each of fiscal years 2020 through 2024 submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report containing information on the expenditure by each grant recipient of grant funds made under this section.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye9577ad8-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><paragraph class="fontsize10" id="ye9577ad9-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>There is authorized to be appropriated $75 million for each of fiscal years 2020 through 2024 to carry out this section.</content></paragraph>
<paragraph class="fontsize10" id="ye9577ada-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Specification</inline>.—</heading><chapeau>Of the amounts authorized to be appropriated pursuant to paragraph (1)—</chapeau><subparagraph class="fontsize10" id="ye9577adb-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>$50 million is authorized for eligible recipients located in jurisdictions that receive funding under section 2003; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye9577adc-e82a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>$25 million is authorized for eligible recipients in jurisdictions not receiving funding under section 2003.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="ye9577add-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/108/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>Subsection (a) of section 2002 of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s603">6 U.S.C. 603</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>sections 2003 and 2004</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>sections 2003, 2004, and 2009</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye9577ade-e82a-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/108/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Clerical Amendment</inline>.—</heading><content>The table of contents in section 1(b) of the Homeland Security Act of 2002 <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after the item relating to section 2008 the following new item:<quotedContent><?GPOvSpace 04?>
